From my understanding of New York's 'Red Flag Law', the statute requires a petition of the court in order to take effect.  I know of no such petition in this case.  It does not mean that no other statute was violated.  But this New York law is a dead end if the case never went before a judge first.

And quite clearly, that standard contains discretion, because it requires the health professional to determine whether the individual is “likely to engage in conduct that will cause serious harm to self or others.”

The hospital apparently decided that he did not meet that standard, and therefore no reporting was required.
Apparently you did not read far enough: Section 2 pages 4-5 Among other disqualifying criteria, the Brady Act prohibits the receipt or possession of firearms by an individual who has
been adjudicated as having a mental disability or has been involuntarily committed to a mental institution.

It really ain't a secret. If passing laws stopped crime,there wouldn't BE any crime.

As in "None at all".

Laws are passed to PUNISH crime at BEST,but mostly to control and/or manipulate the citizens while making the lawyers,a special breed of creature that makes the laws,richer and more powerful.

I write "mostly" because we all know than other than a handful of crimes like rape,murder,etc,etc,etc,most laws SEEM to be passed purely to benefit the wealthy and the powerful.

Anyone who isn't paranoid in 2021 just isn't thinking clearly!
