Tom Petty's family says it sent cease-and-desist letter to Trump after Tulsa rally featured 'I Won't Back Down'

Tom Petty's family says they sent a cease-and-desist notice to President Donald Trump's reelection campaign after the late musician's song "I Won't Back Down" was used during the president's Tulsa rally.

In a statement on Twitter, Petty's family says the song was used without permission.

"Trump was in no way authorized to use this song to further a campaign that leaves too many Americans and common sense behind," reads a statement on Petty's Twitter account, signed by daughters Adria and Annakim along with his widow Dana Petty and ex-wife Jane Benyo.

"Both the late Tom Petty and his family firmly stand against racism and discrimination of any kind. Tom Petty would never want a song of his used for a campaign of hate. He liked to bring people together."

Well, if Trump did not have permission frim whoever owns the song, then he was wrong to use it and could be liable for damages.  So yes, while the family may be hated by Trump supporters, they could be right in this situation.  Now I don't knw if they own the rights to Petty's music or not, but whoever does could have a case if no permission to use the song was granted.

If the campaign paid the licensing fee, then the Petty estate has no grounds for complaint. In other words, they can STFU.

Exactly.

At any rate....whether or not the campaign paid the licensing fee or not... it would seem that the family name fits them to a perfect "T".  And petty is as petty does (which goes for those petty posters here).

If we respected the original intent of the founders, that song wouldn't be owned by anyone by now. Our Constitution only allows creators the rights to hold copyright for a limited time. That used to be 28 years. It did not allow for that copyright to be transferable or an inherited property.

As the creator of the song is now deceased, claiming a copyright on a dead man's work should be unconstitutional, but we threw that out in the 1970s.

That's just it.  Did the campaign pay for permission to use the song and if so, to whom?  You're correct if the family does not own the rights to the music, they have no right to complain.   

This is like last week's story about one of the Village People complaining about use of their song, YMCA.  The guy did not own the music and Trump had an agreement with whoever does own it; so this guy can complain all he wants, but he cannot prevent Trump from using the song.

dont you think his lawyers have this covered?  I mean, musicians have been bitching about republicans using their music at rallies for about four decades now. Jeez

Fine. Have them compile a list of radio stations and private citizens who have played that song without permission that they have sued,and then go forward from there.

Plenty with long term sobriety like Clapton,Ringo,  Elton JOhn, Bonnie Raitt, Alice Cooper, others.

Well,probably the truest words you will ever hear are "If it were easy to quit,no one would be an addict."

It really does grab people at the genetic level,and that's what makes it almost impossible to resist. If you have addicts in your family,do NOT drink alcohol or take narcotic drugs. Not even once. No matter how strong-willed you might think you are,your own compulsions are stronger.

On the other hand,if no one in your family has a history of addiction,"Party ON,Dude/Dudette!"

My maternal Grandfather was a functioning alcoholic. Only 4 children out of 7 (Including my mother) that did not have problems with the bottle. Half of my cousins have alcohol issues. I used to have more than 1 or 2 back in the day, but now, a sip of the chalice at Mass on Sundays and that is about it. Maybe 1 drink every 3-6 months, MAYBE. Entire years have gone by with out one. I won't stop someone else, figure it is their choice.

Genes absolutely have a lot to do with it.  I get angry when people suggest that people can quit if they want to or had the will power.  Unless you witness or experience addiction and how it destroys lives and tears your gut out watching a loved one struggle ... think again.

You'll get no argument from me that it is difficult to stop. I would prefer that Trump use music from Stevie Ray or somebody that got sober, etc.

Trump would be endorsing sobriety, which he practices.

Same here,but I do confess to trying to convince teens whose parents I know are drunks to not drink. I tell them in plain blunt language with no sugar-coating,either.

Then I leave them alone. You can tell people anything,but you can't make them not do something they are determined to do.

The way I see it,you owe it to them as one human being to another to lay out their probably "life road" to them if they get loaded versus life as a sober person. How they live it is up to them,though.

I also tell them that after our little talk if they ever come to me looking for help,they are bleep out of luck. I can warn you,but it is not my job to be your babysitter.
