Senate parliamentarian to let Democrats bypass GOP filibuster on two more bills

The Senate parliamentarian ruled Monday that Democrats can use special budgetary rules to avoid a GOP filibuster on two more pieces of legislation, setting the stage for President Biden's infrastructure agenda to pass in two packages with simple-majority votes.

It's a win for Senate Majority Leader Charles Schumer (D-N.Y.) that allows him to pass Biden's $2.25 trillion package by revising the fiscal 2021 Budget Resolution.

Schumer could pass a budget resolution for fiscal 2022 to do a third reconciliation package for the second half of the Biden infrastructure agenda. Or the fiscal 2021 budget could be revised a third time to set up a third reconciliation package.

Top Schumer aides had argued to parliamentarian Elizabeth MacDonough last month that Section 304 of the Congressional Budget Act of 1974 allows them to revise the budget resolution for fiscal 2021 to create additional reconciliation instructions, setting up pathways to pass two more bills this year with only a simple majority in the 50-50 Senate.

"The Parliamentarian has advised that a revised budget resolution may contain budget reconciliation instructions. This confirms the Leader’s interpretation of the Budget Act and allows Democrats additional tools to improve the lives of Americans if Republican obstruction continues," a spokesperson for Schumer said in a statement Monday. "While no decisions have been made on a legislative path forward using Section 304 and some parameters still need to be worked out, the Parliamentarian’s opinion is an important step forward that this key pathway is available to Democrats if needed."

Democrats used the budget reconciliation process earlier this year to pass Biden's $1.9 trillion coronavirus relief bill without any GOP votes, instead of the 60 votes needed to advance legislation in the upper chamber.

Clearly yet another thing that needs to be fixed via Constitutional Amendment.

Either erase the Senate, or mandate the terms of the filibuster and apply it to all legislation involving the budget, including the reconciliation process.

Too much totally unconstitutional crap is flushing through this scam-way.
The GOP is not the party leadership.  The GOP is the party MEMBERSHIP.   The members need to kick the leaders out if they leaders are going the wrong way.  No coddling allowed.

Democrats can now move the bill through the Senate without a single GOP vote


Democrats will be able to pass President Biden's $2.2 trillion spending bill with a simple majority vote due to a ruling by the Senate parliamentarian, according to Senate Majority Leader Chuck Schumer.

That means Democrats will need just 50 votes, with Vice President Kamala breaking the tie, avoiding the need for 60 votes to break a filibuster and allowing passage without a single Republican vote.

The ruling effectively gives Democrats an opportunity they might not have otherwise had to use the special reconciliation procedure on the bill.

Senate Majority Leader Chuck Schumer, D-N.Y., said in a statement on Monday that the Senate Parliamentarian would allow a revised budget resolution to contain reconciliation instructions pursuant to a little-known workaround.

“While no decisions have been made on a legislative path forward using Section 304 and some parameters still need to be worked out, the Parliamentarian’s opinion is an important step forward that this key pathway is available to Democrats if needed,” Schumer said...................

Amazing that the parliamentarian has this kind of power....

She doesn't.  Her rulings can be brushed off by a single Senator, like they did during the vote on the $1.9T COVID package recently passed and signed.  She ruled against the Rats on the $15 minimum wage, and they simply objected the ruling and passed it anyway. 

She is meaningless.

Schumer gets his game changer

A decision by the Senate parliamentarian to allow Democrats to advance multiple reconciliation packages this year is a game-changer that gives Senate Majority Leader Charles Schumer (D-N.Y.) multiple paths to advance President Biden’s agenda.

At a minimum, Schumer will be able to use budget reconciliation rules to bypass Republican filibusters two more times this year — just as he did to pass Biden’s $1.9 trillion American Rescue Plan last month on a 50-49 vote.
