President-elect Donald Trump‘s Nov. 26 sentencing in his New York criminal hush money case was adjourned by the court as a judge mulls over how to handle the prosecution after Trump won reelection earlier this month.

The sentencing, which was scheduled for next week, was called off without explanation on Tuesday in a brief note by the court. The update came on the same day Manhattan District Attorney Alvin Bragg faces a deadline to offer the court his recommendation for how the case should proceed.

Justice Juan Merchan, who presided over Trump’s trial earlier this year, was initially poised to rule last week on whether the Supreme Court’s July 1 presidential immunity decision precluded the sentencing from going forward. He delayed his decision by one week to give prosecutors and the defense team more time to explain how they think the next steps should be.

The Supreme Court found in Trump v. United States that former presidents are entitled to some forms of immunity from criminal indictments if the alleged conduct falls into the scope of their official duties. Trump, now the president-elect, was found guilty on 34 felony counts for falsifying business records in May, surrounding a $130,000 paid to porn star Stormy Daniels just before the 2016 election.

Trump’s lawyers argued prosecutors introduced inadmissible evidence from when he was a sitting president, and argued their inclusion of that evidence, following the immunity ruling, was grounds to dismiss the case or request a new trial.

The case marked the first criminal trial against a former U.S. president. Trump denies wrongdoing, including the affair Daniels said she had with him, and has described the trial as politically motivated.

Bragg’s team has still not issued a public filing about the recommendations for the case. Prosecutors have several options, including request to postpone sentencing until 2029, or vacating the conviction altogether.

A judge presiding over President-elect Donald Trump‘s Nov. 26 sentencing in his New York criminal hush money case is still awaiting recommendations by District Attorney Alvin Bragg as he mulls over how to handle the prosecution after Trump won reelection earlier this month.

The sentencing, scheduled for next week, was still on the table as of Tuesday afternoon, according to two sources who spoke to the Washington Examiner. Confusion swirled over the status of Trump’s case Tuesday morning after Bloomberg was one of the first of many outlets to purport that the sentencing had been adjourned, citing a “short note by the court.”

When asked whether the court had officially adjourned the sentencing, a source directly familiar with the matter said “no.” A spokesperson for the district attorney’s office suggested the Bloomberg report was incorrect.

New York prosecutors are requesting a stay until at least 2029 in New York v. Trump, as the president's defense attorneys prepare to move to dismiss the case entirely. 

Prosecutors wrote a letter to Judge Juan Merchan on Tuesday, who agreed last week to grant a stay on all deadlines associated with the conviction proceedings against Trump in the final months before he takes office.

Merchan granted the request, which issues a stay on all deadlines, including the Nov. 26 sentencing date, to consider the effect of his election as president.

Prosecutors had asked for the pause in proceedings, which they said would allow them to better evaluate the impact of Trump’s new status as president-elect.

"As a result of the election held on November 5, 2024, Defendant’s inauguration as President will occur on January 20, 2025," Manhattan District Attorney Alvin Bragg wrote to Merchan on Tuesday.

The decision marks a significant shift in the high-profile legal battle that has entangled Trump for the past couple of years. Prosecutors, who had previously pursued Trump with fervor, now appear to be stepping back—at least temporarily—amid the reality of his electoral victory and the constitutional complexities surrounding prosecuting a sitting president.

In a letter to Judge Juan Merchan, lawyers for the district attorney’s office clarified their stance: while they oppose Trump’s effort to dismiss his criminal conviction outright, they do not object to delaying sentencing and other proceedings until his second term concludes.
