Fairfax County, Virginia Orders Principals to Suspend Maskless Students

The superintendent of Virginia’s Fairfax County Public Schools (FCPS) has directed principals in the district to suspend students who do not wear masks in school, according to a whistleblower report provided to Parents Defending Education (PDE).

Superintendent Scott Brabrand briefed school district principals Friday on the updated mask policy, which says, “Any student who refuses to wear a face covering while indoors on school property or during FCPS-provided transportation, and who is not otherwise exempt will be precluded access to face-to-face instructional programming until they comply with the requirements of this regulation.”

This comes only days after Virginia Gov. Glenn Youngkin (R) signed an executive order affording parents the right to choose whether or not to mask their children in public schools, which goes into effect Monday. Brabrand’s briefing slideshow shows direct defiance of Youngkin by announcing the continuation of a universal mask mandate six days after the governor’s executive order.

A Stafford County, VA schools employee just called into the show.

She tells me teachers there engage in "raucous laughter" when parental rights are invoked.

She says the school system intends to suspend students whose families decide not to mask them up starting Monday.

So we have the Executive Order, but you must conduct yourself in accordance with its terms to maintain your legal alignment and maximize our success in asserting our God given right to choose. The Smiling Patriot recommends the following course of action:

1. Email your children's school immediately to formally communicate the following:

"...in accordance with Governor Youngkins Executive Order No. Two (2022) and Order of Public Health Emergency One, which clearly affirms my right as a parent to unconditionally opt out of mask wearing, I hereby elect for [insert childs name(s)] not to be subject to any mask mandate in effect at [insert the school name]. Accordingly, as of Monday 24th January, 2022 [insert childs name(s)] will no longer be wearing a mask to school."

You may feel the need to explain your mask issues further. Resist that feeling. When it comes to the law, explanation is weakness.

Parents are sounding off on Fairfax County Public Schools (FCPS) for recent communication alerting them that their children will still potentially have to wear masks indoors for the 2022-23 academic year pending high CDC COVID-19 community rates.

The memo also noted, however, that parents and legal guardians have rights under the Code of Virginia, allowing parents the choice whether or not to send their kids to school masked.

"FCPS requires all students to wear a face covering when indoors (except while actively eating/drinking) on school property (to include the buildings, school buses and other school provided vehicles) when the CDC COVID-19 Community Level for Fairfax County is high," the email read.

"The current level for Fairfax County is medium. The Code of Virginia allows parents/legal guardians to elect for their child not to wear a face covering while on school property." ...

The Fairfax County Parents Association called the correspondence "baffling." Others suggested the school district was trying to find any reason to prolong the mask mandates. ...
