Arizona Seeks Preliminary Injunction To Stop Federal Immigration Policy

PHOENIX – Arizona Attorney General Mark Brnovich has filed a motion for preliminary injunction asking a court to prevent federal agencies from implementing a plan to slash arrests and deportations.

The Arizona Attorney General’s Office (AGO) is seeking an injunction from the U.S. District Court in Arizona to prevent the U.S. Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) from implementing the agency’s Interim Guidance.

The AGO claims the request is based on internal federal and state documents the AGO obtained that show a nearly 50 percent drop in ICE deportations and interior arrests. The District Court has set this matter for a hearing on May 27, 2021.

Arizona and Montana are suing DHS, ICE, and other federal officials over what they call “dangerous DHS Interim Guidance.”

AZ will be denied standing to sue.  Byrnovich has a rule of thumb:  If there's no chance of winning he'll file a suit.  If there is a chance, he'll ignore it like he did in the November election.
