A judge refused to dismiss a weapons charge Tuesday against an Illinois man accused of shooting three people during a protest against police brutality in Wisconsin last year.

Kyle Rittenhouse, of Antioch, Illinois, shot and killed Joseph Rosenbaum and Anthony Huber and wounded Gaige Grosskreutz during the protest in Kenosha. Prosecutors charged Rittenhouse, who was 17 at the time of the protest, with multiple counts, including homicide and being a minor in possession of a firearm. His trial is set to begin Nov. 1.

Rittenhouse's attorneys have argued that he fired in self-defense after Rosenbaum, Huber and Grosskreutz attacked him. They asked Kenosha County Circuit Judge Bruce Schroeder to dismiss the weapon possession charge during a hearing Tuesday.

Corey Chirafisi, one of Rittenhouse's attorneys, argued that the statute only prohibits minors from possessing short-barreled rifles. Rittenhouse used an AR-style semiautomatic rifle with a 16-inch barrel the night of the shootings, according to Chirafisi.

The only other prohibitions on minors possessing firearms lie in the state's hunting statutes, which state that children under 12 can't hunt with guns. That doesn't apply to Rittenhouse because he was 17 on the night of the shootings, Chirafisi said.

Rittenhouse is being tried as an adult for murder, yet is also charged with being a minor in possession of a firearm.

My memory pretty much sucks from chemo,but I am VERY confident I remember this when it happened,and that MINOR was assaulted by THREE adults with weapons,and acted in self-defense.

That judge needs to go to prison. You KNOW he has all the details,and he is purposely ignoring the self-defense angle.
Anyone who isn't paranoid in 2021 just isn't thinking clearly!

I ain't no lawyur and don't even play one on teebee,but I can see grounds for getting some of these charges dismissed,and then using them as evidence that the DA is overzealous and unjustly prosecuting a case that should never have seen but one day in court to have it dismissed.

Anybody know where the NRA is on this as far as helping him defend himself with cash and lawyurs?

At a MINIMUM,he should be able to get the case tossed under another judge during an appeal.

The rules change after conviction. So if you are tempted to plead, think again.

Another political prosecution. Seems the principle of 'equal justice under the law' is about the last thing law schools teach anymore. Commies do not find it useful.
