Just five GOP senators vote Trump impeachment trial is constitutional
By Jordain Carney - 01/26/21 03:27 PM ES

The Senate sent a strong signal Tuesday that there are not nearly enough votes to convict President Trump in an impeachment trial when only five GOP senators rejected an effort by Sen. Rand Paul (R-Ky.) to declare the looming trial unconstitutional.

The Senate voted 55-45 to set aside Paul's motion, with all but five GOP senators siding with Paul. GOP Sens. Mitt Romney (Utah), Ben Sasse (Neb.), Susan Collins (Maine), Lisa Murkowski (Alaska) and Pat Toomey (Pa.) voted with Democrats to table Paul's point of order.

The vote is the clearest sign yet that Trump is heading toward a second acquittal and offers an early insight into which Republicans are lining up behind an argument that his second impeachment trial isn't constitutional.

Trump will be the first president to undergo a trial after leaving office, but the Senate previously held an impeachment trial for a Cabinet official after they left office.

Paul, speaking ahead of the vote, warned that he wanted to force his colleagues to go on the record.

Rand Paul is alright!

It's going to be pretty tough for Pub Senators who voted the show trial is unconstitutional to convict Trump.

Rand Paul calls impeachment 'dead on arrival' after most Republicans signal that trial is unconstitutional

The Senate tabled an effort by Sen. Rand Paul Tuesday to force a vote on the constitutionality of former President Donald Trump's impeachment trial, but the vote offered an indicator for how Republican senators -- who overwhelmingly voted for Paul's measure -- feel about the trial.
Paul's motion was killed on a 55-45 vote, with five Republicans joining all Democrats, meaning 45 Republicans voted for Paul's effort. Republican Sens. Mitt Romney of Utah, Ben Sasse of Nebraska, Susan Collins of Maine, Lisa Murkowski of Alaska and Pat Toomey of Pennsylvania crossed party lines to vote with Democrats.
In order to convict Trump at his trial, at least 17 Republicans will need to vote with all Democrats when the trial begins next month. Significantly, Senate Republican leader Mitch McConnell sided with Paul in the vote -- a potential indicator that he agrees the constitutionality of impeaching a former President is in question.

13 days ago Mitchypoo "Turtle" McConnell was quoted as saying Trump committed "impeachable offenses"

Let's not forget that moment, as he hides behind 54 other senators today.

I suspect McConnell sees that Liz Cheney is likely to lose her position in the House Republican Caucus over her impeachment vote and he doesn't want the same to happen to him.

This is so revealing I can’t help but wonder if these five clowns don’t plan on running for re-election. Maybe they’re just stupid.

It's always about what's best for Mitch, with him.   If only we could elect reps that care more about what's best for the nation than their own hide, career and bank account(s).   Gone are those good ole days of the founders.

Rand Paul rocked here.  I only wish he had added "Republicans have not moved to impeach or censure or expel Democrats like Kamala Harris who supported summer-long rioting - but when we re-gain the majority we can."

Toomey has already indicated he will not run again.  He is a rat.

Romney the King Rat will not run again for senate, for he intends to run for POTUS in 2024.

Collins is getting long in the tooth, and she might not run again either.

Murkowski is finished.  She will be successfully challenged in a primary.

Sasse, I would hope is finished too.  He is what destroys any hope of a future for the Republicans.  Sanctimonious *ss!!!

I had heard that Ben Sasse yesterday said he thought the process to be unconstitutional.  Obviously, I heard wrong.  I should have known better by looking at his initials.

Anyhoo, we have 45 GOP Senators on record declaring this unconstitutional.  It is highly unlikely that any of those 45 would go back on that by cooperating with that unconstitutional process.

Romney is a complete douche.  I can't believe I was stupid enough to support him in 2008, although at the time he was still better than McCain.  And to think I got booted from TOS in 2012 for supporting Rick Santorum instead of Romney.

Sasse has swallowed the false rhetoric of Trump inciting violence.  Hopefully, someone will tie him down, show him the timeline, and make him read the actual transcript before voting.  There's still some things I like about Sasse.  But he has had the knives out for Trump since 2015 and has kept them out ever since.  I hold out hope that he recognizes truth and chooses correctly on the final vote.  Can't see that happening though for Murkowski, Romnuts, Collins, or Toomey.
If a political party does not have its foundation in the determination to advance a cause that is right and that is moral, then it is not a political party; it is merely a conspiracy to seize power.     -Dwight Eisenhower-

"The [U.S.] Constitution is a limitation on the government, not on private individuals ... it does not prescribe the conduct of private individuals, only the conduct of the government ... it is not a charter for government power, but a charter of the citizen's protection against the government."     -Ayn Rand-

Hoodat   Do not hold your breath for Sasse.  There is a definitive reason he dislikes Trump.  Did it ever occur to you that like Romney, he has hopes for a POTUS run, perhaps in 2024?  He stinks of intent for just that.

Any Republican that votes for Sasse or Romney is a fool.  Neither have leadership qualities.  I don't care what Romney did in business.
