18 U.S. Code § 793 - Gathering, transmitting or losing defense information

There are several sections here, each dealing with intent or action to disseminate defense info.  None of these apply here.  Not only is 18 U.S. Code § 793 is a non issue, they should have been laughed out of court for even trying this.

Which is why they went to a VERY biased Administrative law judge instead of a real one.
"I wish it need not have happened in my time," said Frodo.

"So do I," said Gandalf, "and so do all who live to see such times. But that is not for them to decide. All we have to decide is what to do with the time that is given us."

18 U.S. Code § 1519 - Destruction, alteration, or falsification of records in Federal investigations and bankruptcy

Whoever knowingly alters, destroys, mutilates, conceals, covers up, falsifies, or makes a false entry in any record, document, or tangible object with the intent to impede, obstruct, or influence the investigation or proper administration of any matter within the jurisdiction of any department or agency of the United States or any case filed under title 11, or in relation to or contemplation of any such matter or case, shall be fined under this title, imprisoned not more than 20 years, or both.

This has nothing to do with classified documents.  The only thing in this statute that could apply here is the term "conceals" in that Trump was concealing documents with the intent to inhibit a bankruptcy proceeding or other investigative matter.  In the spirit of the law, there is nothing here that applies to Trump.

The affidavit is under seal because it potentially identifies a confidential informant or cooperating witness of an ongoing FBI/DOJ investigation.

There's a rat in Trump's orbit.  Maybe more than one.

By law, the President has to have a Secret Service detail around him at all times.  So the Dems plant a Secret Service agent to his detail that rats out everything he does including conversations with his legal counsel, cell phone records, whereabouts, etc.  Things only a Secret Service agent would have access to.  Damn right they need to release the affidavit.

Secret Service Agents are law enforcement professionals employed by the Federal Government who have a professional duty to report Federal crimes they witness.

If Trump wanted a dedicated security posse of loyal sycophants, he could always pay for his own private security detail.

Like they did with Hunter Biden?  Hillary Clinton?

Also, what crime did they witness Trump doing?

Now We Know the Three Crimes Donald Trump Allegedly Committed from the FBI’s Search Warrant

by Kyle Becker August 12, 2022

The three crimes that Donald Trump allegedly committed by reportedly removing classified documents and storing them at his Mar-A-Lago statement have been revealed according to the FBI’s search warrant.

The FBI’s search warrant lists three crimes, per a new exclusive report from Breitbart News:

18 USC 2071 — Concealment, removal or mutilation
18 USC 793 — Gathering, transmitting or losing defence information
18 USC 1519 — Destruction, alteration or falsification of records in Federal investigations

The search warrant lists “three criminal statutes under which items are to be searched and seized,” Breitbart News reported. “They are: 18 U.S.C. section 793, which deals with defense information; 18 U.S.C. section 1519, which deals with destroying federal documents; and 18 U.S.C. section 2071, which deals with concealing, removing, or damaging federal documents. The first statute is the one that has likely provoked media speculation about so-called ‘nuclear’ documents: it applies to a broad range of defense ‘information,’ from code books to ordinary photographs.”

The FBI search warrant affidavit thus shows that Donald Trump is under investigation for potential obstruction of justice and violations of the Espionage Act.

Donald Trump reacted to the accusation that he committed these crimes on Truth Social on Friday afternoon.

“Number one, it was all declassified,” Trump said on Truth Social. “Number two, they didn’t need to ‘seize’ anything. They could have had it anytime they wanted without playing politics and breaking into Mar-a-Lago. It was in secured storage, with an additional lock put on as per their request.”

No, we do not.  There were three statutes listed on the warrant.  But no one from the Justice Department has come forward and offered a case explaining how Trump violated any of the three.
