Actually, something like it has been done before. Lincoln suspended Habeas Corpus during the war and mere suspicion was enough to have one imprisoned. Sweeping arrests of southern sympathizers, real and imagined, were made, including Frances Scott Key's grandson, who was imprisoned at Ft. McHenry. (The Almighty seems to love irony).
