Trump DOJ seized House Democrats' data from Apple

rump administration officials subpoenaed Apple for data on accounts belonging to at least two Democrats on the House Intelligence Committee, congressional aides and their family members to find who was behind the leaks of classified information, The New York Times reported on Thursday
Committee officials and sources with knowledge of the inquiry told the Times that records belonging to at least a dozen people, including House Intelligence Chairman Adam Schiff (D-Calif.), were seized in 2017 and 2018. Data that belonged to family members, including at least one minor, was also seized.
One source told the Times that Apple turned over metadata and account information, but did not provide photos, emails or other content.
According to the Times, prosecutors under former Attorney General Jeff Sessions were looking to identify sources who were speaking to members of the media about contact between Trump associates and Russia.
The data seized in the investigations ultimately did not connect the Intelligence Committee to the information leaks; however, Sessions's successor William Barr later revived the investigation, moving a trusted New Jersey prosecutor, Osmar Benvenuto, into the main branch of the Department of Justice (DOJ) to continue the investigation into Schiff and around half a dozen other people, according to the Times.

House Intelligence Committee ranking member Devin Nunes (R-Calif.) said Sunday that it was “sickening” that Chairman Adam Schiff (D-Calif.) had obtained his phone records as part of the House’s impeachment inquiry.
“I think the whole thing is just sickening, but he did it to one of my current staff members and one of my former staff members who he doesn’t like,” Nunes said on Fox News's “Sunday Morning Futures.”

Readers of the New York Times may have been shocked to read their report on the Trump-era Department of Justice’s secret search warrants on communications of members of Congress. Friends and colleagues of federal prosecutor Osmar Benvenuto were even more shocked to find him characterized as a “crony” of then-AG William Barr. The New Jersey Democrat got tapped for the job over his own misgivings, not because he knew Barr but because Barr had been told that Benvenuto was a tough, action-oriented independent thinker within the DoJ.
This recasting of Benvenuto’s background by Politico’s Josh Gerstein puts an entirely different light on Barr’s actions last year:
Associates said Osmar Benvenuto, 39, had misgivings about taking the assignment because he feared he might be seen as tarnished by the work given the perceived politicization of the Justice Department under Attorney General William Barr, but the New Jersey-based career prosecutor ultimately decided to accept the job after friends counseled him to do so.
Several of Benvenuto’s friends and mentors said they found it utterly implausible that he would have taken on a political mission for the Trump administration. For one thing, Benvenuto is registered to vote in New Jersey as a Democrat and previously registered as a Democrat in New York City.

The Trump Justice Department was not alone in suspecting that congressional Democrats leaked sensitive information to reporters about the Russia probe, according to text messages reviewed by the Washington Free Beacon.
Peter Strzok, the top FBI investigator on the inquiry into Russian interference in the 2016 election, sent text messages to colleagues in March 2017 speculating that Democrats from the House Intelligence Committee and on the so-called Gang of Eight were behind media leaks.
The messages could shed new light on a New York Times report that prosecutors subpoenaed Apple for metadata from the phones of Reps. Adam Schiff (D., Calif.) and Eric Swalwell (D., Calif.) as part of the leak hunt. Schiff is chairman of the House Intelligence Committee, and Swalwell has served on the panel since 2015. Prosecutors sought the lawmakers’ records in order to ascertain the sources for stories published in 2017 and 2018 regarding possible links between Trump associates and Russians. Prosecutors empaneled a grand jury as part of the probe, which was quietly closed without charges.
Schiff and House Speaker Nancy Pelosi (D., Calif.) decried the report, saying that Trump weaponized the Justice Department to investigate his political opponents. But Strzok’s FBI text messages show that even investigators scrutinizing Trump suspected that Democrats were behind two separate leaks to reporters.
Strzok wrote on March 17, 2017, of a leak of documents to an unnamed reporter who he said "has great sources on [the House Permanent Select Committee on Intelligence], especially minority side." Democrats were in the minority of Congress at the time.
