They're gonan rack up more in attorney fees if they keep fighting this than what they owed the bakery in the first place.
I understand your point, but the appeal will cost
much less. The total defense through trial were in the neighborhood of $5M, but that includes a very long period of intense discovery, battles over that discovery, the filing of all those motions, and then of course the trial. All of that is done and need not be repeated. The appeal is basically all written submissions apart from an oral argument that will last somewhere around an hour or two. I'd be shocked if the costs of the appeal reached $1M.
