The man accused of kidnapping billionaire heiress Eliza Fletcher was recently released from prison after serving a 20-year sentence for a similar crime.

Cleotha Abston, 38, was arrested and convicted in 2000 for the kidnapping of Memphis attorney Kemper Durand.

At around 2am May 25, 2000, Abston approached Durand from behind on Beale Street in Memphis then robbed him and forced him into the trunk of his car, according to the Memphis Flyer.

Abston then drove Durand around for several hours, then forced him into an ATM and demanded he draw out cash. While in the ATM Durand spotted a housing authority officer and yelled for help, causing Abston to flee.

Abston was convicted for that kidnapping and released from prison in July of 2020, according to Tennessee Department of Corrections, The US Sun reported.

On Sunday Abston was charged with especially aggravated kidnapping and tampering with evidence following Fletcher's Friday disappearance.

He refuses to tell police where they can find Mrs. Fletcher. ...

But what’s especially heart-wrenching is that this crime was completely avoidable.

In 2001 Abston was arrested and charged with kidnapping a local attorney during a violent carjacking. The attorney, who survived, was stuffed in the trunk of the car.

Abston was sentenced to 24 years in prison.

So why didn’t he serve out the full term of his sentence? It was a violent, heinous crime. Why was he allowed to walk out of jail and back onto the streets of Memphis?

The problem is that violent criminals are being treated as victims. That’s why Tennessee House Speaker Cameron Sexton embrace legislation to fix that problem. It’s called “Truth in Sentencing” and it mandates that criminals serve 100 percent of their sentences for 31 differnet violent offenses.

“Real Truth in Sentencing means no early release from prison,” he wrote in 2021. “We need to protect victims, not violent criminals.”

Don’t do the crime, if you can’t handle the time, he said.

The family of missing Memphis teacher Eliza Fletcher made an emotional plea as the search for the mom of two continues.

“We believe someone knows what happened and can help,” her uncle Mike Keeney said Saturday, as her husband Richard Fletcher III stood next to him wiping away tears.

“More than anything we want to see Liza returned home safely,” he continued, also joined by her parents and brother.

The 34-year-old Tennessee mom of two vanished after being abducted during her morning jog Friday. Cleotha Abston was charged Sunday with especially aggravated kidnapping and tampering with evidence, hours after cops found him inside the black SUV wanted in connection with Fletcher’s disappearance. The mom has yet to be located.

A second man was also charged Sunday during the investigation but is currently not believed to be connected to Fletcher’s abduction.

Eliza is the granddaughter of billionaire hardware magnate Joseph Orgill III, who founded the private family business Orgill Inc. Her family has offered a $50,000 reward for information in her disappearance.

MEMPHIS, Tenn. – Memphis police set up a mobile command center and were searching an area on Sunday near a home where Cleotha Abston, a 38-year-old man suspected of kidnapping Eliza Fletcher, could be seen washing clothes and cleaning the interior of his vehicle on Friday following the alleged abduction. Police have not confirmed that Sunday's search is connected to the violent abduction of the billionaire heiress.

Surveillance video reviewed by police shows a man forcing Fletcher, a 34-year-old mother of two and kindergarten teacher, into a GMC Terrain as she was out for a morning run on Friday near the University of Memphis campus. The video also shows Fletcher fighting back against her abductor.

Police located that GMC terrain at Abston's residence on Saturday and took him into custody after he attempted to flee.

Two witnesses told police that they saw Abston "acting very strange" and "behaving oddly" as he washed his clothes in a sink and cleaned the interior of the GMC Terrain at his brother's home near the Pine Hill Community Center, according to an affidavit.

Police wrote that it was "probable and apparent" that Fletcher's injuries "left evidence, e.g., blood, in the vehicle that the Defendant cleaned."

 New details emerge in ‘violent’ Eliza Fletcher kidnapping

Missing Memphis teacher Eliza Fletcher was forced into a black SUV in a “violent” manner — and a pair of sandals left at the scene helped cops locate her alleged abductor, according to police documents obtained by The Post Sunday.

Fletcher, 34, was abducted on her regular 4 a.m. jog Friday after stalked by Cleotha Abston, who’d waited for her to run past him, the police affidavit alleged. She had run from her home in the fancy Central Gardens neighborhood to a nice area near the University of Memphis campus.

Court records show Abston, 38, is a previously convicted kidnapper: he pleaded guilty to especially aggravated kidnapping and robbery in 2001. He was sentenced to 24 years and 11 years in prison respectively, although it is unclear how long he remained incarcerated and if he served his sentences concurrently.

Tennessee authorities obtained surveillance footage of the kidnapping, which allegedly showed Abston running “aggressively toward the victim, and then force the victim Eliza Fletcher into the passenger’s side of the vehicle,” the documents said.

“During the abduction, there appeared to be a struggle,” according to the affidavit, which cited “noticeable damage to the back-passenger taillight area” of the GMC Terrain. 

Police said after Fletcher — who is still missing — was forced into the black SUV, “the vehicle then sat in the parking lot with the victim inside for approximately four minutes before it drove off.”

It is unclear what happened during that time.

“As the abduction was violent with, as captured on video, the suspect waiting for, then rushing towards the victim, then forcing the victim into the car, where she was confined and removed and continues to be missing, it is believed and supported by the facts and physical evidence that she suffered serious injury,” the affidavit said.

“Further, it is probable and apparent from witness statements that these injuries left evidence of blood in the car the defendant cleaned,” it continued.

According to the document, at 6:45 a.m., good Samaritan Miles Fortas was riding his bike when he found Fletcher’s cell phone and a pair of Champion slide sandals in the area where the mom of two was kidnapped. Fortas, unaware of what had occurred, gave the items to the Fletcher family, who then turned them over to authorities.

“DNA found on the shoes matched DNA for Cleotha Abston” that was already in a police database, according to the affidavit.

Authorities said they found footage of Abston wearing Champion slides the day before the alleged kidnapping. They also said his cell phone pinged near the site of the Friday kidnapping.

The car apparently belongs to a local cleaning service that employed Abston.

Officers arrested him after finding him standing in the doorway of his home.

A crime scene with at least a mile radius was blocked off near an abandoned school and less than a mile from 1765 Orleans Street where a witness told police they saw the suspect, Cleotha Abston, cleaning blood out of a GMC Terrain with floor cleaner and washing his clothes. They said he was acting strange.

U.S. Marshals arrested 38-year-old Abston on Saturday after police detected his DNA on a pair of sandals near where Fletcher was last seen, according to an arrest affidavit. An arraignment has been set for Tuesday.

Authorities have said Fletcher, 34, was jogging around 4 a.m. on Friday when a man approached her and forced her into an SUV after a brief struggle. Fletcher was reported missing when she did not return home.

Shelby County District Attorney Steve Mulroy has announced that his office will hold a press conference on Tuesday at 11:30 a.m. ET in light of the latest developments related to Eliza Fletcher's abduction and murder.

Accused killer Cleotha Abston appeared before a judge around 10 a.m. ET Tuesday, when prosecutors said they had updated his charges to include murder, premeditated murder, and murder in perpetration of kidnapping.

The judge scheduled a second court date for Wednesday, Sept. 7, at 9 a.m. (10 a.m. ET).

Accused murderer Cleotha Abston appears in court



Cleotha Abston, the man accused of kidnapping and murdering young Memphis mom Eliza Fletcher, appeared in court on Tuesday morning.

Abston, 38, wore a green jail-issued jumpsuit, a white undershirt and a face mask as he appeared before the judge.

A court-appointed attorney was enlisted to represent Abston.

During Tuesday's hearing, prosecutors announced additional charges of murder, premeditated murder, and murder in perpetration of kidnapping.

The judge scheduled a second court date for Wednesday, Sept. 7, at 9 a.m. (10 a.m. ET).

Eliza Fletcher: Alleged kidnapper Cleotha Abston charged with first-degree murder, records show

Cleotha Abston, the man accused of kidnapping Memphis mom Eliza Fletcher, has now been charged with first-degree murder, in addition to his previous charges, records show.

Abston was previously charged with especially aggravated kidnapping and tampering with/fabricating evidence. Late Sunday, officials added three additional charges against Abston: identity theft, theft of property of $1,000 or less, and illegal possession of a credit or debit card of $1,000 or less, records show.

The murder charge was added on Tuesday morning.

Bail was previously listed as being set at $500,000, but grew to $510,000 overnight. It was not immediately clear if the bail amount would increase further in light of the new charge.

MEMPHIS, Tenn. – Memphis police and several other law enforcement agencies found "tire marks" and smelled an "odor of decay" during their search for the body of Eliza Fletcher on Monday evening.

A new affidavit released Tuesday states that a law enforcement officer found the tire marks in high grass and an odor of decay at 1666 Victor St. in Memphis, which then led them to a rear driveway where a body later identified as Eliza Fletcher was found.

Authorities revealed on Tuesday that they discovered Fletcher's remains at 5:07 p.m. Monday in the "rear of a vacant duplex apartment" near the area where she was abducted.

Police have so far hit Cleotha Abston-Henderson, 38, with a slew of charges, including first-degree murder, premeditated murder and murder in perpetration of kidnappings, in addition to other counts that include aggravated kidnapping and tampering with/fabricating evidence.

In the back of the home, officers "noticed a set of steps just north of the rear driveway. Immediately to the right of the steps, [one of the officers] located an unresponsive female lying on the ground," the affidavit states.

Investigators then canvassed the surrounding area and spotted "a discarded trash bag" roughly 0.3 miles away on South Orleans Street, the affidavit states.

"The bag contained purple Lululemon running shorts that were consisted (sic) with the ones Eliza Fletcher was last seen wearing," the affidavit goes on.

Fletcher, 34, was abducted around 4:30 a.m. Friday while she was running near the University of Memphis. At the time, she was wearing a pink top and purple shorts.


Surveillance footage showed a black GMC Terrain "passing and then waiting for the victim to run by," according to a Memphis Police Department affidavit. "A male exited the black GMC Terrain, ran aggressively toward the victim, and then forced the victim Eliza Fletcher into the passenger side of the vehicle … there appeared to be a struggle."

The affidavit later added: "The vehicle then sat in the parking lot with the victim inside for approximately four minutes before it drove off."

The "violent" abduction was caught on video and allegedly showed Abston-Henderson "waiting for, then rushing toward the victim, then forcing the victim into the vehicle."
