The Supreme Court on Thursday blocked, for now, the Trump administration's plan to include a question on the 2020 census that inquires about a person’s citizenship status.
The court said the administration's explanation for adding such a question is insufficient and sent it back to the lower courts for further consideration. The ruling marks a setback for the administration, though the issue is not yet resolved.
Still, while further lower-court litigation is possible, it would be very difficult for the administration to get the question on the census in time for the forms to be printed by the government’s own self-declared summer deadline.
The 5-4 court majority raised concerns about the Trump administration’s explanations for their proposal. The ruling, authored by Chief Justice John Roberts, said that the court was presented "with an explanation for agency action that is incongruent with what the record reveals about the agency’s priorities and decision making process."
Sounds to me like the Trump administration fed the SCOTUS some BS lie that was so disrespectfully stupid it insulted the intelligence of the Chief Justice. #ArtoftheDeal

In a dissenting opinion, Thomas wrote that "For the first time ever, the court invalidates an agency action solely because it questions the sincerity of the agency's otherwise adequate rationale."
"This conclusion is extraordinary," he wrote. "The court engages in an unauthorized inquiry into evidence not properly before us to reach an unsupported conclusion."
HE got it exactly right!

The decision raises the question of whether the administration will have enough time or the ability to add the citizenship question before the census begins. The administration previously told the court that the questionnaire needed to be printed by the end of June.
I expect they are celebrating too.

I agree. Either the agency has the authority or it doesn't. If it does, shouldn't the propriety of the census question be viewed merely under the "rational basis" standard? What is the SCOTUS doing rendering its opinion of the Trump administration's "sincerity?" Clearly, Roberts has joined the libs to fend off what he fears will be attacks on the Court's impartiality. And he's done so by confirming the Court's partiality (and cowardice).

I think the unspoken purpose of this decision was to ensure the question would not be asked, right or wrong. There is no way now it can be corrected before the Census forms go to print. A Safe Harbor was just thrown away.
They could have allowed the question, then later ordered the result to be ignored, but now that will be impossible because the data can't be collected in the first place.

My daughter's marrying a great guy from a warm and loving family. As a father, I couldn't be more fortunate. CL, my quads are healed enough for me to walk her down the aisle, although I've warned her not to expect Fred Astaire for the daddy - daughter dance!

I remember when you told us about it, and I cringed, having dealt with cut ligaments. I knew healing was going to be a long, long proposition. My heart is out to you, I've been there.
We've had our differences, but enjoy the wedding! You've earned it. This is real life, not an academic discussion about politics and policy.
