Title: Judge blocks Trump policy allowing states to refuse refugees
Post by: Elderberry on January 15, 2020, 09:29:57 pm
Houston Chronicle by  Lomi Kriel Jan. 15, 2020

A federal judge on Wednesday blocked an executive order allowing state and city authorities to refuse to resettle refugees, just days after Republican Gov. Greg Abbott made Texas the first and only state to opt out of the program.

In the 31-page decision, U.S. District Judge Peter J. Messitte said that that the new consent requirement is probably “unlawful.”

“Giving states and local governments the power to consent to the resettlement of refugees — which is to say veto power to determine whether refugees will be received in their midst — flies in the face of clear Congressional intent,” Messitte wrote. “One is left to wonder exactly what the rationale is for doing away entirely with a process that has worked so successfully for so long.”

A spokesman for Abbott, who has said Texas has long resettled the most refugees in the country, did not immediately comment.

"Probably unlawful?"  Either it is or it isn't.

Well, what do I expect? He was appointed by Clinton, so probably a liberal idiot.

I have to revise my ambitions.
Being President of the United States....apparently is nothing.
I need to become an anonymous Judge somewhere/anywhere?
Then I can override the President any time I like,
if he does something that I personally disagree with.
F**k the President....I am in charge of everything!

So which judicial body will this get appealed to next? Hopefully a GOP friendly court.

The White House could appeal Messitte’s ruling to the Fourth Circuit Court of Appeals. Bradley Philip Humphreys, the assistant U.S. Attorney representing Trump, could not be reached Wednesday for comment.

This guy is a district court judge in Maryland.  He has no authority over what Texas does.

btw, Messite was the same judge who allowed the Emoluments case against Trump to go forward.  It was eventually tossed out by a unanimous ruling from the Fourth Circuit Court of Appeals.

If I were Governor Abbott, I would just stop any movements of refugees to the state and ignore this ruling.

What is a doofus judge going to do?  Send armed guards to escort them it?

Time to reign in the judicial as a farce and extra-constitutional entity.

All the way from Maryland.

"Probably unlawful?"  Either it is or it isn't.

Sounds like a real quick path to being overturned at appeals.

Part of the settlement should have included a full retraction every hour by CNN for 72 hours. The others are not covering it because they know they are next.

The Texas Minute for 1/16/2020 by Michael Quinn Sullivan (Email)

Quote
A federal judge in Maryland, appointed by President Bill Clinton, has blocked Texas Gov. Greg Abbott’s rejection of refugee placements in the Lone Star State. Confused? Last year the Trump Administration issued an executive allowing states to opt out of the federal refugee resettlement program. Gov. Abbott recently became the first governor to utilize the new authority by sending an “opt-out” letter to U.S. Secretary of State Mike Pompeo.

•  As Brandon Waltens reports, the federal judge’s order on Wednesday states the judge’s belief the executive order “does not appear to serve the overall public interest” and placed a preliminary injunction on the ability of governors to opt-out.

•  So a liberal federal judge in Maryland knows what’s in Texas’ “public interest” better than Texans? Too many federal judges – especially those appointed by Democrats – can best be described as black-robed philosopher-kings legislating from the bench – imposing their will on the public. No, it’s not what our founding fathers intended for the judiciary.

I wonder what is the public interest in allowing any refugees in anyway?

There really is no benefit to America other than a globalistic perspective.

And any refugee taken in here by definition is one that ultimately must return home once the rationale of being a refugee is over, ie - the home country stabilizes.
