ACLU Demands Feds Vaccinate All Immigrant Detainees

Law360 (May 27, 2021, 5:19 PM EDT) -- The American Civil Liberties Union pressed U.S. Immigration and Customs Enforcement on Thursday to immediately vaccinate the over 22,000 people in immigration detention, slamming the agency's vaccination efforts as a "widespread failure" that endangers the lives of people in its custody.

ICE's detention facilities have recorded COVID-19 positivity rates five times greater than federal prisons and 20 times greater than the general U.S. population, the ACLU said. But while ICE detainees contract the virus at higher rates, the agency has "no clear plan" to ensure their vaccination, the ACLU wrote in a letter to U.S. Secretary of Homeland Security Alejandro Mayorkas and acting ICE Director Tae Johnson.

Several immigration detention centers in the U.S. are experiencing new spikes in COVID-19 cases.

ICE officials attribute the spikes to newly arrived immigrants transferred to ICE detention facilities from Border Patrol facilities near the border with Mexico, where there has been an influx of migrants and asylum seekers.

Many critics, however, say a failure by Immigration and Customs Enforcement under the Biden administration to systematically administer vaccines to detainees has led to the rise in new cases.

Critics say ICE has failed to adhere to other Centers for Disease Control and Prevention guidelines, including reducing unnecessary transfers of detainees between ICE detention facilities, where detainees live in tight quarters behind bars and the virus can easily spread.

Arizona groups are working to vaccinate 5,000 Central American migrants whom they say are difficult to reach online, according to a local church leader.

"I have been very worried about our people because many of them have not wanted to be vaccinated," said the Rev. Antonio Velazquez, who is originally from Guatemala and now serves as an evangelical pastor in Arizona.

Less than half (about 46%) of Arizona's entire population has been fully vaccinated against COVID-19, according to the Arizona Department of Health Services, even though more than half of the U.S. population has been inoculated.
