U.S. Supreme Court hands victory to immigrants facing deportation

(Reuters) - The U.S. Supreme Court on Thursday bolstered the efforts of some long-term immigrants to avoid deportation in a ruling that faulted the federal government for improperly notifying a man who came to the United States illegally from Guatemala to appear for a removal hearing.

The justices, in a 6-3 ruling that divided the court’s conservative bloc, overturned a lower court’s decision that had prevented Agusto Niz-Chavez from pursuing his request to cancel the attempted expulsion based on having lived in the United States for many years. Niz-Chavez lives in Michigan with his family after entering the United States illegally in 2005.

Oh.

I didn't know the laws had a "if you can hide long enough you won't be sent home free" clause. (Turns out there is.  That needs to be rescinded, pronto.)

I thought it wasn't illegal ENTRY into the United States that was a crime, but Illegal PRESENCE that was the crime.  And the crime of illegal presence is something that is renewed on a daily basis.

Gorsuch, Thomas and Barrett are the three defectors here.

Why would an Invader have to be informed that he has to appear in court to deport the Invader?   If he's not informed of the court date, does that somehow invalidate the fact that he is in the country illegally?   Did he not know he entered the country illegally and thus can't be summarily kicked out when he's caught?   Is ignorance of the law some kind of protection when the criminal is an Invader?   

This ruling is llama droppings, just so the majority of the Invaders understand the reference.

This is another case of the Congress giving too much power to the bloated bureaucracy.  All the divisions & sub-sub-sub divisions, all the separate silos with their own bossiness result in this case from MI.

There are probably more citizens who suffer from administrative state's screw ups as illegals.

Thus people, legal or illegal, cannot follow or know all the rules, many of which contradict each other.

Laws are only made complicated because it profits lawyers.

What does immigration law have to say:

It has to define how one applies to immigrate into the US legally.  Make it simpler than the tax code.  Make it an automatic deportation for committing perjury.  No appeal allowed.

It has to say that people who don't follow the approved process are by definition in the country illegally.  (Didn't fill out the form properly.   May grant windows to correct errors.)

It has to define what penalties exist for punishing and deporting people who are in the country illegally.  Mercy is not an option.  They can go home and re-apply for admission from their home countries if they wish.   They will get end-of-line status and people who have not jumped the line are automatically preferred, forever.

Be harsh with our immigration laws.  Make the chance to come to the United States a treasured and valuable HONOR.  It's become a RIGHT, and that's cow diarrhea.
