Georgia GOP clash: Perdue files lawsuit against law allowing Kemp to raise unlimited funds

New Georgia law allows Kemp, but not his challengers, to set up a leadership committee that can raise unlimited funds

Paul Steinhauser | 6 Jan 2022

Former Sen. David Perdue of Georgia, who's primary challenging Republican Gov. Brian Kemp in this year's election, is taking aim at a state law that allows the incumbent governor to raise unlimited campaign contributions.

Perdue on Thursday filed a lawsuit challenging the constitutionality of Georgia Senate Bill 221, which allows Kemp – as well as a handful of state legislative leaders – to set up leadership funds or committees that can haul in and spend unlimited amounts of campaign cash. Word of Perdue's filing was shared first nationally with Fox News.

The bill was approved during Georgia’s 2020 legislative session mostly along party lines by the GOP controlled chambers and Kemp quietly signed the measure into law last May. Kemp's campaign created the Georgians First Leadership Committee in June, just days after the new law went into effect.  .  .  .

https://www.foxnews.com/politics/georgia-gop-clash-perdue-lawsuit-against-law-kemp-unlimited-funds

So while Secretary of State Brad Raffensperger was rewriting Georgia election law in order to help Democrats steel an election, the priority of the State Legislature was to pass a law protecting incumbents from election challenges.  At least we know where their priorities lie.

As Georgia ballot harvesting probe starts, some election evidence has vanished already

Some big Georgia counties say they didn't retain surveillance video from absentee drop boxes in the 2020 election.

John Solomon and Natalia Mittelstadt   |   January 7, 2022 - 10:56pm

Since 1960, federal civil rights law has required state and local election officials to "retain and preserve" records relating to elections involving federal officeholders for 22 months after ballots are cast.

That would seem to be a good thing as Georgia Secretary of State Brad Raffensperger embarks on an investigation into whether third-party liberal activists in 2020 illegally gathered and delivered absentee ballots for voters — a practice known as harvesting that is outlawed in the Peach State.

But some of Georgia's largest counties tell Just the News that they no longer possess evidence that could be helpful to probing the harvesting allegations: video camera surveillance footage that monitored the drop boxes installed around Georgia to help voters cast ballots during the pandemic.

Election officials in several counties say the reason they discarded the footage is that the emergency rules issued by the State Elections Board said they only needed to keep the footage for 30 days after the election.

"We took direction from the Secretary of State and State Election Board, assuming they were not implementing a Rule contrary to law," said the Cobb County elections office, which acknowledged it deleted its video footage from 2020. "Drop boxes were established under an emergency order from the Governor."

Fulton County, home to Atlanta and the state's largest voting metropolis, said it too has long since deleted the files.  .  .  .

Brad Raffensperger broke the law.  He should be prosecuted.  So did Cobb and Fulton County election boards.  They know what federal law says.  They willfully broke it.

Republican Georgia Gov. Brian Kemp’s dreams for an easy reelection bid is becoming seemingly more unlikely, as recent polling reports he is down double-digits in a hypothetical 2022 GOP primary.

Former Sen. David Perdue, R-Ga., whose gubernatorial bid is backed by President Trump, holds a commanding lead over “RINO” Kemp, according to a Fabrizio Lee & Associates poll.

The research shows Perdue led Kemp 47 percent to 44 percent in a hypothetical 2022 GOP primary. After respondents were told that Trump backed Perdue, the former senator’s lead skyrocketed to 56 percent to Kemp’s 34 percent, a 22-point jump.

How do those two (Kemp and Perdue) poll against the Election Sow (Abrams)? I'm not a fan of Kemp, but if got serious concerns about Perdue. He's classic Georgia "good ol' boy" and I guarantee you he's a republican out of expediency rather than any firmly held beliefs.

Georgia Secretary of State Calls for Release of ‘Secret Report’ on Dominion Voting Machines

Zachary Stieber  |  January 29, 2022

Georgia’s secretary of state has joined plaintiffs in lawsuit filed against him in calling for the release of a report that analyzes Dominion Voting Systems equipment.

The report, completed by J. Alex Halderman, director of the University of Michigan Center for Computer Security and Society, was filed under seal in Curling v. Raffensperger, a federal case that alleged hackers had “the capability” and “easy access” to voting machines in Georgia.

Georgia Secretary of State Brad Raffensperger, a Republican, said Jan. 26 that the report should be made public because it is “generating misleading media articles about the Dominion voting equipment used in Georgia.”  .  .  .

Secret report finds flaw in Georgia voting system, but state in the dark

Mark Niesse, AJC  |  Jan 26, 2022

A judge is considering releasing a redacted version of the report based on requests in court Thursday from Secretary of State Brad Raffensperger and plaintiffs in an election security lawsuit.

A confidential report alleges that hackers could flip votes if they gained access to Georgia’s touchscreens, drawing interest from the U.S. Department of Homeland Security, Louisiana election officials and Fox News.

One key agency hasn’t asked the court to disclose the report: the Georgia secretary of state’s office. [pre Jan 29]

There’s no sign that state election officials have done anything about the vulnerability, a potential flaw dangerous enough to be kept under seal, labeled in court as “attorneys’ eyes only” six months ago.  .  .  .

40K Election Fraud Affidavits Delivered to Gov Kemp

M Dowling  |  February 21, 2022

Governor Kemp’s staff received 40,000 election fraud affidavits for the 2020 election in Georgia. But how can this be? It was the most secure election ever.

A local group called Georgia Patriots (led by Holly Kelser) showed up to deliver about 40,000 sworn affidavits regarding 2020 election fraud to the office of Governor Brian Kemp.  .  .

Federal judge rules that Graham must testify in Georgia 2020 investigation

A federal judge in Atlanta has denied GOP Sen. Lindsey Graham's motion to quash a subpoena, ruling that he must testify before a Fulton County grand jury investigating former President Donald Trump's efforts to overturn the 2020 presidential election in Georgia.
In her written decision on Monday, US District Judge Leigh Martin May sent the case to the Superior Court of Fulton County to hear further proceedings on the US Constitution's "Speech or Debate" clause, the centerpiece that Graham's attorneys argued immunized the US senator from South Carolina from having to testify in this case.

"Because the record must be more fully developed before the Court can address the applicability of the 'Speech or Debate' clause to specific questions or lines of inquiry, and because Senator Graham's only request in removing the subpoena to this Court was to quash the subpoena in its entirety, the Case is REMANDED to the Superior Court of Fulton County for further proceedings," May wrote in the ruling.

The South Carolina Republican is scheduled to appear as a witness in Atlanta in front of the special grand jury on August 23.

In her ruling, May wrote that there are "considerable areas of inquiry" that are not "legislative in nature" and said that the District Attorney's office has shown "extraordinary circumstances and a special need for Senator Graham's testimony on issues relating to alleged attempts to influence or disrupt the lawful administration of Georgia's 2020 elections." ..............

Rudy Giuliani target of Georgia investigation over election claims
The Post Millennial, Aug 15, 2022

Former New York Mayor Rudy Giuliani is set to testify on August 17 in Atlanta, Georgia in front of a grand jury in, what the prosecution alleges was his role in looking into election integrity concerns in Georgia's 2020 general election results.

Giuliani was informed that he was the target of a probe into his possible interference in the 2020 election. Much of this stems from the Trump campaign's efforts to create slates of alternate electors who could vote for Trump in the Electoral College should the original results be found inaccurate.

The investigation is being led by the district attorney of Fulton County, Fani Willis. On August 9, a Fulton County judge in Georgia ordered Trump's former private attorney to appear before a special grand jury.

This should prove interesting.  Giuliani was one of the worst lawyers that Trump could have picked; sadly perhaps it was one of the few that he felt he could trust.

It's a possibility @sneakypete  but I think it was someone much closer in Trump's inner circle.  My bet is on Kushner.  I rule out Eric, or Don Jr. I've never, ever trusted Kushner and I don't think Ivanka can be trusted either.  At a stretch maybe Tiffany's new beau, but I doubt he'd be able to get that close yet.

Just get Raffensperger on the stand.  That is all I ask for.  Grill his ass, and prove that the election was stolen.  Regardless of what happens to Trump, they should be able to get enough dirt on Raffensperger to send him to Reidsville for the next 20 years.

Previously Unreleased Document Raises More Questions About Fulton County’s 2020 Election

Fulton County was unaware that the document was in someone's possession prior to its release.

ADDISON BASURTO  October 14, 2022

A previously unreleased document for the certified vote recount (Machine Count 2) conducted on December 1st and 2nd, 2020 — titled “Batches Loaded Report #1” (BLR1), raises even more serious questions about how the certified vote count for the 2020 U.S. Presidential Election in Fulton County, Georgia was obtained.

Joe Rossi, a former business executive and chemical engineer, is a Georgia citizen whose election integrity group’s work was the basis for Governor Brian P. Kemp’s letter date November 17, 2021, where Kemp (R) said the State Election Board (SEB) “must act swiftly” regarding the Risk-Limiting Audit Report for Fulton County.

Specifically, the governor stated that, “the data that exists in public view on the Secretary of State’s website of the RLA report, does not inspire confidence. It is sloppy, inconsistent and presents questions.”

On December 2, 2020 at 11:52 PM, Fulton County Georgia announced, “Fulton County Has Completed The Recount Of The November 3 Presidential Election. Results will be released by the Secretary of State’s Office.”

Subsequently, on December 3rd, 2020 at 12:06 PM, the first Batches Loaded Report (BLR1) report was time-stamped. The BLR is produced after uploading each tabulator’s memory card to the Dominion Election Management System and is the final vote count.

The metadata for BLR1, measured in Zulu Time, said the BLR1 report was created at 12:06 PM, while the email from then-Fulton County Elections Director Richard Barron to Ryan Macias, a member of the National Task Force on Election Crises and “elections expert,” was sent at 12:13 PM, just seven minutes later. The email had an attachment, “Batches Loaded Report.xml.”

Barron admitted in a Fulton Elections Board Meeting on December 4th, 2020 that their vote count was short of Machine Count 1’s total, the original November 3rd tally. In that same meeting, Barron stated that “the state” told them to “reconcile” it.

Seven minutes later, at 12:13 PM, Batches Loaded Report 1 (BLR1) was attached in an email sent by Richard Barron to Ryan Macias.

In the aftermath of the 2020 US Presidential Election, Ryan Macias came to the aide of former Cybersecurity and Infrastructure Security Agency for the Department of Homeland Security (DHS), Chris Krebs, by agreeing with his assessment that the reports about problems in Georgia’s election were “factually inaccurate.”

511,727 votes were recorded in Batches Loaded Report 1 (BLR1), about 17,000 votes short of the November 3rd total from Machine Count 1.

The reconciliation process requested of Richard Barron by “the state” resulted in the generation of Batches Loaded Report #2 (BLR2) sometime after 12:06 PM on December 3rd, 2020. Batches Loaded Report #2 (BLR2) totaled 527,925 votes.

These questions remain unanswered for the reconciliation process for Machine Count 2, which generated the BLR2 total of 527,925 votes.

  • Why were there 3,125 confirmed duplicate ballot images?

  • Why were there 17,852 confirmed missing ballot images?

  • Why were there 13,642 early votes backloaded between 10:16 PM on December 3rd and 12:30 AM on December 4th?

  • Why were 239 absentee ballots added on December 3rd, 2020 at 1:48 PM?

  • Why were 2,897 absentee ballots added on December 3rd, 2020 between 8:10 PM and 8:18 PM?

This information reinforces the idea that something suspicious occurred regarding Batches Loaded Report #2 (BLR2).

The Office of the Fulton County attorney confirmed in an email that there is no record for the tabulator tapes listed below:
