This leak is of a "draft" opinion written by Alito in February, right...?
Do the Justices who would be joining him have their names affixed to it?
If so, is Roberts' name there?
My guess is that when this opinion was first written, the original vote was:
5 - to repeal (the 5 justices "on the right", other than Roberts
3 - nay votes (the 3 leftist justices)
1 - undecided (Roberts)
Obviously, the leak is intended to arouse enough rabble to persuade/coerce some justices on the right to change their minds and alter their votes.
These justices WOULD NOT be:
Thomas, Gorsuch, or Alito.
I'm confident their will is strong enough to resist.
They MIGHT be:
Kavanaugh, Barrett, and Roberts.
One would think Kavanaugh had his will steeled by his confirmation hearing. Then again, he was a buddy of Roberts, or something like that?
The left may hope that Barrett can be badgered into submission.
Whether she can or not, is an unknown (for now).
Roberts... well... he's not trustworthy. His flip-flop on obamacare proved that.
Having said this, if the "5 for the right" hold tight, the final ruling is a foregone conclusion. The "leak" is going to kick up a lot of dust, but the damage is already done. Whether it be five to four or six to three, the Roe decision looks to be history.
This was intended to be the final opinion issued in late June.
That's always the case with the controversial/important ones.
But... so long as the votes haven't changed, The Court might as well release it now, and get it over with.
Conservatives will cheer.
But I'm going to make this prediction:
The fall of Roe is going to result in "unintended consequences" for The Right.
We'll see that in the upcoming midterm elections, which may reveal how women "in the middle" and "on the right" really feel about Roe in the privacy of the voting booth.
As was Dredd Scott to the first War Between the States, could this be "1857 all over again" in the current "cold" war that's going on between the red and the blue right now...?
