WHEN THE JUDGE GAGS A KEY WITNESS FOR TRUMP’S DEFENSE. The false bookkeeping trial of former President Donald Trump is now in its fourth week. This newsletter has pointed out lots of times, most recently last Friday, that while we know that Manhattan District Attorney Alvin Bragg has charged Trump with falsifying bookkeeping records of a nondisclosure payment in order to commit or conceal another crime, Bragg still hasn’t revealed what that other crime is. It’s really the key to the whole case. Without the other crime, there would be no charges against Trump in this matter. The fact that we — and that includes the defendant — still don’t know what the other crime is is one of the great injustices of a felony prosecution that never should have happened.

But now we’re getting an idea of where prosecutors are going. Perhaps the leading theory — they’re all just theories — of the other crime is that in addition to violating New York’s misdemeanor law against falsifying bookkeeping records, Trump also violated another New York misdemeanor law, 17-152, which prohibits conspiring “to promote or prevent the election of any person to a public office by unlawful means.” Put those two misdemeanors together, and bingo! Trump stands accused of 34 felony counts, which could put him in prison for a maximum of 136 years.

Obviously 17-152 depends on specifying what “unlawful means” the defendant used to promote or prevent the election of any person. Otherwise, it’s just campaigning. So at some point prosecutors will have to reveal what those “unlawful means” were. But here’s something that nonlawyers should know: To win a felony conviction, Bragg does not have to prove Trump committed the other crime, whatever it might be. “The statute does not require a defendant to actually be convicted of the ‘other crime,’ but merely that he intend to commit another crime,” wrote the judge in the case, Juan Merchan, on Feb. 15. “The focus here is on the element of intent.”

Hamas publishes the cease-fire proposal it agreed to

BEIRUT — Hamas has published a copy of the cease-fire and hostage release proposal that the militant group said it had agreed to on Monday.

The framework brought forward by Qatar and Egypt aims to bring a halt to seven months of war in Gaza. However, it’s unclear if Israel will agree to the terms.

The proposal outlines a phased release of Israeli hostages held in Gaza alongside the gradual withdrawal of Israeli troops from the entire enclave and ending with a “sustainable calm” or “permanent cessation of military and hostile operations.”

Israel has previously said it would not agree to either a full withdrawal of its forces or a permanent cease-fire as part of a hostage release deal.

The first stage would last 42 days and would involve a partial withdrawal of Israeli forces from the Gaza Strip and the release of about 33 hostages held in the territory, including the remaining Israeli women — both civilians and soldiers — as well as children, older adults and people who are ill.

Thirty Palestinian prisoners held in Israel would be released in exchange for each Israeli civilian hostage and 50 in exchange for each female soldier.

Palestinians displaced in Gaza would be allowed to return to their home neighborhoods during that time.

The parties would then negotiate the terms of the next stage, under which the remaining civilian men and soldiers would be released, while Israeli forces would withdraw from the rest of Gaza. This phase would be conditioned on achievement of a “sustainable calm.”

The final stage would involve exchange of the bodies of hostages who died in captivity and the beginning of a reconstruction plan for the enclave that would take place over three to five years “under the supervision of a number of countries and organizations, including: Egypt, Qatar and the United Nations.”

Biden Administration Refuses to Say if It Is Withholding Aid from Israel

The Biden administration is refusing to comment on if it is withholding aid from Israel after a Sunday report said that it was.

Axios reported Sunday that two Israeli officials said the Biden administration put a hold on a shipment of U.S.-made ammunition to Israel.

On Monday, the White House would neither confirm nor deny it.

A reporter asked National Security Council Coordinator for Strategic Communications John Kirby during a White House briefing if the report was true.

Kirby responded, “I’m not gonna confirm that reporting.”

Irreconcilable Differences: Johnson on Brink of Permanent Power Sharing Agreement with Democrats as MTG, Massie Meeting Fails to Produce Accord with Republicans

Speaker Mike Johnson (R-LA) failed to concede to Reps. Marjorie Taylor Greene (R-GA) and Thomas Massie (R-KY) after a two-hour meeting Monday in which the duo continued pressing for Johnson to resign and end his coalition government with Democrats.

Greene told reporters after the meeting that she and Massie “had a very long discussion with Speaker Johnson. We’ll be meeting with him again tomorrow based on the discussion and then I’ll have more information.”

The two conservative lawmakers have insisted that Johnson is compromised and will not be Speaker next Congress. They called for him to step down so Republicans can begin moving forward, arguing Johnson’s unofficial lame duck status will hurt Republicans as they fundraise and campaign for November’s elections.

“I have been patient, I have been diligent. I have been steady. And I’ve been focused on the facts,” Greene said. “And none of that has changed.”

The meeting came one day after House Minority Leader Hakeem Jeffries (D-NY) bragged on CBS about controlling the House floor agenda — a characterization many conservatives agree with.

“Even though we’re in the minority, we effectively have been governing as if we were in the majority because we continue to provide a majority of the votes necessary to get things done,” he said. “Those are just the facts.”
