Judge strikes down Kansas law requiring proof of citizenship to vote

WICHITA, Kan. — A federal judge has ruled Kansas cannot require proof of U.S. citizenship to register to vote, a setback for Kansas Secretary of State Kris Kobach in a case with national implications for voting rights.

U.S. District Judge Julie Robinson sided with voters Monday that Kansas cannot require people who register to vote to provide documents such as a birth certificate, U.S. passport or naturalization papers. The decision in a couple of consolidated cases makes permanent earlier temporary rulings.

The judge said the Kansas requirement violates the right to vote under the Fourteenth Amendment.

Kobach, a conservative Republican running for governor, had to prove at trial that Kansas had a problem with noncitizens voting.

An appeal is likely, but an appeals court had previously backed Robinson’s preliminary injunction.

Maybe we can pass out voter registration cards to the kids waiting to be reunited with their "parents"....just to save them some time.

I went to the 14th Amendment.  It is talking about citizens.  Born and naturalized.  I know I am no expert but the Constitution mentions voting several times for citizens.

That is irrelevant these days.  Liberals use and abuse the 14th Amendment to mean whatever they want it to mean...to include everything from gay "marriage" to universal healthcare.  It's the favorite Liberal catchall for their agenda.

If voting were covered under the 14th Amendment, we wouldn't have needed the 15th or 19th.

Robinson's logic is not just faulty; it is not even logical at all. It is solely contrived to create a rationale to overstep the bounds of the courts.

If Robinson wants to do so, let Robinson enforce it. Kobach should not comply.

What everyone forgets...including this judge apparently...is that the 14th Amendment along with the 13th and 15th were written and passed to protect recently emancipated slaves form the Jim Crow laws of the South after the Civil War.

Thanks to Liberal Judges and the hard left in Congress...they've morphed into something they never should have been used for.

Yes. What we'll do is bus in Canadians and Mexicans wishing to vote Republican. They will be sent to swing areas to assure Republican victory. If that works well then we can start flying them in from Mongolia.

And hey.... why stop there?  Why bother with silly rules like one person, one vote?  The Democrats already exercise their option to vote multiple times in the same election.  So everyone should vote as many times as they please.  I mean... who needs rules and laws anyway? 

Next... implied intent voting can be enacted.  And your family, which includes your pets, should also get a say.  For instance, I happen to know that my cat and my dog are both Republicans and would vote straight ticket.  So I should be able to vote for them.  Right?

Sided with voters?  No, the judge sided with the ACLU, which rejected what real voters wanted:  an honest election.


I'd sure like to see one of these extra-constitutional judges get removed from his perch.

I don't see how a judge can strike down a law.  Aren't they supposed to simply judge on the constitutionality of a law?

The issue is that Congress is full of worthless weasels who only care about getting themselves rich. They are afraid of everything. They duck and hide and run away from anything which is worth fighting for.

In the absence of an American Congress, Judges are now filling the gap. Judges no longer interpret Law, today they make their own 'law' on the fly. However they feel on a particular day, is the 'law'.

I believe that this could turn into a very strong positive for the GOP ....IF.... the GOP would propose a constitutional amendment that:

1) Limits the right to vote in federal elections to US Citizens
2) Requires states to maintain a separate federal voting roll
3) Requires that the federal voting roll be entirely purged 30 days after a presidential election
4) Requires citizens to provide proof of identity, citizenship and residence in order to register to vote
5) Empowers Congress to establish laws to enforce the above.

Of course, this should be appealed upward, into the Supreme Court, as rapidly as possible.

If it’s unconstituitonal, it cannot be enforced, hence it is, in colloquial terms, struck down.
