Yes, and sometimes merely being an idiot is not a good reason to prosecute, even if the evidence of a violation is clear, precisely because of superseding political considerations.
Back during the Obama regime, the 'Rats thought they'd be real cute and allow lower-court judicial appointments to be confirmed on a simple majority vote, instead of the 2/3 vote that had historically been required - McConnell used that to their lasting lament by proceeding to apply the same rationale to Supreme Court nominations and getting three conservative (more or less) justices seated, despite heated 'Rat opposition and a very slim majority.
I hope that the 'Rats will also end up regretting this decision. Personally, I hope that the first thing that happens after Biden leaves office is that he is indicted for bribery.
