Biden Uses Gun Control Announcement to Renew False Claim That Early Americans Couldn’t Buy a Cannon

President Joe Biden expounded on his new rules for so-called “ghost guns” Monday and renewed his false claim that early Americans could not buy a cannon.

Earlier on Monday, Breitbart News noted that the White House released a Fact Sheet as a precursor to Biden’s speech.

The Fact Sheet explained new rules requiring Federal Firearms License holders (FFLs) to add serial numbers to any unserialized gun taken into their possession:

The Justice Department is requiring federally licensed dealers and gunsmiths taking any unserialized firearm into inventory to serialize that weapon. For example, if an individual builds a firearm at home and then sells it to a pawn broker or another federally licensed dealer, that dealer must put a serial number on the weapon before selling it to a customer. This requirement will apply regardless of how the firearm was made, meaning it includes ghost guns made from individual parts, kits, or by 3D-printers.

Biden expounded on the information in the Fact Sheet during his speech, then renewed his calls for an “assault weapons” ban and universal background checks.

After announcing so-called “ghost gun” controls,” and pushing the other gun controls, Biden said, “By the way — it’s going to sound bizarre — I support the Second Amendment.”

He continued, “But from the very beginning the Second Amendment didn’t say you could own any gun you want, as big as you want. You couldn’t buy a cannon, when in fact the Second Amendment passed.”

Biden has repeatedly claimed early Americans could not buy cannons and his claims have been disproven again and again.

For example, on February 3, 2022, Breitbart News did a Fact Check on Biden’s claim that early Americans could not buy a cannon and found the claim to be false.

Years earlier, in 2020, PolitiFact did a Fact Check on Biden making the same claim and also found it to be false.

The Washington Post gave Biden four Pinocchios for claiming the purchase of cannons was prohibited by the Second Amendment and labeled the claim “false.”

The President just repeated the false statement that when the Second Amendment was ratified "you couldn't own a cannon." The suggestion that the Second Amendment was viewed as limited types of gun ownership, even cannons, is false.

...The President said "this is going to sound bizarre but I support the Second Amendment" and noted that you could not buy a cannon in the early Republic. It does sound bizarre because it is legally and historically untrue.

...There was no federal regulation or law barring the types of guns or weapons that could be possessed or owned when the Second Amendment was ratified. What is weird is that he keeps raising a point that undermines his position because this was not the view in the early Republic.

 It comes up all the time in all of my First Amendment type cases when I’m discussing somebody kind of where the limitations on free speech are, they always say, “Well, yeah, I know there are limitations because you can’t yell fire in a crowded theater.” So where did that come from?

It actually came from a case way back when, in I believe it was 1917, Schenck versus United States is the case. I’ll put the citation down here so you can actually look it up. And it was a quote from Supreme Court Justice, Oliver Wendell Holmes. And the interesting about it is the Schenck case wasn’t about fires, it wasn’t about theaters, it kind of wasn’t even about free speech. It was in a way, but it was really about a guy that was being charged with violations of the Espionage Act because he was a member of the socialist party and he was speaking out against the draft. And the other bizarre thing about why this quote gets attributed to why it’s okay to limit free speech is, the Schenck case, which has now actually been overturned and has been for like 60 years, actually stood for the exact opposite. The Schenck case was applying a pretty large degree of censorship on free speech. That’s why it was overturned is because it was actually found to be completely contrary toward what the First Amendment stood for.

So, the idea that you can’t yell fire in a crowded theater, Justice Holmes was using that as an analogy to simply say that free speech can’t go completely unchecked. And that idea has maintained it’s truth throughout the years. That’s still true. There are limitations on what is considered protected speech and what is not considered protected speech, and that’s a topic for a different video. But it’s just always been interesting to me that this quote, which is just dicta, it’s not the holding of the case, it’s not really the law of the land, and it’s not Justice Holmes saying that’s what the law of the land should be, has somehow withstood the test of time and is still, to this day, if you watch news reports on First Amendment issues, or you read newspaper articles on First Amendment issues, you’ll invariably run into somebody that talks about, “Well, we all know you can’t yell fire in a crowded theater.” That’s not the law. It really never has been the law. And it’s from a case that got overturned some 60 plus years ago. ...

My college fraternity had a cannon which we used to shoot off (powder charges, of course) at football games.

Today, for that and for countless other normal daily activities, we would be kicked off campus.

Gun massacres are starting up again,  The democrats were ready before the shooting started to scream gun control,   Are gun owners going to give up their guns because anything Biden does is better than Trump?  When it comes to playing the fool, in for a penny, in for a pound!  The last election, useful fool Presidential election, surprised even me!  The Republic many well be one useful fool election away from tyrant rule, our forefathers so despised.  Some even say; That was the last election, (they may end up being right).
