Pence aide pushes back on Navarro claim that VP could delay election certification

A top aide to Vice President Pence is pushing back on statements made by a White House adviser suggesting the vice president could delay certification of votes from the Electoral College when he presides over a congressional count on Wednesday.

Peter Navarro, the White House director of trade and manufacturing policy, asserted during an appearance on Fox News over the weekend that Pence "has the authority" to provide a 10-day window to investigate the election results, saying, "I cannot imagine when you look to the facts, he won't vote the right way on that."

Trump made a similar but false claim in a tweet on Tuesday, saying: "The Vice President has the power to reject fraudulently chosen electors."


Marc Short, Pence's chief of staff, threw cold water on the idea.

"Peter Navarro is many things," Short told The Wall Street Journal for a story published Tuesday. “He is not a constitutional scholar.”

Congress is counting the Electoral College votes on Wednesday, the last step before President-elect Joe Biden's inauguration on Jan. 20.

A number of Republican senators have said they will object to the certification of the election results, an action that would trigger hours of debate during a joint session of Congress.

A majority in both chambers would need to vote to approve the rejection of any state's electors, though the vice president — acting as the president of the Senate during such a proceeding — cannot unilaterally invalidate or delay the certification of votes or electors.

The White House did not immediately return a request for comment.

I think that is what we all need to remember -- a majority in BOTH chambers is needed.  That's not going to happen.  The House will vote for Biden and because of McConnell and Mittens already swearing their allegiance to a Biden presidency, the hope that somehow this election is going to be overturned is gone.

Our ONLY hope right now is that the GOP wins GA and we maintain a slim majority.

BTW, just as a side note -- even IF Pence could somehow save this election and knock it bock into Trump's court, I don't think he'd do it.

Only problem with this theory @mystery-ak is in Jan 2017 VP Biden had no reason to claim or evidence to present of Republican coordinated election and voter fraud.  Biden's rejection of Trump would have been arbitrary and Al Gore's rejection of Bush would have been arbitrary since the courts ruled in W's favor in the Florida recount. 

Pence would not be acting arbitrarily in throwing the elector vote back to the legislatures in states with an overwhelming preponderance of evidence of fraud .... the same standard required by the highest court in the United States.

Why would sending the electoral vote back to the state legislature and asking THEM to review the fraud allegations and make the determination of rightful electors require 2/3 of both houses of our federal congress?
