Federal judge orders Defense Department to stop discriminating against service members living with HIV

The Defense Department must stop discriminating against service members living with HIV, a federal judge in Virginia ruled Wednesday in what advocates are calling “one of the strongest judicial rulings in over two decades for people living with HIV.”

The ruling represents a landmark moment in the fight to advance the rights of HIV-positive people. It also helps to end the stigma around HIV, as it reflects the reality that it’s a chronic, treatable condition and not a reason to discriminate.

Army Sgt. Nick Harrison said he was denied the opportunity to serve as an officer because of his HIV status. After serving for 18 years in the Army and National Guard with deployments to Afghanistan and Kuwait — and after graduating from law school in 2011 — he applied to commission into the Judge Advocate General (JAG) Corps.
