Joe Biden to Ban Cash Bail for Violent Criminals -- in the Interest of ‘Equity,’ You See

This Biden-Pelosi-Obama crowd is a tricky cast of characters that likes to tuck surprise goodies into immense legislation, hoping no one spots them until it’s too late.

Remember Nancy Pelosi back in 2010 saying the House had to pass the 2,500-plus page ObamaCare bill in order to see what was in it? So, we could just take Barack Obama’s word that if you liked your doctor and health plan, you could keep them.

This year, with a complicit and/or oblivious Joe Biden in the White House, Pelosi’s tax-happy House has slipped into legislation a pilot study to tax all American drivers by the actual miles they each drive, in addition to the per-gallon gas tax. That would require a mileage meter tracking where every vehicle goes every mile.

Then there’s the plan to tax capital gains when they appear on your statement, even before you sell that investment and actually get the profit.

Now, what’s just come out is a Joe Biden plan to abolish cash bail for violent suspects. No, seriously. Because, you know, why would any accused murderer skip town?

We’ve heard plenty of stories about “bail reform” over the past few years, few of them ending well. This is a progressive talking point that’s primarily been limited to changes in municipal law, though it’s shown up at the state level a few times, such as in New York. The goal is always the same, as is the supposed rationale for the change. If cash bail requirements disproportionately impact minorities it must, by progressive definitions, be racist, right? This week, however, we learned that proponents of this dangerous theory have gained a new and much bigger champion. As our friend and colleague Andrew Malcolm explains at Redstate, hidden away in Biden’s National Strategy on Gender Equity and Equality is an alarming codicil calling for the elimination of cash bail in most cases from the federal level. And it’s all being done in the name of racial and gender “equity,” don’t you know.

I'm no legal-beagle, but since the Constitution forbids excessive bail, doesn't that intrinsically mean cash bail can be legal, and thus forbidding bail would be unconstitutional?

The standard way to deal with the worst offenders is to make the bail high enough that they are unlikely to produce it. Only those with a record of flight can be held without bond. In the local jail there are about a dozen with bail amounts set above $500K, and a few at 1 million.
