EPA case decision comes as a major blow to the Biden admin's climate change agenda

Supreme Court Justice Elena Kagan warned parts of the East Coast could be "swallowed by the ocean" in a dissenting Supreme Court opinion in an environmental regulation case Thursday.

"If the current rate of emissions continues, children born this year could live to see parts of the Eastern seaboard swallowed by the ocean," Kagan wrote in her dissent.

Justices Stephen Breyer and Sonia Sotomayor joined Kagan's dissent in the 6-3 case.

"Today, the Court strips the Environmental Protection Agency (EPA) of the power Congress gave it to respond to ‘the most pressing environmental challenge of our time,'" Kagan wrote.

Kagan said the dangers of rising temperatures and, as a result, devastating environmental effects, including, "Rising waters, scorching heat, and other severe weather conditions [that] could force ‘mass migration events[,] political crises, civil unrest,’ and even state failure.'"

Kagan elaborated that the Earth was "now warmer than any time" in modern history, highlighting the importance of scientific research on carbon dioxide contributing to global warming. She also wrote global warming could be the cause of "4.6 million excess yearly deaths."

She added that the EPA's authority in curbing greenhouse emissions did fall into the parameters set by Congress.

If that is really the case, then Congress will see fit to give the EPA the authority necessary to deal with it.  Seriously, Kagan, did you not read the majority opinion?  All it said, at bottom, was that if Congress wants the EPA to enact the rules under review, then all it has to do is pass legislation authorizing the EPA to do so.

Easy peasy.

Kagan needs to reminded "Better to remain silent and be thought a fool than to speak out and remove all doubt." Also someone should ask her if the oceans are really rising, why are so many wealthy democrats buying beach front property?

The EPA doesn't have the power to do what it was doing, all the smoke, hype and panic over a claimed crisis by Justice Kagan doesn't change that.

Well, Justice Kagan,  If the EPA and Corps of Engineers would permit people to build seawalls between their land and the water, maybe less would be eroding away.  That problem isn't new, and the solution has been banned, despite working for centuries.

As for the changing shape of coastlines, yes, they are geologically dynamic, especially in beachfront areas and barrier islands. One storm can create or close inlets where none existed, strip a beach of sand, or build up a beach where there was none. It is always changing, and wave refraction will make headlands erode more quickly than straight shorelines or lagoons. It's simple shoreline processes working as they always have.
