Conservative Brief by Martin Walsh February 9, 2023

A pair of House Republicans are calling on Democrat Rep. Nancy Pelosi to testify about security failures that occurred at the U.S. Capitol Building on Jan. 6, 2021.

“The reason there wasn’t a proper security presence on that day goes right to the speaker’s staff and the speaker’s office. As you go back and look at the communications, there’s this pattern that develops where the Sergeant of Arms is meeting with Pelosi’s staff. Many of those meetings, Republican staff wasn’t allowed to be there, but they had this pattern where everything had to run through her office, her staff, before the Sergeant of Arms could make a decision,” Ohio Rep. Jim Jordan said when speaking about House Republicans’ report detailing security failures at the Capitol that day.

Texas Republican Rep. Troy Nehls issued a similar response: “And Nancy Pelosi. You do have questions you need to answer … Nancy, we’ll get you, and we’ll fly you back from Italy once you’re the ambassador,” Nehls said as he joked about prior reports speculating that President Biden was considering offering the U.S. Ambassador to Italy post to Pelosi.

Former President Donald Trump’s last secretary of defense has taken several “geriatric” congressional leaders to task in a new book, taking particular aim at Pelosi.

Be carefull what you ask for ... their could be blow back that she failed to secure the Capitol from her fellow Reps and Senators in the Sedition Caucus.

Seditious GOP Reps and Senators were Federal political actors of the Janurary 6th Cheetoh Putsch conspiracy to illegally have the State Legislatures override the will of the People in states with "disputed" or "alternate" slates of Electors.

A legally imaginative prosecutor may even be able to civilly or criminally prosecute members of GOP Congressional Sedition Cacaus for participating in a RICO scheme to illegally benefit Don Donald Trump poltically and financially.

A not so imaginative prosecutor might push over the Constitutional violations that occurred in modifying election laws without legislative input in those heavily contested States, not to mention reopen cases denied for 'lack of standing' in which the evidence was NEVER examined (and that's just about all of them).

What would be the predicate acts that would underpin such a RICO charge?

Predicate charges for RICO ... racketeering ... an organization with Trump as its head engaging in illegal activity for the purpose of financially enriching Trump (money changing hands) and politically corrupting the Electoral Process (fake Electors, State Legislature Nullification of ideally chosen Electors, coercing Georgia State elections officials with threats of illegal Federal action against them).

There was an rackereer influenced enterprise (Trump 2020 Re-election legal team) working to use the powers and offices of Federal and State governments to corruptly influence and coerce State and Federal Presidential elections officials for the benefit of Donald Trump.

The RICO statute lists a set of acts - the so-called "predicate acts" - which are required before an action under RICO will lie.  These include, generally:

* Any violation of state statutes against gambling, murder, kidnapping, extortion, arson, robbery, bribery, dealing in obscene matter, or dealing in a controlled substance or listed chemical (as defined in the Controlled Substances Act);

* Any act of bribery, counterfeiting, theft, embezzlement, fraud, dealing in obscene matter, obstruction of justice, slavery, racketeering, gambling, money laundering, commission of murder-for-hire, and many other offenses covered under the Federal criminal code (Title 18);

* Embezzlement of union funds;

* Bankruptcy fraud or securities fraud;

* Drug trafficking; long-term and elaborate drug networks can also be prosecuted using the Continuing Criminal Enterprise Statute;

* Criminal copyright infringement;

* Money laundering and related offenses;

* Bringing in, aiding or assisting aliens in illegally entering the country (if the action was for financial gain);

* Acts of terrorism.

The fake Elector ballots sent to the National Archives Administration might qualify as fraud or counterfeiting.

Trump's phone call to Brad Raffensperger threatening Federal prosecution might qualify as extortion.

The invasion of the Capitol on January 6th, while Congress was in session to count Electoral votes, might qualify as a terrorist act.

Those rooms at the Willard Hotel weren't free.  Someone paid for them.  Were those funds laundered from unlawful sources?

Who paid for the dinner at the Olive Garden?  Those never-ending breadsticks aren't free.  Were those funds laundered from unlawful sources?

It's best not to distrub the January 6th hornet's nest.
