Powerline by Steven Hayward 1/24/2024
Texas Governor Greg Abbott is standing his ground in the aftermath of the Supreme Court’s dreadful ruling on Monday to allow the Biden Administration to tear down the fencing Texas put up along its southern border to effect what the Biden regime refuses to do: Control the border.

Governor Abbott Issues Statement On Texas’ Constitutional Right To Self-Defense
January 24, 2024 | Austin, Texas | Press Release
Governor Greg Abbott today issued a statement on Texas’ constitutional right to defend and protect itself as President Joe Biden continues to attack Texas and refuse to perform his duties to secure the border.
"The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now," reads the statement. "President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary."
-
Biden will stir up Texit even more than it already is.
I'm very proud of Abbott.
-
When? How much longer? Until Texas, Florida, Texarkana will be free!
Texas legislators would not allow a resolution on Texas secession.
Because they knew ... they knew it would pass.

Abbott doubles down on border ‘invasion’ declaration after Supreme Court blow
by Rafael Bernal - 01/24/24 4:08 PM ET
Texas Gov. Greg Abbott (R) on Wednesday accused the federal government of breaking the compact with the states following a Supreme Court ruling on Monday that cleared the way for the Border Patrol to remove razor wire installed by Texas along the U.S.-Mexico border.
In a statement, Abbott said, “President Biden has refused to enforce [immigration] laws and has even violated them.”
It’s the latest escalation in a legal and political standoff between Texas and the federal government, though Abbott stopped short of announcing any specific measures.
He has been pushing constitutional boundaries on state versus federal jurisdiction of border and immigration enforcement for the better part of two years; his legal team, including state Attorney General Ken Paxton, first publicly toyed with the idea of formally declaring a border “invasion” in April 2022.
In that November, Abbott wrote Biden invoking a state’s constitutional right to wage war when invaded, but he only made his official invasion declaration public in September.

Dem Lawmakers Urge Biden To Seize Control Of Texas National Guard
Two Democratic members of the House of Representatives urged President Joe Biden to federalize the Texas National Guard on Wednesday.
Republican Gov. Greg Abbott of Texas issued a defiant statement after the Supreme Court ruled the Biden administration could cut concertina wire placed by the state on the border in which he said the National Guard was among agencies erecting barriers. Democratic Reps. Joaquin Castro and Greg Casar of Texas demanded Biden seize control of the National Guard in response to the statement...................
“Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border,” Castro posted on X, formerly known as Twitter. “If Abbott is defying yesterday’s Supreme Court ruling, @POTUS needs to establish sole federal control of the Texas National Guard now.”
Federalizing the National Guard is an action that has been undertaken by a president before. Former President Dwight D. Eisenhower federalized the Arkansas National Guard after Democratic Gov. Orval E. Faubus of Arkansas used it to prevent black students from attending Central High School in Little Rock in 1957................

Greg Abbott Uses 'Supreme Law' of Texas to Give Soldiers Power Over Biden
Newsweek by Rachel Dobkin 1/24/2024
Texas Governor Greg Abbott has declared his state's "right to self-defense," using "the supreme law of the land" to give soldiers power over President Joe Biden on immigration at the U.S.-Mexico border.
Abbott issued a statement on Wednesday criticizing Biden for violating "his oath to faithfully execute immigration laws enacted by Congress."
In his statement, Abbott said the Biden administration's failure to "protect each [State] against invasion," as stated in Article IV, Section 4 of the Constitution, "has triggered Article I, § 10, Clause 3, "which reserves to this State the right of self-defense.
"For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas's constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary."
Abbott said that the "Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law, to secure the Texas border."
Amid Abbott's legal battles with the Justice Department, which claims that the governor's deterrence tactics impede federal law, there have been calls for Texas to declare independence from the United States, a movement being coined as Texit.

Amy Coney Barrett Says Ruling For Open Border Has Nothing To Do With Landscaping Work She Needs Done This Summer
Jan 23, 2024
(https://media.babylonbee.com/articles/65aff1a41b92f65aff1a41b930.jpg)
WASHINGTON, DC — Supreme Court Justice Amy Coney Barrett fielded questions from reporters regarding her controversial vote to remove razor wire from the Texas border and claims it has absolutely nothing to do with her plans to re-landscape her yard this summer.
"My plans to have a nice row of Elm trees planted along the southern fence of my backyard has nothing to do with my vote to allow more gardeners, er, I mean illegal immigrants, into the country," Justice Barrett explained.
The Supreme Court ruled in a 5-4 vote against Governor Greg Abbott's efforts to stop the flow of illegal immigrants entering the United States through Texas's southern border. Justice Barrett voted to allow border patrol agents to remove razor wire placed there by Texas officials, a move she said has nothing to do with her search for a landscaping crew that's affordable and will work for cash payments.
"My yard plans have nothing to do with my vote to allow the river of illegal migrants to continue to pour across the border," Justice Barrett said. "Now, if Governor Abbott happens to send a bus of hard-working cheap laborers up to the East Coast and I happen to pick up a few of those laborers in the parking lot of my local Home Depot and they happen to install a nice flagstone path between my deck and backyard veggie garden, so be it."
As of publishing time, Justice Barrett had downloaded the language-learning app Duolingo on her phone and was learning all the ways to say "I want Kentucky Blue Grass planted over there by the rock wall, please," . . .

BORDER SHOWDOWN: Texas’ Constitutional Right to Defend Against Invasion Supersedes Federal Law, Says Governor
RANDY CLARK and BOB PRICE24 Jan 2024138
Texas Governor Gregg Abbott asserts Texas’ constitutional right to defend and protect itself as it relates to the ongoing border crisis gripping the state. His analysis comes in a statement issued on Wednesday while state and federal authorities square off over granting federal agents access to Shelby Park in Eagle Pass, Texas. Governor Abbott ordered state authorities to seize the park in early January. The statement faults President Biden for refusing to enforce immigration laws in the state.
Abbott’s statement asserts in part:
President Biden has violated his oath to faithfully execute immigration laws enacted by Congress. Instead of prosecuting immigrants for the federal crime of illegal entry, President Biden has sent his lawyers into federal courts to sue Texas for taking action to secure the border.
President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The effect is to illegally allow their en masse parole into the United States.
By wasting taxpayer dollars to tear open Texas’s border security infrastructure, President Biden has enticed illegal immigrants away from the 28 legal entry points along this State’s southern border— bridges where nobody drowns—and into the dangerous waters of the Rio Grande.

President Biden Urged to Seize Texas National Guard - Joe Manchin Calls for National Emergency
By Ward Clark | 7:50 PM on January 24, 2024
On Wednesday, Representative Joaquin Castro (D-TX) called on President Biden to "seize" the Texas National Guard by calling them into Federal service, removing them from the command and control of the State of Texas. This is presumably in response to Texas Governor Greg Abbott's defiant tone towards the Biden Administration on closing the border.
A Texas congressman has urged President Biden to take the state's National Guard under federal control if Republican Governor Greg Abbott defies a Supreme Court ruling allowing federal agents to remove razor wire from a section of the U.S.-Mexico border.
The call was made by Democratic Representative Joaquin Castro after Abbott posted on X, formerly Twitter, saying the Texas National Guard would continue to "hold the line in Eagle's Pass," a popular migrant crossing point, stating: "Texas will not back down from our efforts to secure the border in Biden's absence."
Castro re-shared Abbott's post on his own X account, adding: "Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border.
This idea by Rep. Castro raises some interesting questions:
Were the President to activate the Texas National Guard under Title 10, what would their orders be? To assist federal officers in throwing open the gates?
What happens if members of the Texas National Guard refuse activation and instead continue to follow the orders of TX-ANG officers and Governor Abbott?
What if the Texas Guard splits, and former comrades end up facing each other across that red line?
If the Pentagon sends federal troops, how willing are they going to be to confront other Americans to allow the continued invasion of the country?
Is there any possibility that there may be open conflict between Texas and federal officials?

Gov. Abbott is being very smart. The Supreme Court didn't actually order Texas to DO anything. The Court gave the Biden Regime permission to do something. Those are two very different things! Texas is simply laying more wire and moving in more resources. Also the court deferred on the majority of the case that is still before the 5th Circuit. Abbott is exploiting this window to rally more governors, more personnel, and to secure the moral high ground.
Good for Abbott, good for Texas, good for America.
HOLD THE LINE TEXAS!

With Castro yes. Remember his mother was/is a Chicana political activist who helped establish the Chicano political party La Raza Unida. Currently she is on the city council in San Antonio.
What do you think she and Joaquin and Julian are working towards? Taking back TX (LaRaza believes it is the Mexican people's land) and politically turning it blue.
As time goes on, I'm afraid we will see some sort of civil war. Perhaps before the election.

Border Patrol agents 'absolutely' don't want to cut Texas razor wire, BUT ...

'We have an obligation to follow a legal order'
Border Patrol agents don’t want to cut Republican Texas Gov. Greg Abbott’s border wire after the Supreme Court ordered that the federal government can take it down, National Border Patrol Council President Brandon Judd told the Daily Caller News Foundation.
The Supreme Court ruled Monday that federal authorities can take down wire that Texas erected along the southern border, but the state is putting up more wire in Eagle Pass, Texas, at Shelby Park, which it took control of earlier this month. Border Patrol agents largely support Texas’ efforts, several rank-and-file agents recently told the DCNF .
“Agents absolutely do not want to cut the razor wire, but we have an obligation to follow a legal order,” Judd told the DCNF. “We will continue to put as much pressure on the admin to fix the crisis as we can. That will not change.”

GOP Governors Support Texas Gov. Abbott’s Efforts to Secure Border
Legal Insurrection by Mary Chastain Thursday, January 25, 2024
IMPORTANT: Abbott is *not* defying SCOTUS. The SCOTUS order means the feds can cut wire. It doesn’t say TX cannot install more wire or keep the feds away.
Republican governors and lawmakers have supported Texas Gov. Greg Abbott as the state adds more concertina wire after SCOTUS gave border patrol permission to cut the wire.
“James Madison, Alexander Hamilton, and other visionaries who wrote the Constitution foresaw that States should not be left to the mercy of a lawless president who does nothing to stop external threats like cartels smuggling millions of illegal immigrants across the border,” stated Abbott. “That is why the Framers included both Article IV, § 4, which promises that the federal government ‘shall protect each [State] against invasion’ and Article I, § 10, Clause 3, which acknowledges the ‘the States’ sovereign interest in protecting their borders.’ Arizona v. United States, 567 U.S. 387, 419 (2012)(Scalia, J., dissenting).”
Abbott isn’t even defying the SCOTUS order. SCOTUS vacated an injunction from the 5th Circuit that prevented border agents from cutting the wire except in the case of a medical emergency.
The order does not say Texas cannot add more wire. The order does not say that Texas has to give the border patrol access to the wire.
Utah Gov. Spencer J. Cox

The border is a disaster that continues to spiral out of control, both in terms of people and deadly fentanyl traffic. This is not a partisan issue. This is a national security issue. This is a common sense issue. This is an American issue.

Top general: Texas has constitutional right to defend itself!
WND 1/25/2024
Biden has allowed invasion of millions through open border policies
Days ago, the Supreme Court ruled that the feds could cut the razor wire installed by Texas on its border with Mexico to protect its citizens from an invasion.
But that ruling, according to Gen. Michael Flynn, a military expert and President Trump’s early national security adviser, will be “one of the court’s most cowardly decisions” and it actually could “doom our nation.”
If it stands.
Because Texas has a right to defend itself.
He writes in a commentary at the Western Journal the decision wasn’t just about razor wire.
”It was about the role of states in our federal system and the betrayal of the nation — first by a president, and now by two Republican-appointed justices.”
He noted it was Biden who demanded that the nation’s southern border be open for illegal aliens to enter, more or less at will.
”This statement was so absurd that we knew at once that this man who had somehow assumed the presidency was not on our side. Biden had just sworn the president’s constitutionally prescribed oath to ‘preserve, protect and defend the Constitution of the United States,’ and within hours he had flung open the nation’s borders to all comers,” he noted.
He noted media criticism of Trump’s plan to spend $11 billion on a wall. But he said Biden’s plan is estimated to cost taxpayers $451 billion.
”Biden opened the door, and over 3.8 million people walked through. That number of illegals is greater than the population of 22 states and is on the verge of destroying the nation in every way by causing crime, drug deaths, child trafficking, terrorism, deficit spending and more. He could not have done any more damage to the nation if he had tried.”
The general said the ruling “deserves as much respect as its Dred Scott decision that no African-American could be a citizen, or its Korematsu decision that approved locking up Japanese-Americans during World War II, or its Roe v. Wade decision that led to the death of well over 40 million babies.”
A commentary at the Liberty Daily called the fight the most important political war in ages.
”I cringe when I hear about this or that being the most important battle in generations… except for now since I’m the one saying it. The battle between Texas and the United States government, between Governor Greg Abbott and Joe Biden, really is the most important political battle in ages. It’s not just our sovereignty at stake with a border invasion in progress. That alone is huge. It’s also the constitutional debate over state’s rights. It’s also the incessant question about judicial supremacy,” the commentary said.

Huh. The Rockies (less CO of course), the Northern Plains, and the South. No surprise there except KS.
But it ain't civil war.
This is nullification, and the proper form of it.

There is, no doubt, a right of way, for wont of a better term, which necessarily falls within the jurisdiction of the federal government in every legal sense...
But there is also a setback from that right of way that absolutely belongs to the state, and there ain't a damn thing the feds can do about what the state erects there.

Border Crisis
Gov. Abbott Is Right: Texas Has The Right To Defend Itself And Secure Its Border
The Federalist By: John Daniel Davidson January 25, 2024
States have a fundamental right of self-defense that transcends the authority of the president and the Supreme Court.
The constitutional crisis that’s been building at the southern border reached a sharp point on Wednesday when Texas Gov. Greg Abbott asserted his state’s right to defend itself against invasion, arguing the Biden administration has “broken the compact between the United States and the States.”
It’s not an overstatement to say this is the worst constitutional crisis since the Civil War and that we’re in uncharted waters now. There have been times in our history when a state has defied the enforcement of federal laws, but we’ve never faced a situation where the federal government has refused to enforce its laws and even violated them. And because the border crisis involves the question of security, Abbott’s assertion of state authority cuts right to the heart of the question at hand, which is one of first principles: Does a polity have the right to defend itself, to preserve its existence in the face of invasion?
The answer is, of course, yes. The preservation of the polity must come before process arguments about whose job it is to enforce federal immigration laws. The state of Texas, in this case, has an authority that transcends that of President Biden and the Supreme Court. That’s precisely why the U.S. Constitution includes a clause explicitly recognizing a state’s right to act in self-defense when faced with invasion.
It shouldn’t have come to this, but Biden has not only refused to enforce federal immigration laws, his administration has been blatantly violating them for three years, triggering the worst illegal immigration crisis in U.S. history. Texas has borne the brunt of Biden’s dereliction of duty, and Abbott has at last decided to do something about it.
Specifically, Abbott has ordered the Texas National Guard and other Texas law enforcement agencies under his charge to take control of certain parts of the border, erect barriers, and apprehend those who attempt to enter the state illegally. This week, following the Supreme Court’s decision to side with the Biden administration and vacate an injunction that prohibited the feds from cutting razor wire Texas had placed across a stretch of border, Abbott went a step further. He declared that by failing to fulfill his constitutional duties to protect states from invasion, Biden has triggered Article I, Section 10, Clause 3 of the U.S. Constitution, which stipulates that states are not allowed to “enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded.”

I expect Biden to do just that - but then what about the right of TX to defend itself???
IF SCOTUS would have ruled in TX favor, they'd be looking at a different scenario.
Meanwhile we still have an invasion and how can SCOTUS justify allowing that to happen? They can't!!

GOP fighting Biden's newest scheme to leave southern border wide open
WND 1/25/2024
Lawmaker plans to ban feds from removing state's razor wire
As part of the Republican Party’s campaign to protect Americans through a secure border with Mexico, they are pushing for a ban that would prevent the feds from removing razor wire the state of Texas has installed to protect its citizens.
Areport from Fox News explains the plan is from rep. Mike Collins, R-Ga.
His legislation would ban federal authorities from removing razor wire or other barriers from the U.S.-Mexico border.
That follows a narrow ruling from the Supreme Court that said federal agents could, in fact, endanger Texans by taking down the security barrier.
Texas Gov. Greg Abbott has been in a pitched battle with Joe Biden and has dispatched the state National Guard to protect state citizens from the invasion that Biden has allowed to come across the border.
”President Biden is aiding and abetting illegal aliens who are swarming our border and raiding our country’s resources,” Collins explained. “Why else would he try to stop the state of Texas from turning them back to Mexico?”
The proposed Restricting Administration Zealots from Obliging Raiders, or "RAZOR," Act specifically prevents federal authorities like Customs and Border Protection from removing barriers erected by any state.
Biden has demanded that federal agents cut the barriers state officials have put in place to protect the state’s citizens.
Following the Supreme Court decision, Abbott also pointed out that Biden had failed to uphold the nation's compact with Texas “by allowing an invasion of millions of illegal immigrants under the Biden administration.
Abbott charged, “The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting states, including immigration laws on the books right now. President Biden has refused to enforce those laws and has even violated them.”

Tucker Carlson Calls on 'Men of Texas' To Defend Border
Newsweek 1/23/2024
Tucker Carlson appeared to question the "men of Texas" after America's highest court ruled that miles of barbed wire installed by Texas Governor Greg Abbott could be removed.
Justices ruled 5-4 in favor of the Biden administration, which argued that the area of Eagle Pass should be protected by measures the federal government agreed with, rather than Texas, in order to prevent Border Patrol agents from being granted access to key areas.
Texas said instruments such as razor wire and other measures are useful in keeping people from crossing the border.
A spokesman for Texas Governor Greg Abbott told Newsweek: "The absence of razor wire and other deterrence strategies encourages migrants to make unsafe and illegal crossings between ports of entry, while making the job of Texas National Guard soldiers and DPS troopers more dangerous and difficult."
Carlson said later on X: "So it's unanimous: everyone in power, from the White House, to the hedge fund managers, to the Supreme Court of the United States has decided to destroy the country by allowing it to be invaded.
"That leaves the population to defend itself. Where are the men of Texas? Why aren't they protecting their state and the nation?"
Newsweek has approached Carlson for comment via direct message on X.
Fears of vigilante groups manning the Texas border have been raised by non-government organizations (NGO) previously and include concern about Texas HB20.
The legislation would create a 'Border Protection Unit.' Republicans had moved the attached language regarding the provision to an amendment of House Bill 7 after House Bill 20 failed to pass in May last year, but the State Senate couldn't agree on the bill in its final shape.
Under the provisions, citizen members of the unit would have the power to "detain persons crossing the Texas-Mexico border unlawfully" and arrest them.
Human Rights Watch slammed the idea, saying, "People serving in the unit would be granted criminal and civil immunity against claims of wrongdoing."
The NGO added that the provisions would give "Texas police power to vigilantes."
The Anti-Defamation League (ADL) has said it is neighboring Arizona that has been a "hub" for vigilantes looking to police the border, but that "Texas has recently experienced considerable activity."
Appearances of vigilante groups or lone actors relying on their convictions remain a sensitive topic. Governor Greg Abbott was heavily criticized in 2019 when a gunman shot 23 people in El Paso.
A campaign leaflet for the governor appeared that year called on people to "defend" Texas and "take matters into our own hands." Abbott's campaign said it was just normal campaign language.

Border Patrol agents 'absolutely' don't want to cut Texas razor wire, BUT ...
WND By Jennie Taer Daily Caller News Foundation 1/24/2024

What about their obligation to following their sworn oath:
OATH OF OFFICE
I will support and defend the Constitution of the United States against all enemies, foreign and domestic;
that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental
reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which
I am about to enter. So help me God.
Are they perjurers? If they don't think they need to follow their sworn oath than why should they feel obligated to follow a 'legal order' that makes them facilitators of a foreign invasion?

Ok...what are the guesses on what's going to happen here?
1. Biden comes to his senses and backs down.
2. This becomes a pissing match and lasts for weeks/months.
3. There is some type of military confrontation.
My bet is #1. Not even Biden is stupid enough to cause a military confrontation.
Thoughts?
Or #4, Biden declares Texas 'under rebellion', and their representation in Congress is suspended as well as their electoral votes in the Presidential election. Trump picks up Georgia, Michigan, Wisconsin, and Arizona, but still loses to Biden 251-247.

Can he even do this?

House Speaker Mike Johnson Is the Latest to Support Texas on Border Crisis
RedState By Ward Clark 1/25/2024
On Wednesday, Speaker of the House Mike Johnson (R-LA) took to X/Twitter in support of Texas Governor Greg Abbott in the state's confrontation with the Biden Administration. Speaker Johnson has named "...holding Secretary Mayorkis accountable" as the House of Representative's next step.
The Speaker said on X/Twitter:
Speaker Mike Johnson
@SpeakerJohnson
I stand with Governor Abbott. The House will do everything in its power to back him up.
The next step: holding Secretary Mayorkas accountable.
https://twitter.com/SpeakerJohnson/status/1750375316478931298 (https://twitter.com/SpeakerJohnson/status/1750375316478931298)
It is unclear what the House is doing to help Texas in this, other than holding hearings against Homeland Security Chief Alejandro Mayorkis, who is largely seen as the architect of the current calamity on the southern border.
Removing Mayorkas from his post would have little impact on the feud between Texas and the federal government, even as the GOP argues he should be removed over his handling of the border.
It’s also unlikely to happen, given that it would require a two-thirds vote in the Democrat-led Senate.
But Johnson’s support comes as some Democrats have called on President Biden to take a tougher stance with Texas, which through Operation Lone Star has taken a number of measures challenging the federal government.
That includes placing buoys in the Rio Grande, prompting the federal government to take Texas to court.
And earlier this month, Texas officials took over a public park on the shores of the Rio Grande in Eagle Pass, using Texas National Guard troops to block the Border Patrol from accessing the park.
As the article notes, any action the House takes will almost certainly die in the Democrat-controlled Senate, especially as the removal of a "civil Officer" under Article 2, Section 4 and Article 1, Section 3, requires a two-thirds of the Senate to approve.

RFK Jr. praises Texas in battle with Biden over border
Independent presidential candidate Robert F. Kennedy Jr. on Thursday backed Texas in its ongoing battle with the federal government over border authority, criticizing the Biden administration for its handling of the U.S. southern border.
“Texas is right. Biden’s failure to secure the border leaves states no choice but to take matters into their own hands,” Kennedy wrote in a post on X, formerly known as Twitter. “As President, I will end this humanitarian crisis once and for all. I will secure the border and destroy the business model of the drug cartels. A country without borders is not a country at all.”

It Is Not Texas That’s Defying the Law — It’s Biden
National Review By Andrew C. McCarthy 1/25/2024
There is a great deal of moronic commentary accusing the State of Texas of defying the Supreme Court. In point of fact, the Supreme Court did not order Texas to do anything. It vacated an order by the Fifth Circuit that, during the pendency of an ongoing lawsuit between the feds and the state, barred federal authorities from cutting concertina wire that Texas has installed in parts of its 1,254-mile border with Mexico. That is, the Supreme Court (with no opinion, and over the objection of four justices, who also did not write) held that, for now, the lower courts may not prevent the federal authorities from dismantling barriers.
That Supreme Court action did not to direct Texas to do anything. The Court did not presume to tell Texas that it could not take action to protect its territory and exclude intruders — to have done so would have been constitutionally dubious for the reasons Justice Antonin Scalia explained nearly a dozen years ago in his Arizona v. United States opinion — which Governor Gregg Abbott has explicitly relied on, and which should be read, reread, and memorized. (Note: Abbott described the 2012 Scalia opinion as a “dissent”; it actually concurred in part and dissented in part with the Court’s multilayered decision.)
There is no doubt that the federal and state governments both have immigration- and border-enforcement authority. How they work out disputes, particularly under circumstances in which no attempt has been made by Congress in statutory law to prevent the lawful defensive measures Texas has taken, is a political question. This is vertical rather than horizontal separation of powers — collision between federal and state authority rather than presidential and congressional authority — but the dynamic is similar: The law’s preference is for the political officials who answer to the people whose lives are deeply affected to work it out.
Although I disagree with the high Court’s vacating of the Fifth Circuit injunction against DHS (our editorial leans that way, too), I think I understand why it was done (i.e., why Justice Amy Coney Barrett sided with the majority rather than with the other four conservative justices).
Border enforcement is a political duty, not a judicial one. It involves matters of security and diplomacy that are not within the judicial ken. The state government has border-enforcement authority, and the federal government has border-enforcement authority. The actor whose border-enforcement authority is questionable is the Court. I assume the Court was uncomfortable with federal judges’ telling the Biden administration how to carry out border enforcement; I assume the justices would be equally reluctant to endorse a court’s telling Texas how to do it.

BORDER SHOWDOWN: Texas’ Constitutional Right to Defend Against Invasion Supersedes Federal Law, Says Governor
318
Abbott Asserts Texas' Right to Repel Invasion (Randy Clark, Bob Price/Breitbart Texas)Randy Clark, Bob Price/Breitbart Texas
RANDY CLARK and BOB PRICE24 Jan 2024544

Texas' dispute with Biden over border crisis escalates
The Center Square By Bethany Blankley 1/25/2024
Congressional Democrat calls on Biden to federalize Texas Guard; Consitutional law expert says Congress should determine if that would be impeachable offense
(The Center Square) – As the conflict between the federal government and Texas escalates over the state's right to defend its border with Mexico, Gov. Greg Abbott is not backing down as a congressional Democrat called on President Joe Biden to federalize the Texas National Guard.
If the Texas National Guard were federalized solely to usurp Abbott’s constitutional authority to secure the Texas border, Congress should consider whether doing so constitutes a high crime and misdemeanor – an impeachable offense – under the U.S. Constitution, a constitutional law expert told The Center Square.
After Abbott invoked his constitutional authority to defend Texas’ border on Wednesday, saying, “The federal government has broken the compact between the United States and the States,” reports surfaced that Biden could federalize the Texas National Guard. This would result in pulling them from the Texas border and breaking the chain of command under Abbott.
Abbott called up several thousand guard members and positioned them at the Texas-Mexico border through his border security mission, Operation Lone Star. After the U.S. Supreme Court this week ruled Border Patrol agents could destroy Texas' concertina wire barriers, Abbott instructed guardsmen to build more.
U.S. Rep. Joaquin Castro, a Democrat from San Antonio, said that if Abbott “defies” the Supreme Court’s ruling, Biden “needs to establish sole federal control of the Texas National Guard now.”

Yes, the Texas State Guard. (https://en.wikipedia.org/wiki/Texas_State_Guard) And yes, they are a part of Operation Lone Star, which is the official name for the border protection operation.

Border Patrol has 'no plans' to remove razor wire set up by Texas amid feud with Biden admin
Border Patrol has "no plans" to remove razor wire placed by Texas along the southern border, a senior Customs and Border Protection (CBP) official told Fox News on Friday, stressing a "strong" relationship with Texas despite an ongoing legal battle between the state and the administration.
Texas is currently locked in a multi-pronged legal fight with the federal government over the security of the Texas-Mexico border. The federal government has threatened legal action over Texas’ recent seizure of Shelby Park near Eagle Pass, while lawsuits are ongoing over the administration’s cutting of razor wire set up by Texas and the establishment of buoys in the Rio Grande. Texas has declared that it has a right to "self-defense" against what it says is a migrant "invasion."
On Monday, the Supreme Court found in the administration's favor when it granted an emergency appeal to allow agents to keep cutting border wire set up by Texas after a lower court had blocked such moves. Texas has continued to fortify the border, and has also indicated it will not comply with the administration’s demands for it to vacate the Shelby Park area.
"[President Biden's] actions have caused an unprecedented invasion that we must defend against," Abbott said on Thursday.
The Biden administration has said that Texas is interfering with the federal enforcement of immigration law.
"Enforcement of immigration law is a federal responsibility," a DHS spokesperson said this week. "Rather than helping to reduce irregular migration, the State of Texas has only made it harder for frontline personnel to do their jobs and to apply consequences under the law. We can enforce our laws and administer them safely, humanely, and in an orderly way."
Dozens of Republican governors have backed Texas as the feud between the state and the feds escalates. But a senior CBP official told Fox that the relationship between Texas and Border Patrol officials on the ground is "strong."...........

White House chides 25 GOP governors backing Abbott in border dispute
By
Christian Datoc

The White House discounted a letter signed by Republican governors in support of Gov. Greg Abbott‘s (R-TX) directive at the southern border.
President Joe Biden is locked in a battle with Abbott and House Republican lawmakers over what the administration has claimed are “political stunts” surrounding the immigration debate.
On Thursday, 25 additional Republican governors backed Abbott, specifically his decision to deploy razor wire and mobilize the Texas National Guard to secure the border.
White House press secretary Karine Jean-Pierre flipped a question about Abbott’s backers into a familiar critique of House Republicans, whom for days the White House has accused of getting in the way of bipartisan negotiations on border security and additional Ukraine aid in the Senate.
“I would say to them that if they truly want to help with the issue, with the border, with the immigration system, that they need to talk to their — they need to talk to the congressional members, the senators in their states,” she said. “That’s what they need to do. They need to ask them to make sure that they have the resources they need in their respective states to take action, right to actually deal with a broken system.”

HUGE: Border Patrol Turns on Joe Biden, Proclaims Support for Texas National Guard
Bonchie
Is there going to be a major confrontation on the border following Joe Biden's ultimatum that Texas National Guard forces be removed from Shelby Park and other "disputed" areas? Not if the rank-and-file of the U.S. Customs and Border Patrol have anything to say about it.
According to a new post put out by the Border Patrol Union, and a new report from Griff Jenkins of Fox News, Biden has lost operational control of the situation, at least in a practical sense.
The Biden administration had initially warned Texas that it had until mid-day Friday to relinquish control of Shelby Park, the nearby boat dock, and the International Bridge. That deadline has now come and gone, and instead of there being a major clash between the Border Patrol and the state-controlled soldiers on site, it appears those on the ground have already de-escalated the situation.
The Border Patrol Union ends by slamming Biden for creating the current "catastrophe" and reiterating that there will be no conflict between CBP agents and state forces. The statement is a clear signal of support for the Texas National Guard, its mission, and those leading it, including Gov. Greg Abbott.
Rank-and-file BP agents appreciate and respect what TX has been doing to defend their state in the midst of this catastrophe that the Biden Admin has unleashed on America.
We want to be perfectly clear, there is no fight between rank-and-file BP agents and the TX NG, Gov. Abbott, or TX DPS. It may make flashy headlines, but it simply isn't true.
Furthering the division between the Border Patrol and the White House was a senior CBP official who said they have no plans to follow through on removing the razor wire put up by Texas. Biden has completely lost whatever leverage he had.
This is an incredible turn of events. I don't know if "mutiny" is the right word here, but clearly, Biden has no way to enforce his threats at this point. Border Patrol agents are not going to go along with it and short of using the Insurrection Act to mobilize the U.S. Army (and they likely wouldn't act either), this represents a major roadblock to the president's attempts to further destroy the Southern border.
We are in uncharted territory right now, and I'm certainly thankful cooler heads have prevailed, at least at this point. Will this force Biden's hand toward some kind of renewal of enforcement of immigration laws? Surely, with his bluff having been called by his own law enforcement officials, he has to try a different approach. Never underestimate the propensity of Washington politicians to keep making the wrong decisions, though.

Turley Explains Which Party Has ‘Upper Hand’ In Texas-Biden Showdown. It Comes Down To One Word

News and Commentary Writer

Fox News contributor and George Washington University law professor Jonathan Turley argued Friday that the federal government has the “upper hand” in the ongoing showdown between Texas and the Biden administration.
The Supreme Court, in a 5-4 decision Monday, agreed to vacate an injunction that temporarily blocked Border Patrol from cutting wire Texas had placed along the border.
The ruling does not require Texas to take any action to remove the wire fencing at the behest of the Supreme Court. Rather, the ruling states that federal border patrol agents have the right to remove the fencing if it impedes their ability to carry out the Biden Administration’s orders.
Turley first began by arguing that the open border crisis is a “violation of the understanding between the federal government and the states,” adding the federal government has not “fulfilled its pledge.”
“The problem is that federal courts are unlikely to agree that this is the ‘invasion’ referenced in the Constitution. There’s also a reference to ‘imminent danger’ and certainly looking at hundreds of thousands of people crossing, an effectively, open border presents an imminent danger, but the courts are likely to define that in the context of that provision in the context of an invasion by – as with a foreign state. So I think Texas is going to have a hard time making that constitutional argument in court,” Turley said.

Protest Convoy Headed to Southern Border Is Calling Itself an ‘Army of God’
Vice News by Tess Owen 1/26/2024
Experts say that the Christian nationalist rhetoric adds a dangerous dimension to the standoff between Texas and the Federal Government.
A trucker convoy of “patriots” is heading to the U.S. border with Mexico next week, as the standoff between Texas and the federal government intensifies.
The organizers of the “Take Our Border Back” convoy have called themselves “God’s army” and say they’re on a mission to stand up against the “globalists” who they claim are conspiring to keep U.S. borders open and destroy the country.
“This is a biblical, monumental moment that’s been put together by God,” one convoy organizer said on a recent planning call. “We are besieged on all sides by dark forces of evil,” said another. “Blessed are the peacemakers, for they shall be called the sons of God. It is time for the remnant to rise.” (The remnant, from the Book of Revelation, are the ones who remain faithful to Jesus Christ in times of crisis).
Experts say that the Christian nationalist overtones in this rhetoric adds a dangerous dimension to an already fraught situation.
“When people believe that they are working on behalf of God, they might be willing to resort to relatively extreme measures,” said Ruth Braunstein, assistant professor of sociology at the University of Connecticut and author of “Prophets and Patriots: Faith in Democracy Across the Political Divide.” ”And so you have a politically volatile situation that could become much more so, in part because of this rhetoric.”
The organizers current plan is for the convoy to depart Virginia Beach on Monday and snake down through the southeast, stopping over in Jacksonville, Florida before making its way to several stops along the border. The convoy will then split up for separate rallies on Feb. 3, one near Eagle Pass, Texas, a second in Yuma, Arizona, and a third in San Ysidro, California.
A group of six patriot-world influencers, including Kim Yeater, who runs a self-empowerment self-help group and an anti-voter fraud group, started organizing the convoy around a month ago. “God’s army is rising up,” she said on the planning call. “We all have been chosen for this time.”
The convoy was originally intended to send a message to the Biden Administration: “Secure Our Borders.” Its website calls on “all active & retired law enforcement and military, veterans, mama bears, elected officials, business owners, ranchers, truckers, bikers, media and LAW ABIDING, freedom-loving Americans,” to join the cause.
But recent events have significantly raised the stakes for the convoy. Two weeks ago the Texas National Guard seized control of Shelby Park in Eagle Pass, Texas—an epicenter of unauthorized border crossings—and erected razor wire around it, effectively limiting Border Patrol’s access to the area. It was an act of aggression in a simmering dispute between Texas and the federal government over who has jurisdictional authority over the border.

As Texas faces potential federal standoff, state AG says border looks like Biden 'cut a deal with cartels'
Fox News By Charles Creitz 1/26/2024
State militias or national guards had previously been federalized under Eisenhower and Washington
As Texas faces a potential standoff between state National Guard forces and federal Border Patrol on the border in Eagle Pass, the state's top lawman said the crisis gives the impression President Biden "cut a deal" with the cartels controlling parts of the boundary.
Texas Attorney General Ken Paxton told Fox News on Thursday he is not entirely sure what Biden's next move will be after the Supreme Court signaled the feds could take down razor wire in state-controlled Shelby Park, while not explicitly prohibiting Gov. Greg Abbott from reinstalling it.
"As far as a showdown, I don't know what Joe Biden is going to do. So far, it seems like every decision he's made has been a bad decision for our country," Paxton said.
"He is cooperating — not just cooperating, but he's literally in partnership with these cartels."
Paxton said that under previous presidents, illegal immigrants and cartel smugglers would hide from Border Patrol, fearing consequences including deportation.
But, under Biden, members of transnational criminal organizations actively seek out Border Patrol so that they are put into the veritable pipeline of foreign nationals dispersed into the country, he suggested.

Governor pledges to ship razor wire to Texas if Biden stops Abbott
Fox News By Charles Creitz 1/26/2024
Noem says governors are commanders-in-chief, too
A Republican governor of an interior state pledged to drive in razor wire on the border herself if Texas Gov. Greg Abbott is stopped by President Biden or federal forces from retaining operational control of a park in Eagle Pass.
Meanwhile, the U.S. congressman who represents the area warned Biden would be an "idiot" to commence a standoff or worse with Texas National Guard members now using the park, as parallels were drawn to the last instance of National Guard federalization 67 years ago.
South Dakota Gov. Kristi Noem told Fox News that Abbott is doing the right thing by standing firm after a Supreme Court ruling in which two conservative justices sided with the liberals to vacate a lower court's order preventing U.S. Border Patrol agents from accessing the park, which has reportedly been a high-traffic illegal migrant arcade. The court’s decision allows Border Patrol agents to cut concertina wire that Texas had installed along the border near Eagle Pass while litigation continues.
"I'll drive in more razor wire from South Dakota if I have to, for [Abbott] to do his job," Noem told "America Reports."
"What people forget is that governors are commanders-in-chief. We're responsible for the men and women of our National Guard. It's a heavy responsibility that weighs on our shoulders, and so we never engage our National Guard soldiers and those men and women unless it's incredibly important."
In defying the order, Abbott said earlier this week the federal executive branch has a constitutional duty to enforce laws protecting states, and that the Founders intended for states not to be victim to the whims of a "lawless president."
Florida Gov. Ron DeSantis and Oklahoma Gov. Kevin Stitt also indicated they stand with Abbott.
Noem said that, despite being hundreds of miles north of Mexico, she long ago declared the border a "war zone," and has sent her state's guard to deployments at the border multiple times to do the Biden administration's job.
She added that the agents under Biden's control similarly don't support their own boss' lax handling of the crisis.

Texas AG says state not backing down from Shelby Park takeover in Eagle Pass
Border Report by Sandra Sanchez 1/26/2024
McALLEN, Texas (Border Report) — As the Friday night deadline approached for a Homeland Security request for the State of Texas to open up Shelby Park in Eagle Pass to federal authorities, the state’s attorney general shot back a letter saying they aren’t backing down.
In a letter Friday, Texas Attorney General Ken Paxton disputed a claim by DHS officials in a previous letter that federal authorities have rights to Shelby Park lands that were established during the building border barrier in 2008.
“Your own map shows that most of the tracts you reference fall outside the perimeter area secured by Texas at Shelby Park,” Paxton wrote in the three-page letter to DHS General Counsel Jonathan Meyer.
“With respect to parcels identified in your maps that are actually in the vicinity of the park, publicly available records suggest the United States does not even purport to own what your latest letter claims … Based on our necessarily cursory review, current records from Maverick County do not support that claim,” Paxton wrote.
This is the second time Paxton has told federal officials that Texas will not relinquish the border park.
Meyer on Tuesday sent a letter to Paxton demanding access to the park. Border Report obtained a copy of the letter, in which Meyer requested that the state evacuate control of the park by Friday night.
In his Tuesday letter, Meyer claimed the City of Eagle Pass had given a “perpetual easement” to federal officials in 2018 of the park’s boat ramp and road leading to the ramp.
But Paxton wrote: “Texas never approved that transaction,” under the state’s Constitution. “Your federal federal agency cannot have something that was not the City’s to give.”
“This office will continue to defend Texas’s efforts to protect its southern border against every effort by the Biden Administration to undermine the State’s constitutional right of self defense,” Paxton wrote.

People's Convoy 2.0: Huge cavalcade of TRUCKERS will head to border hotspots in bid to shame Biden administration into cracking down on migration crisis
Daily Mail by Maryann Martinez, Texas Bureau Chief In Eagle Pass 1/26/2024
• Truckers are planning to make stops in Eagle Pass, Texas; Yuma, Arizona; San Ysidro, California-- all illegal immigrant crossing hot spots
• Biden Administration gave Texas until today, Jan. 26, to return
A massive convoy of truckers will make its way to three migrant hotspots across three states in a bid to shame the White House into tackling the worsening crisis.
Hundreds - possibly thousands - of big rigs will head for Eagle Pass in Texas, Yuma in Arizona and San Ysidro in California from January 29 for the four day 'Take Back Our Border' event.
They hope the eye-catching, all-American protest will draw further attention to record numbers of migrants crossing the southern border and into the US, with multiple cities now buckling under the weight of trying to care for them.
Congressman Keith Self, a Republican representative from Texas said: 'Once again, the truckers are standing for We the People.
'The time is NOW to take action and secure our borders!'
The development is the latest in an increasingly heated and chaotic political fight over whether Texas can ignore or supersede the federal government-- as Gov. Greg Abbott accuses the Biden Administration of not doing enough to stem the flow of illegal immigrants into the Lone Star State.
Despite the Supreme Court ruling on Monday in favor of the Biden Administration that Border Patrol agents can cut razor wire placed at the border (placed there by Texas) if they feel the need to, Texas is doubling down.
The state added more wire fencing, a is refusing to give up control of a Eagle Pass park it seized control of on Jan. 10.
Bizarrely, a golf course remains open in the park for locals to enjoy the genteel pastime - while federally-employed Border Patrol agents are barred.
The feds have given the state a deadline of Jan. 26 to allow Border Patrol agents, were have been banned from the park, access to Shelby Park.
It's unknown what, if anything, will happen if Texas refuses to comply with the federal government by Friday, but San Antonio Congressman Joaquin Castro ratcheted up the language-- suggesting Biden use force.
But Texas has plenty of support, with 25 governors from Republican states releasing letters backing up Abbott.
'I think the border has now reached a boiling point, that you now see governors getting involved,' Self told Fox Business News.
'We have a trucker convoy coming down to the border. The American people are going to have to get involved.'

I'm expecting a Fidel Trudeau style response from this lawless regime.
I am expecting incidents designed (yes, designed) to provoke violent outcomes.
That way the Red States resisting invasion can be declared in rebellion, some Martial Law proclamation made, and subjugation would be complete (well, except for the war).
Biden has been threatening to use those F-15s for a while now. like it's some sort of itch he has.

Key senators cut deal to give US new power to clamp down on border crossings
By Manu Raju, CNN 1/26/2024
Under the soon-to-be-released package, the Department of Homeland Security would be granted new emergency authority to shut down the border if daily average migrant encounters reach 4,000 over a one-week span. If migrant crossings increase above 5,000 on average per day on a given week, DHS would be required to close the border to migrants crossing illegally not entering at ports of entry. Certain migrants would be allowed to stay if they prove to be fleeing torture or persecution in their countries.
Moreover, if crossings exceed 8,500 in a single day, DHS would be required to close the border to migrants illegally crossing the border. Under the proposal, any migrant who tries to cross the border twice while it is closed would be banned from entering the US for one year.
The goal of the trio of negotiators – GOP Sen. James Lankford of Oklahoma, Independent Sen. Kyrsten Sinema of Arizona and Democratic Sen. Chris Murphy of Connecticut – is to prevent surges that overwhelm federal authorities. The Biden administration and Senate leaders have been heavily involved in the talks, and more details of the deal are expected to be released in the coming days.

Retired FBI execs to Congress: Invasion at border 'perilous' for America; U.S. has never suffered an invasion of the homeland but one is unfolding now
Highland County Press By Bethany Blankley 1/26/2024
The Center Square
Ten retired FBI directors and experts in counter intelligence sent a letter to congressional leaders warning that President Joe Biden’s border policies have facilitated a “soft invasion” into the U.S. of military-age men coming from terror-linked regions, China and Russia.
They argue a terrorist attack is likely imminent but preventable.
“The threat we call out today is new and unfamiliar. In its modern history the U.S. has never suffered an invasion of the homeland, and, yet, one is unfolding now. Military age men from across the globe, many from countries or regions not friendly to the United States, are landing in waves on our soil by the thousands – not by splashing ashore from a ship or parachuting from a plane bur rather by foot across a border that has been accurately advertised around the world as largely unprotected with ready access granted.”
“It would be difficult to overstate the danger represented by the presence inside our borders of what is comparatively a multi division army of young single adult males from hostile nations and regions whose background, intent, or allegiance is completely unknown.”
“It would be difficult to overstate the danger represented by the presence inside our borders of what is comparatively a multi division army of young single adult males from hostile nations and regions whose background, intent, or allegiance is completely unknown. They include individuals encountered by border officials and then possibly released into the country, along with the shockingly high estimate of 'gotaways,' meaning those who have entered and evaded apprehension.”
According to the US Department of Defense, an Army company is comprised of 100 soldiers, a battalion of 1,000, a brigade 5,000, a division 15,000, and a corps, 45,000.
There have been over 1.7 million gotaways reported to have illegally entered and evaded capture since Biden’s been in office, the majority of whom are military age men. They are included in the more than 10 million total illegal border crossers reported to have entered the country from Jan. 1, 2021, to Sept. 30, 2023.

I applaud Abbott for doing this. We are being slow bled by the globalists working thru the current admin to the point where if this keeps happening, at some point the country is going to destabilize.
Then it will be the same result because it will be their excuse to declare martial law and take over in a coup, except of course the States and citizens will be in a much weaker position to fight it. Might as well address it now and risk the fallout.
Main this is the strategy - instead of trying to do a brute force take on of the FedGov, baiting them to step out on the limb so it can be cut off. They've already done that some by splitting hairs on the SCOTUS decision and basically staying within the law. That's what they need to continue to do and let the Skeezy admin escalate.
Next step seems to be if the Skeezy will pull a petty partisan power play and nationalize the Guard to deny Abbot from using it, but with no real emergency, mission, or purpose other than essentially admitting that they want to continue the giant human trafficking operation of illegals across the border.
After that it gets dicey, but TX needs to keep the FedGov on the wrong side of the law and force them to back down or commit a coup, after which point nobody has do do a damn thing they say.
-
I applaud Abbott for doing this. We are being slow bled by the globalists working thru the current admin to the point where if this keeps happening, at some point the country is going to destabilize.

I feel that this country is already destabilized; the DOJ and SCOTUS are corrupt. I fear that they will nationalize the Guard in every state. However, there are states such as Florida that have a State Guard and the FEDS can't touch them.
So, the next step for them would be to declare martial law and start seizing guns...then you are going to see a battle. That is where I believe that the UN will step in to assist the take down of this country.
You bet ya, I fear the future and this scenario happening.

I agree with all of this, and concur, except in that any Nat'l Guard can be nationalized without the acquiescence of their Commander in Chief, which is invariably the governor - The governor says go, and take your command from the feds, and in that they are nationalized.
No, they are the states' armies and are under the governors to send forth or call home at their whim.
So if Bitem tries to nationalize, he will have egg on his face, Abbott gives him the finger, and the Nat Guard does too.
With twenty other states in tow, and ready to stand with Texas, and loaning her their own guardsmen, The sacred blood of the West and of the South stand with Texas. All of that, ready to flip Slow Joe the finger. And they MEAN it.
No, ol Bitem will not escalate. he does not want to go against twenty states.

Texas again rejected DHS demands for full access to the Shelby Park area in Eagle Pass
VOZ by SABRINA MARTIN 1/27/2024
Texas again rejected Biden's demands for full access to the Shelby Park area in Eagle Pass, which was taken over by Gov. Greg Abbott earlier this month.
The Department of Homeland Security (DHS) sent a letter to Republican Texas Attorney General Ken Paxton insisting it wants unrestricted access to the area. But once again, Texas responded that it would only allow entry to Border Patrol personnel who need to respond to emergencies.
According to Fox News, DHS alleged that the federal government acquired real estate interests and, therefore, would have the right to access them. "Because the Department owns property rights to the areas depicted on the attached map, we demand that you immediately remove any and all obstructions therein," the letter states.
But Paxton responded to DHS and denied its claims: "With respect to parcels identified in your maps that are actually in the vicinity of the park, publicly available records suggest the United States does not even purport to own what your latest letter claims," he replied. Likewise, Paxton asked DHS to provide maps and titles showing the areas he claims are owned by the U.S. government.

Border Patrol Union Backs Texas National Guard, Slams ‘Catastrophe’ Biden ‘Has Unleashed On America’
DailyWire.com By Zach Jewell Jan 27, 2024
The official union of U.S. Customs and Border Protection released a statement on Thursday backing the Texas National Guard’s attempts to secure the southern border and slamming the Biden administration for its “catastrophic” border policies.
The National Border Patrol Council (NBPC), which has over 18,000 members, said that the “rank-and-file” Border Patrol agents “appreciate and respect” the measures Texas has taken to repel the record flow of illegal immigrants into the U.S. under Biden.
“TX NG and rank-and-file BP agents work together and respect each other’s jobs. Period,” the NBPC said. “If TX NG members have LAWFUL orders, then they have to carry out those orders.”
Earlier this week, Texas Governor Greg Abbott doubled down on using razor wire to repel migrants from illegally crossing the border after the Supreme Court ruled that Border Patrol agents have the authority to cut through the wire to allow illegal immigrants into the country. On Friday, The Daily Wire found that Texas authorities have not only maintained existing razor wire fortifications but have added razor wire to border barriers, all while continuing to bar Border Patrol from establishing a presence at Shelby Park in Eagle Pass.

It is dang hard not to like and respect this guy and his style.
Paxton:
By February 15, DHS must supply the official plat maps & deeds demonstrating the precise parcels to which they claim ownership, an explanation of how Texas is preventing access to those specific parcels, documentation showing that Eagle Pass or Texas ever granted permission for DHS to erect infrastructure that interferes with border security, & proof of Congress empowering DHS to turn a Texas park into an unofficial & illegal port of entry. If the federal gov. is going to make such claims, it must provide proof.
Presumably because you have no meaningful response to our letter, your latest letter abandons earlier factual assertions, asserts new ones, & supplies even less of a legal basis for your demand. Once again, I respectfully suggest that any time you might spend suing Texas should be redirected toward enforcing the immigration laws Congress already has on the books. As I said before, this office will continue to defend Texas’s efforts to protect its southern border against every effort by the Biden Administration to undermine the State’s constitutional right of self-defense.
Nice. Very nice.

Does Joe Biden WANT a Civil War?
Texas Scorecard by Sid Miller January 30, 2024
A house divided against itself cannot stand.
Economic warfare is warfare. Casus belli is a Latin term which means “a reason to go to war.” Joe Biden has just initiated casus belli against the state of Texas. In his effort to impose his tyrannical will on our great Republic, he has fractured our nation in a way that could be seen as the beginning of the end of the American Experiment if calmer and wiser heads don’t prevail.
Last week, the president of the United States cancelled all LNG projects in Texas in retaliation for our refusal to submit to an illegal invasion by criminal cartels, Islamic terrorists, and the worst actors from around the world including Iran, Russia, and even North Korea.
Biden’s open borders are a disaster of historic proportions. His irrational, ideological doggedness in continuing these policies is tearing our country apart.
Over 170 known terrorists have been apprehended at the border. How many more are among the hundreds of thousands of “got aways” for which we have no accounting?
President Biden, a house divided against itself cannot stand. You must stand down before you destroy the world’s last, best hope with your misguided and dangerous declaration of war against Texas and your open border insanity!

The Second Alamo
The Post & Email by Thomas Reiner 1/31/2024
“Come and Take It” — Texas Flag During the Texas Revolution
The First Alamo was a thirteen-day siege of the Alamo during the Texas Revolution where 189 Texian and Tejano defenders were massacred by the Mexican Army led by President-General Antonio López de Santa Anna. Being ignorant that Texans are the True Bada**es of AmericaTM, the Mexican Army was soundly defeated by the Republic of Texas six weeks later in the Battle of San Jacinto and skedaddled south of the Rio Grande. While President, Santa Anna acted as a tyrant, bankrupted the Treasury, suspended the Mexican Constitution and led Mexico into unnecessary conflict. This President who attacked Texas was completely incompetent. Sound familiar?
A Second Alamo is in the making by the incompetent mess currently occupying the Presidency in Washington, DC. Presidentish Biden has thrown open the Southern Border of the United States to an Army of Terrorists, Fentanyl Mules, Sex Traffickers, Cartel Operatives, and millions of military-aged men, especially from Communist China. Federal Border Patrol have been reduced to the role of cruise ship directors. Texas is standing up to this criminal behavior and Just Says No. The States have the Constitutional Right to protect their citizens, especially when the Federal Government allows an army to cross America’s borders. Biden is ready to launch a Civil War against Texas by federalizing the Texas National Guard and sending in troops if necessary. Texas will likely suffer its Second Alamo, but the victory of the Tyrants thousands of miles away in Washington will be short-lived. Twenty-five states have already signed support for beleaguered Texas. The Border Patrol is reluctant to move against the Texas National Guard. Americans of many stripes will stand up to The True Threat to DemocracyTM and will throw the Leftists out in the onrushing November general election assuming no next Virus hysteria.
So what is the “Come and Take It” business all about? The Texians used this phrase with a cannon embroidered on the Texas flag during the Texas Revolution. That cannon was supplied by the Spanish in 1831 and the Mexican Army asked, then demanded, that the Texians return the cannon. “Come and Take It” was the response. Game on. Next stop, the Alamo. Many wars later, General McAuliffe was similarly defiant to a German capitulation order with the simple eloquent, “Nuts!”
Barbed Wire protecting the United States/Texas border is now the object of the attack by the Federal Government on the Free People of TexasTM. The Supreme Court twisted itself by incorrect Constitutional Law, ruling that Biden can remove the barbed wire to reopen the border to the flood of Illegals. Texas has a response: “Come and Take It.” Texas will just replace it with newer, bigger and more beautiful barbed wire. The Court did not rule against that.

WTH is wrong with the Governors of NC,New Mexico,Arizona, and Kentucky??
I kinda understand why the yankees and the left-coast are leaving this alone, but not the southern states.

That is 50 per cent of the states. So when do the biggest whiners, Ill. and NY, wake up and get a clue?
@berdie
When the "gift checks" from the US Treasury Dept stop arriving.

How is an order to aid and abet the commission of felonies (each illegal invader is one) a legal order? There is no obligation.
@Smokin Joe
I am not a lawyur and doan much, but if a state doesn't have the rights to control it's own borders, what rights DOES it have other than to be a slave state to a all-powerful dictatorship?
-
I don't think Abbott is going to flinch here. With the support of multiple governors this is a fight that needs to happen.
@Jack Russell
BTW,Biden isn't doing ANYTHING.
Who are the unknown, unnamed, and non-elected people that are working in the background to destroy America, and sending that dummy out in front of the cameras to try to defend when he doesn't understand?
Does ANYBODY REALLY think that Slow Joe is in charge of ANYTHING other than bathroom breaks for diaper changes?
What,"We,the people" need is to see the names and backgrounds of the globalist traitors working in the background and pulling that fools strings.
We can NOT continue to allow them to work anonymously in the background to destroy America. EVERYBODY should have the ability to know who they are,and what their stated goals are,as well as their personal histories.

Arizona is a clear proof of the concept, "Stolen Elections have consequences." We now have a far-left Rat Governor (after eight years of a RINO), as does NM.
-
Not a chance. That would stir up the entire country. Can he even do this?
@Jack Russell
He (or more correctly his handlers because he makes no decisions on anything) can do whatever the hell he WANTS to do because Congress is too full of career politicians who won't try to stop him because they want to remain on the "Congressional Gravy Train."
Will he get away with it?
WTH knows.
Somebody close to him needs to remind him of what happened at Ft.Sumpter,SC when the feral gooberment got "too big for it's britches.
There is NO promise that the outcome,IF this happens, will end like that one ended. I can guarantee you that there will be no shortage of volunteers in the south.
Who wants to claim the north will have no trouble recruiting volunteers to go south to fight?

How many states would follow? What election?
@Smokin Joe
If there is an actual war declared because "the south is in rebellion",our masters will cancel the election until after the war ends.

Eagle Pass migrant processing facility is evacuated after threats to BURN it down were made by people who joined 'Take Back Our Border' trucker convoy
Daily Mail By Maryann Martinez 2/2/2024
• Threats to burn down migrant center triggered evacuation of migrant holding center in Eagle Pass, Texas Thursday
• Migrants moved to other detention centers in Lone Star State
• Threats made as trucker convoy to protest Biden border policies expected to arrive in Eagle Pass Friday afternoon
A Border Patrol center for migrants in Eagle Pass, Texas was evacuated after threats to burn it down were made by people who joined the 'Take Back Our Border' trucker convoy to protest the Biden administration's border policies.
Up to 175 migrants were relocated to other holding centers in Texas on Thursday after law enforcement learned of the threats, sources confirmed to DailyMail.com.
The Border Patrol's version of SWAT units, BORTAC, and a separate mobile response team were activated to provide additional security, the sources added.
'As far as everyone knows, this is the first time something like this has happened,' said one Border Patrol agent, who spoke on condition of anonymity.
'Everyone keeps hearing they want to burn Firefly - that's what the threat was, so that's why they were moved,' the agent said.
US Customs and Border Protection, the parent agency of the Border Patrol confirmed the danger.
'Threats of violence against law enforcement personnel and migrants are unacceptable and CBP takes all threats very seriously,' a CBP spokesperson said.
'As such, we are taking appropriate and necessary actions to keep our employees and migrants in our custody safe. We will remain vigilant and continue to work closely with our law enforcement partners.'

NOPE!
The guy in the room hollering the loudest to do something violent and illegal is usually the Fed, or one of them. Has it really been that long since Ray Epps was hollering to "go inside"?
Leftists are the arsonists, so yeah, that reeks.
When I was in High School, a friend went to a pot party (back when a joint would get you a couple years). He got a strange vibe, went to the can, out the window, and hitchhiked home.
When the badges came out in the party, it turns out everyone left had one.
Maybe the only way to fight that False Flag is to pull off someplace north and have a few burgers...and then meet up somewhere else. That way if the usual suspects start some crap in Eagle Pass, all the people there will be UC/CI/Feds, etc.

Republican Governors Warn of ‘Imminent Danger’ in Biden’s Open Border Policies
Texas Scorecard by Sydnie Henry February 4, 2024
Texas Gov. Greg Abbott was joined by 13 other governors in Eagle Pass on Sunday.
EAGLE PASS—Texas Gov. Greg Abbott gathered with 13 other Republican governors to assert the states’ right to self-defense as President Joe Biden’s border crisis continues.
“Joe Biden does not need more legislative authority,” said Abbott, citing the laws already in place that Texas is attempting to follow. “He just needs a backbone to step up and do his job and secure the border.”
Shelby Park has long been a hotspot for illegal crossings, and since the state took it over and fortified it, crossings at the park have greatly lessened.
If Texas can do it, Abbott said the federal government most certainly can.
Abbott was joined by Arkansas Gov. Sarah Huckabee Sanders, Georgia Gov. Brian Kemp, Idaho Gov. Brad Little, Indiana Gov. Eric Holcomb, Iowa Gov. Kim Reynolds, Louisiana Gov. Jeff Landry, Mississippi Gov. Tate Reeves, Missouri Gov. Mike Parson, Montana Gov. Greg Gianforte, Nebraska Gov. Jim Pillen, New Hampshire Gov. Chris Sununu, Tennessee Gov. Bill Lee, and Utah Gov. Spencer Cox—all of whom have previously voiced support for Texas in its fight against the Biden administration.
“Our states’ are being invaded,” Gov. Gianforte echoed Abbott.
“Joe Biden has completely failed at one of his most basic duties as president,” said Gov. Sanders.
“We don’t have time to wait till November,” added Abbott. “We’ve got lives on the line every single day.”
“Our declaration is a declaration of our rights under the United States Constitution,” said Abbott. “Article I, Section 10, Clause 3 guarantees the right of every state, as either invaded or in imminent danger—which we are in imminent danger—to be able to exercise self-defense. Texas will continue to exercise that self-defense and expand the area where we are using self-defense to make sure we are able to better protect our communities.”
Abbott said the number of people who have crossed illegally since Biden took office is equivalent to three times the 2.3 million population of Houston. December’s official numbers alone soared over 300,000—the highest month ever recorded.

Actually I could’ve quipped that Trump always makes his own show and event, so yes he has no time for anything outside his own ready-made “event”.

Yup!
Why would I criticize anyone for doing something right?

The thing that stands out to me is that DeSantis is supporting Abbott even though Abbott endorsed Trump, because on this issue it was the right thing to do. If the shoe were on the other foot, and Abbott had endorsed DeSantis, thin-skinned Trump would have been trashing both of them.

You are delusional.
This is nothing more than an attempt by "Sore Losers,Inc" to try to rally support for their little "lust bunny"
in order to try to make sure Trump doesn't win the election so you can do your little "We TOLD you so!" "Superiority Dances" if he doesn't win.
And let's face it,due to DNC cheating and sore groupies like you,it's gonna be tough for Trump,or anyone else not supported by "World Wide Government,Inc" to win.
So,I hope that you and the other "But..,...,but.....,he is RICH AND RUDE!" airheads enjoy yourselves at your "superiority dance classes",because if Trump is defeated you will suffer as much as everyone else, and if he wins, you still suffer BECAUSE he won.

Texas Stripped of Powers in Border Security Bill
Newsweek by Sean O'Driscoll 2/6/2024
Conservatives have attacked a provision of the new border security bill that would only allow legal challenges to be made in Washington D.C.
The bill would strip the power of Texas and other states to challenge some of the its provisions in their local federal court.
Conservative commentators were quick to denounce the provision, contained on page 221 of the bill. Bill Shipley, who was a federal prosecutor for over 20 years, decried the its court provisions on X, formerly Twitter, on Sunday.
"This would prevent plaintiffs - like the State of Texas - from filing suit in Texas federal courts. This is corrupt," he wrote.
After outlining the provisions under which immigrants can seek judicial review of a deportation order, the bill states:
"The United States District Court for the District of Columbia shall have sole and original jurisdiction to hear challenges, whether constitutional or otherwise, to the validity of this section or any written policy directive, written policy guideline, written procedure, or the implementation thereof."

Border crisis: Gov. Abbott to expand Operation Lone Star along border
Fox7 by Rudy Koski 2/7/2024
EAGLE PASS, Texas - The expansion of border enforcement is expected to target specific locations along the Rio Grande between official Ports of Entry. The promise of a ramp up by Gov. Greg Abbott came on Thursday afternoon at Shelby Park in Eagle Pass.
The site was seized by state officials last year after a series of migrant surges into Texas. The expansion plan comes after 14 governors, earlier this week, told Abbott they would send extra manpower to Texas.
"So, the next step is, working with the National Guard on plans as we speak right now, to expand the National Guard effort along the border region," Gov. Abbott said. "We're going to work on strategies to ensure the capabilities of the National Guard to add more soldiers, more resources, more capabilities, so they can be even more successful."
An enforcement ramp up is supported by State Rep. Ellen Troxclair.
"I think we have no choice," said the Lakeway Republican.
Any increase in enforcement is expected to be condemned by immigration advocates. Troxclair, who is a member of the Texas House Homeland Security Committee, believes the current border policy by the Biden Administration justifies a ramp up.
"We have the constitutional right as a state to secure our state," said Troxclair.
Nearly two dozen state lawmakers, including Rep. Troxclair, were invited to the governor's Thursday event in South Texas. She is not surprised a new enforcement plan will build on what’s been done at Shelby Park.
"The numbers are going down. It is working," Troxclair said. "So, I just think that we have to keep our foot on the gas, keep going, and keep putting up those roadblocks as much as possible for the cartels."

Five More States to Send National Guard to Texas Border
Texas Scorecard by Luca Cacciatore February 12, 2024
The number of Republican states aiding Texas’ border security effort continues to swell.
Five more states led by Republican governors are preparing to deploy national guardsmen and other personnel to the Texas-Mexico border.
Texas Scorecard previously reported that Florida, Idaho, Ohio, Oklahoma, and North Dakota either had personnel in Texas at the border or were working to send some.
Now, after Texas Gov. Greg Abbott’s February 4 press conference that included 13 Republican governors in Eagle Pass, top officials in Iowa, Indiana, Louisiana, Utah, and Tennessee are also pledging to send troops to Texas.
Tennessee Gov. Bill Lee was the first to move, pledging during the border trip that his state was working on a timeline for additional aid to Texas’ multi-agency border security effort, known as Operation Lone Star.
WVLT-TV 8 reported that the newly pledged troops would constitute deployments of a second and third wave of Tennessee guardsmen. The first wave is expected to deploy to the border within 60 days.
“Tennessee will continue. We are the Volunteer State. We have had hundreds of troops on the border. We are prepared even today to send additional troops. We are working with the Texas Department of Military to do just that,” Lee said.
Speaking at a news conference in the Iowa State Capitol one day after returning, Iowa Gov. Kim Reynolds said she informed Abbott that her state “stands ready” to send Iowa National Guard soldiers and Iowa State Patrol officers to Texas.

Texas Land Commissioner Buckingham to discuss state takeover of Fronton Island
FRONTON ISLAND, Texas (Nexstar) — Texas Land Commissioner Dawn Buckingham will head to McAllen on Monday to discuss the acquisition of Fronton Island, a stretch of land in the Rio Grande River where the state recently seized operational control.
Fronton Island is a 170-acre area in Starr County. According to the Texas Military Department, the island in the Rio Grande was “lawless” and was associated with high cartel activity and smuggling operations involving “narcotics, weapons, money and high-value individuals.”
The General Land Office worked with the TMD throughout the fall to assume control of Fronton Island after Buckingham granted permission for the Texas Department of Public Safety and Texas Rangers to police the area in September.

The 170-acre island situated in the Rio Grande River between Starr County and Mexico is a hot spot for cartel trafficking.
Three suspected cartel members armed with rifles were documented crossing Fronton Island in August.
Two of the three men were later arrested by DPS.
In September, Texas Land Commissioner Dawn Buckingham authorized DPS policing and patrolling on the state-owned island.
Buckingham told Fox News, “Law enforcement has found some ammunition, suspicious devices on it. And we just feel like with the border crisis, it was really important to ensure that Texas law enforcement have access to these islands, so we can help secure our border.”
“While the federal government refuses to safeguard Texas communities, the General Land Office will step up and assist our state in its robust border security efforts,” said Buckingham.

Too bad Kemp couldn't step in back in 2020 when Democrats spent four days creating enough votes to win two US Senate seats and the White House. Maybe if you had enforced election laws in Georgia, we wouldn't be complaining about Biden not enforcing immigration laws in Texas.

And I am POSITIVE the states with Dim governors will soon do the same.
After all, they are the states with busted budgets and out of control crime rates, and the governors there DID swear oaths to protect their states and people, right?
If they don't,anybody running against those governors has an automatic advantage when it comes to campaigning.
LOTS of voters that live in those leftists "people paradises" HAVE to be getting pretty fed-up by now with all the inflation and crime they are dealing with due to their governors obeying their globalist masters.
Just because many/most of them won't say this in public for fear of being attacked verbally AND physically, that doesn't mean they won't vote to end it.
AND.....,no doubt, deny they did this because they don't have any guts. If they had guts, this would have never happened to start with.

Texas and Biden administration lawyers face off in court over new law making illegal border crossing a state crime
The Texas Tribune by Uriel J. García and Pooja Salhotra Feb. 15, 2024
An Austin judge will decide whether Senate Bill 4 will go into effect on March 5. The new law allows police to arrest people suspected of illegally crossing the border.
Lawyers for the Biden administration and Texas faced off in a federal court in Austin on Thursday to argue whether a new state law that would allow police to arrest people suspected of crossing the Texas-Mexico border illegally should go into effect next month.
Senate Bill 4, which Gov. Greg Abbott signed in December, is Texas’ latest attempt to try to deter people from crossing the Rio Grande after several years of historic numbers of migrants arriving at the Texas-Mexico border.
The law makes illegally crossing the border a Class B misdemeanor carrying a punishment of up to six months in jail. Repeat offenders could face a second-degree felony with a punishment of two to 20 years in prison. The law also requires state judges to order migrants returned to Mexico if they are convicted; local law enforcement would be responsible for transporting migrants to the border. A judge could drop the charges if a migrant agrees to return to Mexico voluntarily.
On Thursday, attorneys representing the U.S. Department of Justice and several nonprofit organizations that have sued the state argued that only the federal government can enforce immigration laws. They said that precedent set by federal courts makes clear that states are prohibited from enacting their own restrictions on entry to and removal from the U.S.

Texas Nat’l Guard seizes border section, builds razor-wire wall: Report
A new video shows the Texas National Guard building a razor-wire wall on the El Paso border as the state continues to defy President Joe Biden’s administration.
The “End Wokeness” social media account shared a video on Tuesday of the Texas National Guard installing a razor-wire wall on the southern border between the United States and Mexico. End Wokeness claimed that the Texas National Guard had “just seized” control of the border in El Paso.
“The Texas National Guard is continuing to defy the federal government,” End Wokeness tweeted. “They just seized the border in El Paso. A razor-wire wall is now going up.”
Tuesday’s video comes after the Texas Military Department released a video last week showing that Texas was continuing to reinforce barriers at the border. The Texas Military Department claimed that the reinforcement of the barriers was helping protect both Texas and the rest of the United States.
Alongside a picture of Texas National Guardsmen, the Texas Military Department shared a statement Sunday, saying, “The Texas National Guard continues to surge additional personnel and equipment to protect El Paso. More than 700 additional Soldiers, including 200 Soldiers of the Texas Tactical Border Force (TTBF), have deployed to El Paso throughout the past week.”
“Governor Greg Abbott, the Texas Department of Public Safety (DPS), and the Texas National Guard continue to work together to secure the border; stop the smuggling of drugs, weapons, and people into Texas; and prevent, detect, and interdict transnational criminal activity between ports of entry,” the governor’s press release stated.
The Republican governor’s press release explained that Operation Lone Star fills the “dangerous gaps” at the southern border that have been “created” by the president’s “refusal to secure the border.”
