ATF Unveils Pistol Brace Rule…Everything Is An SBR!

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) released its final rule surrounding pistol stabilizing devices killing off the market for the items unless court challenges prove successful.

The new rule (ATF final rule 2021R-08F) was published on the ATF’s website today and is set to be posted on the Federal Register on Monday, one day before the industry’s largest trade show, SHOT Show. The regulation will affect millions of Americans that currently own pistol stabilizing devices. What has been considered pistols for years will now be regarded as short barreled rifles (SBR) and be subjected to the National Firearms Act (NFA).

The proposed rule used a form known as “Worksheet 4999” to determine if a firearm equipped with a pistol brace would be considered an SBR by using a point system. The ATF ditched the form in favor of a widespread declaration that almost every pistol equipped with a brace of any kind would be considered an SBR.

    “Worksheet 4999 was intended to ensure uniform consideration and application of the statutory definition of those terms. Based on the comments received, the Department agrees that the proposed Worksheet 4999 and point system did not achieve these intended purposes,” the Final Rule reads.

Under the new rule, any firearm that is “designed or redesigned made or remade and intended to be fired from the shoulder” will be considered an SBR.

Any pistol with a length of pull that is consistent with that of what would be found in a rifle would be considered an SBR. Any adjustable attachments, such as a multi-position buffer tube, would also automatically make the pistol an SBR. If the shooter places an optic on their firearm that requires an eye relief that is consistent with what’s used on a rifle, such as a scope, then that gun will also be considered a short barreled rifle. If a firearm has the surface area to be fired from the shoulder, such as a firearm equipped with a nonadjustable buffer tube, then that will be considered an SBR, basically making every AR-15 pistol and SBR.

I have scopes on 2 pistols and a red dot on another. It's scary to think that they are going to be considered SBRs.

Remember, Millions of people have these braces on their guns. This new rule, which isn't even a law but has the consequences of being law, asserts that any weapon that is designed, redesigned, manufactured or modified to be fired from the shoulder will now legally be an SBR.

There is also the possibility that if a firearm only features a surface area that could permit it to be fired from the shoulder, it may fall under the definition of an SBR.

The ATF will consider any pistol with a length of pull equivalent to that of a rifle to be an SBR.

Further, the addition of an optic on a pistol that requires eye relief in the same fashion as a rifle will be an SBR. So simply putting an optic on a pistol will likely change it from a pistol to an SBR.

Once again, remember, the ATF told us that these braces were legal to put on our guns, and now over night, they're illegal unless you register them with the ATF.

It doesn't take a genius to see how this is a defacto gun registration.

So now, millions of guns that were once not on a registration will have to be on a registration, or you become a felon.

I'm optimistic there will be lawsuits filed over this but as anyone who has had the misfortune of dealing with the court system, the one thing they are not is fast.

The Bureau of Alcohol, Tobacco, Firearms, and Explosives’ (ATF’s) stabilizer brace rule was finalized January 13, 2023, and it portends the registration of millions of guns.

Breitbart News reported the announcement of the finalized rule, noting that owners of said braces will have 120 days to register them once the rule is published in the federal register.

This means millions of guns must be registered within 120 days.

At the low end of the spectrum, NPR notes, “Officials estimated about 3 million stabilizing braces are currently in circulation in the U.S.”

At the higher end of the spectrum, the Congressional Research Service suggested there were already “between 10 and 40 million” stabilizer braces by April 19, 2021.

For stabilizer brace owners who do not wish to register their guns, the ATF provides four alternatives:

•    Turn in the entire firearm with the attached “stabilizing brace” to ATF;

•    Destroy the whole firearm;

•    Convert the short-barreled rifle into a long-barreled rifle;

•    Permanently remove and dispose of, or alter, the “stabilizing brace” from the firearm so that it cannot be reattached.

Breitbart News noted that the U.S. Court of Appeals for the Fifth Circuit struck down the ATF’s bump stock ban on January 6, 2023.

Judge Jennifer Walker Elrod wrote the Fifth Circuit’s majority opinion, noting the ban came as myriad demands for a ban were made following the October 1, 2017, Las Vegas shooting:

Republican lawmakers and gun rights groups blasted the Biden administration over a new rule that tightens regulations on pistol stabilizing braces.

The Bureau of Alcohol, Firearms, Tobacco and Explosives (ATF) finalized a new regulation Friday that will treat guns with stabilizing accessories like short-barreled rifles, which require a federal license to own under the National Firearms Act.

The move is part of a comprehensive gun crime strategy President Biden announced in April 2021, in response to the massacre at a grocery store in Boulder, Colorado, where a gunman using a stabilizing brace killed 10 people. A stabilizing brace was also used in a shooting in Dayton, Ohio, that left nine people dead in 2019.

Announcing the rule, Attorney General Merrick Garland said that stabilizing brace accessories, which were designed to help disabled combat veterans enjoy recreational shooting, transform pistols into short-barreled rifles.

“Keeping our communities safe from gun violence is among the Department’s highest priorities,” Garland said. “Almost a century ago, Congress determined that short-barreled rifles must be subject to heightened requirements. Today’s rule makes clear that firearm manufacturers, dealers, and individuals cannot evade these important public safety protections simply by adding accessories to pistols that transform them into short-barreled rifles.”

“Certain so-called stabilizing braces are designed to just attach to pistols, essentially converting them into short-barreled rifles to be fired from the shoulder,” said ATF Director Steven Dettelbach. “Therefore, they must be treated in the same way under the statute.”

I'm sure this will change now: A mare's leg is only considered an SBR if it was a cut down Model 1892 with a serial number. But a mare's leg built from the ground up is considered a pistol.
