Great Barrington Declaration Scientists Join Missouri, Louisiana in Lawsuit Against Biden Administration For Censoring Covid Facts

Dr. Jay Bhattacharya, Dr. Martin Kulldorff, and other scientists have joined the lawsuit alleging the (CDC) and (DHS) worked with Big Tech to censor Americans discussing covid.

Last month, Legal Insurrection reported that the states of Missouri and Louisiana filed a complaint alleging that such collusion violated, among other things, its citizens first amendment rights.

Legal Insurrection readers may also recall my reports about the Great Barrington Declaration. The formal statement promoting “focused protection” rather than blanket lockdowns and restrictions was signed by over 40,000 scientists (including myself), and was authored by Dr. Martin Kulldorff (professor of medicine at Harvard University), Dr. Sunetra Gupta (professor at Oxford University, an epidemiologist with expertise in immunology, vaccine development, and mathematical modeling of infectious diseases), and Dr. Jay Bhattacharya (professor at Stanford University Medical School).

Now Bhattacharya, Kulldorff, and other scientists have joined the lawsuit filed by the states of Missouri and Louisiana, alleging that the Centers for Disease Control and Prevention (CDC) and Department of Homeland Security (DHS) worked with Big Tech companies to censor Americans discussing covid. The scientists are represented by the New Civil Liberties Alliance (NCLA).

Social media platforms, acting at the federal government’s behest, repeatedly censored NCLA’s clients for articulating views on those platforms in opposition to government-approved views on Covid-19 restrictions.

This insidious censorship was the direct result of the federal government’s ongoing campaign to silence those who voice perspectives that deviate from those of the Biden Administration. Government officials’ public threats to punish social media companies that did not do their bidding demonstrate this linkage, as do emails from the Centers for Disease Control and Prevention (CDC) and the Department of Homeland Security (DHS) to social media companies that only recently were made public.

Science is about asking questions, hypothesizing and testing assumptions and conclusions. Scientists have always questioned current dogma. Stop doing that and human advancement ceases.

                FIRST AMENDED COMPLAINT
                NATURE OF THE ACTION

1. In 1783, George Washington warned that if “the Freedom of Speech may be taken away, ”then “dumb and silent we may be led  like sheep, to the Slaughter.” George Washington, Address to the Officers of the Army (March 15, 1783). The freedom of speech in the United States now faces one of its greatest assaults by federal government officials in the Nation’s history.

2. A private entity violates the First Amendment “if the government coerces or induces it to take action the government itself would not be permitted to do, such as censor expression of a lawful viewpoint.” Biden v. Knight First Amendment Institute at Columbia Univ., 141 S. Ct. 1220, 1226 (2021) (Thomas, J., concurring). “The government cannot accomplish through threats of adverse government action what the Constitution prohibits it from doing directly.” Id.

3. That is exactly what has occurred over the past several years, beginning with express and implied threats from government officials and culminating in the Biden Administration’s open and explicit censorship programs. Having threatened and cajoled social-media platforms for years to censor viewpoints and speakers disfavored by the Left, senior government officials in the Executive Branch have moved into a phase of open collusion with social-media companies to suppress disfavored speakers, viewpoints, and content on social-media platforms under the Orwellian guise of halting so-called “disinformation,” “misinformation,” and “malinformation.”
