‘Democrats have good reason to doubt whether an ERA would be ratified today,’ liberal law professor says.

Some leading Democrats want to see the Archivist of the United States David Ferriero insert the Equal Rights Amendment (ERA) into the Federal Register as a ratified Amendment to the Constitution.

The Archivist of the United States is the one that certifies Constitutional amendments. Pro-abortion organizations like the National Organization for Women and Planned Parenthood are strongly supportive of getting the ERA ratified.

This comes after decades of failed attempts to get the required three-fourths majority of states needed to ratify the pro-abortion amendment to the Constitution.

The original deadline, which courts have held to be the only one, was March 22, 1979, nearly 43 years ago.

“Democratic leaders like Rep. Carolyn Maloney (D-N.Y.), chair of the House Committee on Oversight and Reform, want Ferriero to simply publish the ERA in the Federal Register as a ratified amendment,” George Washington University law Professor Jonathan Turley wrote on March 9. 

“It isn’t, of course. However, these Democrats insist that a unilateral decision from Ferriero declaring it ratified would mean it is ratified … at least until some courts say otherwise,” Turley wrote.
