Bipartisan Gun Deal Announced: No ‘Assault Weapons’ Ban, No Raised Minimum Rifle Age

A bipartisan group of senators announced a deal on gun control legislation Sunday in the wake of recent mass shootings — though the compromise excludes President Joe Biden’s “assault weapons” ban and a raised minimum age for rifle purchases.

The deal includes Republican priorities such as expanded mental health services and school safety. It nods to Democratic priorities by adding expanded background checks for those under the age of 21, who will now have juvenile records screened before gun purchases.

A press released from the bipartisan group outlines the contours of the proposed legislation (original emphasis) :

    BIPARTISAN GROUP OF SENATORS ANNOUNCE AGREEMENT

    WASHINGTON–U.S. Senators Chris Murphy (D-Conn.), John Cornyn (R-Texas), Thom Tillis (R-N.C.), Kyrsten Sinema (D-Ariz.), Richard Blumenthal (D-Conn.), Roy Blunt (R-Mo.), Cory Booker (D- N.J.), Richard Burr (R-N.C.), Bill Cassidy (R-La.), Susan Collins (R-Maine), Chris Coons (D-Del.), Lindsey Graham (R-S.C.), Martin Heinrich (D-N.M.), Mark Kelly (D-Ariz.), Angus King (I-Maine), Joe Manchin (D-W.Va.), Rob Portman (R-Ohio), Mitt Romney (R-Utah), Debbie Stabenow (D-Mich.), and Pat Toomey (R-Pa.) issued the following statement:

    “Today, we are announcing a commonsense, bipartisan proposal to protect America’s children, keep our schools safe, and reduce the threat of violence across our country. Families are scared, and it is our duty to come together and get something done that will help restore their sense of safety and security in their communities. Our plan increases needed mental health resources, improves school safety and support for students, and helps ensure dangerous criminals and those who are adjudicated as mentally ill can’t purchase weapons. Most importantly, our plan saves lives while also protecting the constitutional rights of law-abiding Americans. We look forward to earning broad, bipartisan support and passing our commonsense proposal into law.”The proposal includes:Support for State Crisis

    Intervention Orders
    ●     Provides resources to states and tribes to create and administer laws that help ensure deadly weapons are kept out of the hands of individuals whom a court has determined to be a significant danger to themselves or others, consistent with state and federal due process and constitutional protections.

    Investment in Children and Family Mental Health Services
    ●     National expansion of community behavioral health center model; major investments to increase access to mental health and suicide prevention programs; and other support services available in the community, including crisis and trauma intervention and recovery.

    Protections for Victims of Domestic Violence
    ●     Convicted domestic violence abusers and individuals subject to domestic violence restraining orders are included in NICS, including those who have or have had a continuing relationship of a romantic or intimate nature.

    Funding for School-Based Mental Health and Supportive Services
    ●     Invests in programs to expand mental health and supportive services in schools, including: early identification and intervention programs and school based mental health and wrap-around services.

    Funding for School Safety Resources
    ●     Invests in programs to help institute safety measures in and around primary and secondary schools, support school violence prevention efforts and provide training to school personnel and students.

    Clarification of Definition of Federally Licensed Firearms Dealer
    ●     Cracks down on criminals who illegally evade licensing requirements.

    Telehealth Investments
    ●     Invests in programs that increase access to mental and behavioral health services for youth and families in crisis via telehealth.

    Under 21 Enhanced Review Process
    ●     For buyers under 21 years of age, requires an investigative period to review juvenile and mental health records, including checks with state databases and local law enforcement.

    Penalties for Straw Purchasing
    ●     Cracks down on criminals who illegally straw purchase and traffic guns.

It is unclear whether the proposal can pass the 60-vote threshold required to defeat a legislative filibuster in the Senate — or whether the “progressive”-led Democratic caucus in the House would pass what they would see as a watered-down bill.

 Biden says he will sign Senate’s bipartisan gun proposal

President Biden said on Sunday that he plans to sign gun safety reforms proposed by a bipartisan group of senators earlier in the day, adding that he hopes legislation comes to his desk soon.

“I want to thank Senator Chris Murphy and the members of his bipartisan group—especially Senators Cornyn, Sinema, and Tillis—for their tireless work to produce this proposal,” Biden said in a statement, calling the proposed legislation the “most significant gun safety legislation to pass Congress in decades.”

“Obviously, it does not do everything that I think is needed, but it reflects important steps in the right direction, and would be the most significant gun safety legislation to pass Congress in decades,” Biden added.

I wonder what 'incentives' it gives to states to implement red flag laws?  Those laws could easily be broadened from what we have in FL (thanks Rick Scott /s).

So far, we have avoided the implementation of national red flag laws.

What else is in the bill?  With Cornyn, Romney and Portman working on it; I'm leery.

A) Pelosi on Senate gun pkg: While more is needed, this package will take steps to save lives. Included..are..proposals to incentivize states to establish extreme risk protection order laws and get guns out of the hands of those who pose a danger to themselves or others.

D) Pelosi: As we move forward on this bipartisan framework, we are continuing to fight for more life-saving measures: including universal background checks, banning high-capacity magazines and raising the age to buy assault weapons, which must also become law.

This is pretty much a publicity measure.  There is not much substance to it at all. I do worry about the precedent-setting aspect (ie, "camel's nose" problem), but they have to do something or they lose all credibility as a governing mechanism.

On this we differ. Sometimes, nothing is exactly what needs to be done. "DOING SOMETHING!!!" when nothing they do will actually stop the problem is part of the problem. Form over substance.

And yes, anything that nibbles away at the 5th amendment and due process, especially involving an enumerated Civil Right is cause for concern, especially when those nibbles at those Rights are so easily politicized and used not to prevent madmen from shooting up schools, but to strip political opponents of their God Given Rights in a proceeding that can be used politically against them without any recourse or right to defend against a presumption of guilt fabricated on thin evidence not obtained under oath. Stacks of red flag orders could be rubber stamped by people who have no clue about the individuals they are targeting, with something as thin as the assertion that "no one needs an AR-15, and you'd have to be crazy to want one".

This is just one more bad direction the country is going in, after decades of resisting this sort of crap, putting a sharp tool in the hands of wannabe totalitarians on both sides of the aisle, especially when the whole atmosphere is steeped in 1/6 "insurrection" nonsense.

The few voters here who might have abstained, or the even fewer who might have misguidedly voted for Biden, likely made absolutely no difference in the calculus of stealing the election in just 5 states (suspected) and three of those pretty much a certainty.

Using COVID as an excuse, Constitutional requirements for changing voting rules, state laws and ordinary form and supervision were cast to the winds without recourse or recrimination, and multiple methods were enjoined to make popular vote totals shift in Bidens favor, no matter how incredibly statistically improbable those totals seemed when the smoke cleared and the paper covering the windows was taken down.

A handful of votes made no difference, one way or the other, because the 'fix' was in.

There have been practically no prosecutions of those caught stuffing ballot boxes, despite the same technology used to track them, and video of them committing multiple counts of offenses, quite unlike people tracked standing in the street in Washington DC last January who just happen to be in the lead of the opposition in the Governor's race in one of those States. (I hope he stays in and gets elected--it's no crime to stand in the street, no matter what the people around you are doing).
