OK, let's review.

1.  He's in the country illegally.  That's a misdemeanor punishable by six months in prison.
2.  He's charged with a felony for a crime he committed while in this country illegally.

SO WHY IN THE HELL IS HE FREE? 

WHY ISN'T HE BEING HELD WITHOUT BOND UNTIL HIS FELONY TRIAL IS OVER?

Good grief, can't we at least practice a little common sense here?  This is 100% the fault of those charged with enforcing the law, both at the State and Federal levels.

He's been "sentenced." To probation.

The way I read this, he already had a felony charge against him when he made the threat.  Am I wrong about that?

That could be, Hoodat. There's been scant reporting on this incident, and it's hard to get all the background info.
