Texas Supreme Court denies petition challenging New Braunfels 'can ban'

NEW BRAUNFELS -- The Texas Supreme Court denied a petition for review Friday that challenges New Braunfels' longtime "can ban."

The ordinance, also referred to as the can ban, prohibits the use of can or any disposable items on the river, keeping the river cleaner and improving the health and safety of the city's waterways, according to the city.

The Stop The Ordinances Please Association filed a petition for review in its lawsuit challenging the New Braunfels Disposable Container and Cooler Size Ordinances.

The Texas Supreme Court denied the review and will allow the city and everyone involved to move forward in making the ordinances work and benefit the citizens of New Braunfels, according to a press release.

   Very disappointed in this court decision.  Many of us lobbied hard against the 'Can Ban', winning a temporary injunction the first summer and recalling the City Council member who had the original brain fart.  It is now officially over, Freedom has another layer peeled away.

I have no problem with the can ban.  Who wants to float the river with discarded trash/cans everywhere.  It's bad enough to have drunks on the river, when there are families there as well.  Makes for a bad combination.

@corbe  What's stopping the Council from lifting the ban?  Why rely on a court to do the heavy lifting?

   The Council wants the BAN, it's for the Environment, though they still pay a hefty sum every year to clean the debris from the River.  Someone's Brother in Law has the contract, no doubt.  You can drink anything you like on the River, it just must be in a non disposable container.  These sell like hot cakes.

   The 'O'riginal plan was to Ban Beer on the River, when the Legislature told them to go pizz up a rope, they reworded it for disposable containers, hence 'Ban the Can'.

We once had a place called "Tin Can Beach," though not affectionately so.

   Don't think the Comal/Guadalupe River has EVER been as bad as Tin Can Beach @truth_seeker

   We use to have a place up near Austin called Hippy Hollow (Nude was optional), until the perverts ruined it.   
   Austin suxs, IMHO.
