Legally Speaking: Maricopa County ballot lawsuit could have merit

KTAR News by Monica Lindstrom 11/9/2020

https://ktar.com/story/3688136/legally-speaking-maricopa-county-ballot-lawsuit-could-have-merit/

Quote

Due to a recent lawsuit filed in Maricopa County, we may have to wait even longer to find out who actually won what election.

The Donald J. Trump for President Committee, the RNC and the Arizona Republican Party have made good on their word and have filed a lawsuit in Maricopa County claiming legal ballots were not counted. The plaintiffs are asking the court to order Maricopa County to review and adjudicate all ballots that were cast by overriding the machine’s rejection of the ballots and hold off on the certification of the results of the election until this is done. It is the “Green Button” controversy.

On Election Day, Maricopa County voters showed up in person to voting centers and submitted their completed ballot to electronic tabulation machines. According to the complaint, these tabulation machine models had never been used in any Maricopa County election prior to 2020.

The heart of the lawsuit comes down to what happened when a voter would attempt to feed their ballot into the machine. “After marking their ballots, voters deposit them into the tabulation device. If the tabulator detects an apparent defect or irregularity on the face of the ballot, it will display an alert and eject the ballot.”

The complaint explains the proper procedure when this happens is “the voter may obtain and cast a new ballot, and the original ballot is deemed ‘spoiled.’ Alternatively, if the voter chooses to cast the original ballot notwithstanding the apparent defect or irregularity, the ballot must be physically deposited in a drawer within the tabulation device. Those ballots are then later subjected to further review and adjudication at the counting center.”

Trump Campaign Comically Unveils ‘Marking Device’-gate Lawsuit After ‘Sharpiegate’ Branding Falls Flat

Law & Crime by Matt Naham Nov 9th, 2020

https://lawandcrime.com/2020-election/conservative-lawyers-quietly-dropped-lawsuit-that-pushed-debunked-sharpiegate-conspiracy-theory/

Quote

Sharpiegate is dead, at least the one about the 2020 election rather than the one about Hurricane Dorian’s trajectory and the censorship of government scientists.

On Monday, the Trump campaign unveiled a new lawsuit repackaging debunked claims that poll workers gave Trump supporters markers—knowing that those markers would bleed through ballots and that the ballots would not be counted, and all to help Joe Biden win Arizona.

Not long after Law&Crime published a story on conservative lawyers withdrawing a lawsuit on the “Sharpiegate” conspiracy theory, a representative of The Kolodin Law Group PLLC sent us a copy of the law firm’s new complaint about this issue, dated Nov. 9. Unlike the original complaint, the new suit names the Trump campaign as a plaintiff. Also unlike the original suit, the facts of the case do not refer to a Sharpie but to a “marking device.”

The lawsuit included exhibits of declarations that were signed on Nov. 4 or Nov. 5. The exhibits, which predated the notice of dismissal for the initial complaint, were the only parts of the filing that referred to Sharpies by name; neither the facts of the case nor the section on causes of action in the updated complaint did so.

Trump campaign adviser leading election lawsuits effort has COVID-19, reports say

The News & Observer by Bailey Aldridge  11/9/2020

https://www.newsobserver.com/news/nation-world/national/article247080562.html

David Bossie, an adviser for President Donald Trump’s campaign, has tested positive for COVID-19, according to multiple reports.

Bossie, who is in charge of the lawsuits and other efforts to contest the 2020 presidential election results, tested positive for the coronavirus on Sunday, Bloomberg, ABC News and CBS News reported Monday.

The Associated Press declared now President-elect Joe Biden the winner of the election Saturday. The Trump campaign has said it will bring the outcome to the courts.

Lawsuit claims election fraud in Michigan's Wayne County

By Scott McClallen | The Center Square 11/9/2020

The Great Lakes Justice Center (GLJC) has filed a lawsuit alleging fraud in Wayne County's vote counting process.

Filed on behalf of several poll challengers, the lawsuit alleges that Wayne County election officials allowed illegal and fraudulent processing of votes cast in Tuesday’s election.

Seven witnesses filed affidavits attesting to allegedly fraudulent activities.

The complaint claims:

•   Ballots were counted even though the voter’s name did not appear in the official voter rolls.

•   Election workers were ordered to not verify voters’ signatures on absentee ballots, backdate absentee ballots, and process such ballots regardless of their validity.

•   Election workers processed ballots that appeared after the election deadline and falsely reported that those ballots had been received prior to Nov. 3, 2020 deadline.

•   Defendants used false information to process ballots, such as using incorrect or false birthdays.

•   Defendants coached voters to vote for Joe Biden and the Democratic Party. Election workers would go to the voting booths with voters to watch them vote and coach them for whom to vote.

•   Unsecured ballots arrived at the TCF Center loading garage, not in sealed ballot boxes, without any chain of custody, and without envelopes.

•    Defendants refused to record challenges to their processes and removed challengers from the site if they politely voiced a challenge.

Detroit Election Clerk Janice Winfrey didn’t respond to a request for comment.

Detroit lawsuit alleges new problems at TCF counting center, citing 5 affidavits

Detroit News by Beth LeBlanc 11/9/2020

https://www.detroitnews.com/story/news/politics/2020/11/09/detroit-lawsuit-alleges-new-problems-tcf-counting-center/6223885002/

Quote
A third lawsuit has been filed over Michigan's vote count, this one filed in Wayne County Circuit Court and alleging problems with the counting process at TCF Center in Detroit.

The filing relies on the affidavits of four Republican poll challengers and a city of Detroit employee who said she worked in the city's election headquarters through September, a satellite clerk's office in October and the TCF Center the day after the election.

Besides the affidavits, no actual evidence of the alleged issues was presented.

The allegations range from restrictions on poll challengers to late arriving batches of absentee ballots to the encouragement of early voters to cast their ballots for Democratic presidential candidate Joe Biden. Election officials have said they allowed the maximum number of poll watchers for both Democrats and Republicans, only restricting access to any additional poll watchers because of COVID-19 concerns.

Photos: Pennsylvania Data Shows That 109k Of The Mail In Ballots Were Returned BEFORE They Were Mailed
November 9, 2020 Alex Hall

Pennsylvania and Wisconsin are the only two swing states where officials can begin processing and counting the millions of absentee ballots only on Election Day, which delaying complete results for several days. (In a third crucial swing state, Michigan, clerks can begin processing ballots only the day before Election Day.)

These elections are one of the worst in our history as mail-in ballots caused a huge mess!

Pennsylvania data shows that some of the mail-in ballots were returned BEFORE they were mailed, on the same day or next day. I marked such ballots as “Suspicious” (RED) in the plot. There are 109421 (3.53%) “Suspicious” ballots.

Alabama Attorney General Joins Group Supporting Lawsuits over Pennsylvania’s Mail-in Ballots

https://www.alabamanews.net/2020/11/09/alabama-attorney-general-joins-group-supporting-lawsuits-over-pennsylvanias-mail-in-ballots/

Alabama Attorney General Steve Marshall joined nine other attorneys general in filing an amicus brief in support of two lawsuits seeking U.S. Supreme Court review of the constitutionality of the Pennsylvania Supreme Court’s decision to extend the deadline for mail-in ballots in the state.

“Judges are supposed to be servants of the law, not the makers of it,” Attorney General Marshall said in a statement. “Those sitting on the Pennsylvania Supreme Court apparently think different, handing down an eleventh-hour decree that contravened our constitutional order and invited possible fraud. This cannot stand.”

“I join my fellow attorneys general in calling upon the Supreme Court to rule on the decision by the Pennsylvania Supreme Court to rewrite state law by arbitrarily extending the deadline for Pennsylvania’s mail-in voting and ordering that ballots showing up after Election Day with no postmark be assumed to have been mailed before Election Day,” Marshall said.”The court’s action defied state law, ignored the constitutional command that legislatures-not judges-set the manner of presidential elections, and made Pennsylvania’s election less secure.

Trump’s Vote-Count Lawsuits: The Election Endgame
By Andrew C. McCarthy

Human error and cheating occur in every election. The issue with fraud claims is whether it made a difference -- for the president, that is a steep mountain to climb.

President Trump’s campaign is vowing to file lawsuits challenging the results of the 2020 election in several key states. Ground zero for litigation is Pennsylvania. Rudy Giuliani, representing the president and the campaign, held a press conference in Philadelphia on Saturday, adumbrating the lawsuits he plans to begin filing today.

To call this an uphill battle understates the matter. At the moment, presumptive President-elect Biden is computed to be ahead in the electoral vote, 290 to 214. Three states have not yet been “called” (I’ll address what I mean by that shortly): Georgia (16 electoral votes) leaning Biden, and North Carolina (15) and Alaska (three) leaning Trump. That is a probable final “call” of 306 to 232 — ironically, as many have observed, the same total the president won by in 2016. Contrary to what he has claimed ever since, that is no landslide. It is, however, a commanding lead. He would need to flip Pennsylvania, where Biden leads by about 46,000 votes, plus at least two other states — the plausible candidates would seem to be Georgia, Arizona, and Wisconsin, where Trump is currently behind by less than one percent — respectively, 10,000, 17,000, and 20,000. The Trump camp also complains about voter fraud in Michigan, but he trails by over two percent (146,000) there.

Over a period of 67 minutes, Trump's votes actually decreased by 33k votes while Biden's continued to rise.

If a political party does not have its foundation in the determination to advance a cause that is right and that is moral, then it is not a political party; it is merely a conspiracy to seize power.

-Dwight Eisenhower-

"The [U.S.] Constitution is a limitation on the government, not on private individuals ... it does not prescribe the conduct of private individuals, only the conduct of the government ... it is not a charter for government power, but a charter of the citizen's protection against the government."

Nov 10: The Biden bubble stops expanding as a river of affidavits flows

JoNova

https://joannenova.com.au/2020/11/the-biden-bubble-starts-to-pop-biden-back-to-259/

Quote
Today the world noticed that RealClearPolitics still hasn’t called Pennsylvania for Biden. Their “tally” for him stands at 259 Electoral College votes.  CNN has him at 279. AP has him at 290.

So is he or is he not the President Elect? He’s not (see Bannon and Gorsky). He never was — that title can only be conferred by the Electoral college or the House, not the media. Cancel the corona-free parties… send back the congratulatory messages. Biden is the unverified President Elect. He’s the estimated President Elect.

The case for voter fraud grows stronger every day

Watch the latest WhiteHouse press conference. There are now 131 affidavits in Michigan alone — including people willing to swear they were told to backdate ballots, an illegal activity.

In Pennsylvania, 682,000 ballots were counted that no Republicans were allowed to watch, which is illegal. Plus other rules were different for Democrat counties and Republican Counties. Biden’s lead is 45,000, and is one legal decision away from disappearing.

Media censorship is over-the-top

The overreach will burn. Even Fox news found the Whitehouse Press Briefing above so scandalously blasphemous they had to protect viewers and actively override Kayleigh McEnany, and hide her message:

Fox News host Neil Cavuto stopped airing White House press secretary Kayleigh McEnany briefing on Monday afternoon after she accused Democrats of “welcoming illegal voting” and not being interested in counting all legal votes.

“You take these positions because you are welcoming fraud and you are welcoming illegal voting,” she said about Democrats and the media.

“Whoa, whoa, whoa,” said Fox News host Neil Cavuto. “Unless she has more details to back that up, I can’t in good countenance continue showing this.”

One nugget of gold to come out of Trump’s battle to expose the democrat party as a Third World party, willing to cheat and subvert the constitution, Trump will know with certainty who his loyal friends and allies are!

If Trump manages to beat back this democrat steal and win back HIS presidency, he will be politically INVINCIBLE next term!

Everything was on the line for democrats. Biden’s influence peddling enriching his family, Obama/Biden administration illegal FBI surveillance of the Trump campaign, the bad actors in the FBI corruptly undermining the President and currently under DOJ investigation, etc. The democrats had to win the election at all cost. So they bought election insurance...in Michigan, Arizona, Pennsylvania, Wisconsin, Nevada, etc.

Trump wins? A lot of people know they’re going to jail. Biden wins? They’re in fat city.
