What happens now that Roe v. Wade is overturned?

The Supreme Court’s decision to overturn the landmark abortion decision Roe v. Wade Friday is expected to ban or restrict the procedure for over 40 million women across at least 26 states.

While the high court’s decision to uphold the Mississippi law challenging Roe v. Wade does not outlaw abortion, it does hand regulatory power to state governments — the majority of which have indicated their intention to make it illegal to terminate a pregnancy.

In Kentucky, Louisiana and South Dakota, abortion bans are already in place, with so-called “trigger laws” kicking in automatically upon Roe’s reversal, according to an analysis by the Guttmacher Institute, a New York-based pro-choice research organization.

In Idaho, Tennessee and Texas — where abortion is already functionally illegal after six weeks — trigger laws will automatically outlaw abortion 30 days from the decision.

Seven other states require a largely perfunctory sign-off by the state’s attorney general before laws already on the books make abortion illegal in the absence of federal protection from Roe.

Confidence in Supreme Court hits record low as Roe v. Wade decision looms

America’s confidence in the US Supreme Court hit a record low this month as the justices are expected to issue a ruling overturning the 1973 Roe v. Wade as soon as Friday, a new survey found.

Only 25% of Americans have a “great deal” or “quite a lot” of confidence in the Supreme Court, an 11 percentage point drop from last year, according to a Gallup survey.

Gallup – which has measured confidence in the country’s highest court for 50 years – said the previous low of confidence was 30% in 2014.

Approximately 43% of respondents said they had “some” confidence in the Supreme Court, while 31% said they had “very little” or “none.”

Broken down by parties, the survey – released Thursday – found a massive drop in support from Democrats and Independents. Specifically, only 13% of Democrats have confidence in the court, compared to 30% previously and approximately 25% of Independents have confidence, while 40% did before.

I'm surprised that each didn't draft his/her own dissent, to which the other two would have joined.

Their dissent is such an egregious affront to the Constitution that none of them wanted to be credited with writing it.  In the first paragraph, they offer the same argument that the Democrat dissenters in Brown v. Board of Education offered, mainly that [Plessy] had been on the books for over 50 years, and that it shouldn't be overturned.  Almost 70 years has gone by since Brown overturned Plessy, but Democrats haven't changed a bit.

Well guess what the Great State of Mississippi did?  They passed a law.  That's what due process is.  And the only ones who are standing in the way of that today are Sonia Sotomayor, Stephen Breyer, and Elena Kagan.  THEY are the ones violating due process.

Pelosi: Dems will fight 'ferociously' to enshrine Roe v. Wade into law, blame GOP for 'cruel' ruling

House Speaker Nancy Pelosi on Friday said the "Republican-controlled" Supreme Court "achieved the GOP’s dark and extreme goal of ripping away women’s right to make their own reproductive health decisions."

Blaming former President Trump, Senate Minority Leader Mitch McConnell, the Republican Party, and its "supermajority" on the high court, Pelosi said "American women today have less freedom than their mothers."

“With Roe now out of their way, radical Republicans are charging ahead with their crusade to criminalize health freedom," she said in a statement, warning that in Congress "Republicans are plotting a nationwide abortion ban."

"In the states, Republicans want to arrest doctors for offering reproductive care and women for terminating a pregnancy," she warned. "GOP extremists are even threatening to criminalize contraception, as well as in-vitro fertilization and post-miscarriage care."

“A woman’s fundamental health decisions are her own to make, in consultation with her doctor and her loved ones – not to be dictated by far-right politicians," Pelosi said. "While Republicans seek to punish and control women, Democrats will keep fighting ferociously to enshrine Roe v. Wade into law."

"This cruel ruling is outrageous and heart-wrenching," she continued. "But make no mistake: the rights of women and all Americans are on the ballot this November.”

Wade, DNC Chair Jaime Harrison, DSCC Chair Gary Peters, DCCC Chair Sean Patrick Maloney, DGA Chair Roy Cooper, DAGA Co-Chairs Aaron Ford and Kathy Jennings, DLCC Chair Andrea Stewart-Cousins, and Democratic Mayors Association President Levar M. Stoney issued the following joint statement:

“Democrats believe women in America have the right to make their own health care decisions, and that politicians should never get in the way of these private decisions," they wrote. "Today’s Supreme Court ruling is the culmination of a coordinated Republican effort to attack this fundamental freedom – but Democrats will fight back with every tool we can, and voters of every political persuasion will hold the GOP accountable in 2022." 

“Make no mistake: The Republican Party will not stop at overturning Roe," they added.

The Democrats said the 2022 midterm elections "will now determine whether new, cruel, and punishing restrictions will be put in place on women and families."

"With Republicans in power, states could make abortion illegal without exceptions for rape, incest, and the life of the mother, and women and doctors could be charged with a crime if they have or perform an abortion," they warned.

“The stakes of November’s elections could not be higher – and voters will make their voices heard by standing with Democrats up and down the ballot.”

Breyer didn't write any of this.  The author is engaging in a petty political argument, constantly attacking the majority while offering zero explanation on how the Mississippi law violates the Constitution.  The author even makes the point that the Fourteenth Amendment was ratified by men only in 1868, admitting that none of those sexist pigs would have considered their words as affirming abortion as a guaranteed right.  But fast forward to 2022 when we can now affirm that the intent of liberty by those sexist men extended to prohibiting States from protecting the liberty of unborn babies.
If a political party does not have its foundation in the determination to advance a cause that is right and that is moral, then it is not a political party; it is merely a conspiracy to seize power.

Although I find it odd to hear someone characterize a woman freely choosing to have unprotected sex as "making their own health care decision", I do believe women have that right.  And no one is stopping them.  Not this Mississippi law.  Not the 1973 Texas law.  Not the 1973 Georgia law.  So carry on, women.  Keep exercising that free choice.  But when you end up getting pregnant, your 'freedom' does not suddenly expand to include depriving life to another.

More than 2 dozen states to restrict abortions after Roe v Wade overturned in Dobbs decision
Abortion faces restrictions, bans in at least 25 states, or half the country

   At least 13 states in the country have so-called "trigger laws" banning most abortions that will take effect immediately or within weeks of Roe v. Wade being overturned.

According to the Guttmacher Institute, a pro-abortion rights research group, those states are Arkansas, Idaho, Kentucky, Louisiana, Mississippi, Missouri, North Dakota, Oklahoma, South Dakota, Tennessee, Texas, Utah and Wyoming, which just passed its trigger law in April.

Today, the Supreme Court not only reversed nearly 50 years of precedent, it relegated the most intensely personal decision someone can make to the whims of politicians and ideologues—attacking the essential freedoms of millions of Americans.

Yes, and I trust that all are ready to go to bat for state and local elected officials.  Quite frankly, since this decision puts everything squarely back in the hands of state and local governments, there will be intense pressure to turn every state government blue - and to be perfectly honest, the DNC has a much, much better machine for turning out state and local elections than does the GOP.

And once they've turned the state governments blue on this issue, well, après les deluge.  Everything else they want at the state/local level will come to pass as well.
