Conservative Brief by Martin Walsh April 5, 2023

House Speaker Kevin McCarthy declared that Congress will take action after former President Donald Trump appeared in Manhattan on Tuesday for his arraignment in the case brought against him by Manhattan District Attorney Alvin Bragg.

Trump pleaded not guilty to 34 charges regarding allegations that he falsified business records related to adult film star Stormy Daniels’ hush-money case. Trump was indicted by a Manhattan grand jury in a case involving his purported role in hush money payments to Daniels ahead of the 2016 election, allegedly to keep Daniels quiet about an affair the two of them had in 2006.

McCarthy voiced his frustration and vowed to hold Manhattan District Attorney Alvin Bragg accountable.

“Alvin Bragg is attempting to interfere in our democratic process by invoking federal law to bring politicized charges against President Trump, admittedly using federal funds, while at the same time arguing that the peoples’ representatives in Congress lack jurisdiction to investigate this farce. Not so. Bragg’s weaponization of the federal justice process will be held accountable by Congress,” McCarthy tweeted.

The Manhattan judge presiding over the case against Trump warned the former president on Tuesday to not make statements that could possibly lead to violence. However, the judge did not issue a gag order, which would have limited Trump’s ability to speak about the case.

Judge Juan Merchan said that Trump and other witnesses that prosecutors intend to call should “refrain from making statements likely to incite violence or create civil unrest.”

So, GOP, has abandoned States' Rights in favor of Federal Absolutism?  Sounds bakwards.  That would make Republicans no different than their Lib Dem counterparts.

By that illogic, a Dem majority would subpoena a Texas state prosecutors to explain their conduct of abortion law enforcement.

A Dem majority could subpoena Governor DeSantis for his Martha's Vineyard immigrant flight.

A Dem majority could subpoena any state, county, or local Republican officials enforcing "voter integrity" laws.

A Dem majority could subpoena a Tennessee prosecutor amidst an active state judicial proceeding against a defendent charged with violating the state ban against trannies in public places.

These Trumpswabs are attempting to set a precdent of the Federal legislature interfering with a state judicial proceeding.

What next?  A Federal abortion ban ... which will set a precedent for Dem Majority to later pass Federal laws affirming Federal abortion rights and protections ... that will have supremacy over state abortion restrictions.

These GOP Congressional dinks are working against the States' Rights principle used to overtturn Rowe v Wade.

Is GOP for States' Rights or against them?

Exactly. I have heard "Congress will hold XYZ accountable" all my life. And it NEVER/NEVER/NEVER happens.

Why is Hillary still free? Why is Mayorkas laughing at Congress? Why is Fauci still preening like a peacock God?
Why is Pelosi still insider trading? And dozens more like this ...

Congress can never hold anyone 'accountable' for anything, because they are all equally guilty. There is a mutually assured destruction pact among all of them.

So, are you saying that Congress has no place in investigating whether a state prosecutor is using his power to deny a U.S. citizen due process of law for partisan political vindictiveness?

Does not the guarantee of due process of law in both the 5th and 14th Amendments provide a federal question which Congress can investigate?

Bragg has already invited Federal oversight by (sort of) charging Trump with a Federal felony.

The reason the indictment was blank, except for a bookkeeping error which Bragg repeated the same charge 34 times, is that even an idiot like Bragg knew that he had no authority to charge Trump with election interference or campaign fund fraud. So, Bragg concluded the hell with it. Just charge Trump with something/anything and we will figure out what we are going to do later. He admitted as much.

When Bragg was asked why he did not specify charges in the indictment, he answered - "Because I don't have to".

They literally could have charged Trump with 34 unpaid speeding tickets. And they would have, if it came down to it. The ONLY thing they wanted was the perp-walk. After that, nothing else matters.

To Bragg, the perp-walk was the goal. To get it, Bragg was more than willing to spend 200 million and to shut down NYC for an entire day. Bragg would have spent 5 times that much to "GET TRUMP!"

New York State is giving Donald Trump his due process.  He's getting a trial.

Trump was charged with New York State felonies, not Federal felonies.

The Federal Government has no Constiutional authority to interfere with a state prosecutor bring state charges before a state court of law.

What about the 10th Amendment?

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Does Congress have a Constitutional authority to interfere with a state prosecution of a private citizen before a state court for violation of state laws pertaining to accuracy of business documentation for corporations and LLC created by, and registered with, New York state?

If Sedition Caucus has their panties in a bunch over Bragg's prosecution of a fraudulent business documents case, they will have atomic wedgies when the Fulton County, GA, prosecutor files state charges against Trump and others for allegedly violating Georgia state election laws.

Maybe so, but it is certainly a matter Congress can take an interest in if it appears that a state may be attempting to deprive an individual of his constitutionally protected right to due process.

Or perhaps Congress shouldn't have stuck its nose into all those black lynchings back in the day.  After all, that was a process of a sorts, and all that the various states considered was due to blacks.

Yes, his opportunity to prove his innocence.  Well stated, Comrade.

Due process has barely started; and is not yet denied.

Congressional Republicans - rather than dealing with consequential issues, such as the Debt Ceiling, the Budget, Immigration, Repatriation of American Supply Chains, and Domestic Energy Productiion - are expending Federal resources to pre-emptively investigate and oversee a nascent state prosecution and trial that is only a week old.

It is blatantly transparent that members of the Sedition Caucus are using Federal Congressional resources to run interference for the Trump legal defense team in a state legal matter.

 ////00000////

Rather than pussyfooting around the issue, Sedition Caucus Republicans come out in the open and coronate Donald J. Trump as King of America.

Allegiance and loyalty to Tangerine Mussolini is a one-way, dead-end street.  Just ask the January 6th "tourists" who were summoned to DC by Trump ... to interfere with the Congressional Proceeding to tabulate the Electoral Vote counts, ... and are now languishing in prison for their actions at Trump's behest.

Is Trump spending any of his money to contribute to the defense of his January 6th minions?

What makes members of the Sedition Caucus think Trump will aid their defense should they be charged for their participation in the January 6th conspiracy to interfere with a Congressional proceeding; to submit fradulent slates of electors to the National Archivees and Records Administration; to use the threat of a DOJ prosecution to coerce Georgia elections to "find" votes for Trump; and other activities detailed in the January 5th "Kraken" Powerpoint:

https://wehco.media.clients.ellingtoncms.com/news/documents/2021/12/11/voter-fraud.pdf

The only hope the Sedition Caucus and Trump have, is for the Trump legal team to run out the clock until Trump gets re-elected President in 2024.

That's not entirely fair, either.  That was Pelosi's take on the matter, but up to now, the NY courts have been pretty good at respecting the presumption of innocence and putting the burden of proof on the prosecution.

Only if the TX Prosecutors accepted Federal Funds.  Your argument is very stretched.
