Rep. Thomas Massie (R-Ky.) issued a warning to states moving to keep former President Trump off the presidential ballot, saying the House of Representatives has the final say over whether electors from those states are certified on Jan. 6, 2025.

“Maine, Colorado, and other states that might try to bureaucratically deny ballot access to any Republican nominee should remember the U.S. House of Representatives is the ultimate arbiter of whether to certify electors from those states,” Massie posted Friday on X, formerly Twitter.

Billionaire Elon Musk, owner of X, replied to Massie’s tweet about certification: “Interesting.”

Trump was declared ineligible by Colorado’s Supreme Court last week and by Maine’s secretary of state on Thursday under the 14th Amendment’s insurrection clause, pointing to Trump’s denial of 2020 election results and actions leading up to a mob of his supporters attacking the Capitol building on Jan. 6, 2021, as it met to certify electors from each state.

That normally mundane certification procedure in January 2025, Massie suggested, could be the mechanism by which Congress tosses out electoral votes from Maine, Colorado and any other states where Trump is ultimately denied ballot access.

All of this denying people a place on the ballot, without any conviction to justify it is bogus.

It violates the 5th and 14th Amendments, but even more, it is the State Legislatures which make the election rules, not the Courts, under the US Constitution.

We're not yet at that point.  The Colorado ruling was for the primary election.  And neither Congress nor the State of Colorado has any authority whatsoever to block any political party from putting a name on a party primary ballot.

The problem is the cause. Remember: there is no right to ballot access. If the Democrats decided "you know what? We're just not going to certify your petitions, and that's our right, because we said so," it'd be a lot tougher to fight against that. Many lesser candidates get thrown off the ballot on those grounds (or lack thereof) regularly. But the fact that they're using a Constitutional clause now exposes them to legal challenges.

As we all know, Trump hasn't been found to engage in insurrection, the necessary clause needed to disqualify him. Even so, it's not even clear whether states would be required to pull him from the ballot; unlawful candidates (foreign-born naturalized citizens, those under 35) have qualified for ballots elsewhere.

Either they're overthinking this or they really want this to fail, since it'd be so much easier to just leave him off the ballot and deny any appeals. At this point I can't tell which.

In Colorado, ballot access for a primary election is left up to each Party.  The State has no say.  At least that's what Colorado law says.
