17-year-old challenges extradition to Wisconsin over Kenosha shooting charges
By Kaelan Deese - 09/26/20 11:58 AM EDT

The teenager charged in the shooting deaths of two protesters in Kenosha, Wis., this summer is challenging his extradition from Illinois.

Kyle Rittenhouse, 17, surrendered to law enforcement in his hometown of Antioch, Ill., a day after prosecutors say he shot and killed two protesters and wounded a third in Kenosha on Aug. 25.

Lawyers claim Rittenhouse was acting in self defense when he fired on the two people amid protests over the police shooting of Jacob Blake, a Black man who was shot during an arrest in the city.

Rittenhouse is charged with first-degree intentional homicide in the killing of two protesters and attempted intentional homicide in the wounding of a third.

John Pierce, an attorney for Rittenhouse, asked a judge Friday to give him a month to prepare arguments challenging the teenager's extradition to Wisconsin to face the charges, The Associated Press reported.

The lawyer said the request involves "issues of some complexity, frankly that have not arisen in the country for some time."

Judge Paul Novak allowed the defense 14 days to review papers and file pleadings over Rittenhouse's planned Oct. 9 hearing.

Illinois Gov. J.B. Pritzker (D) signed a warrant to extradite Rittenhouse to Wisconsin at Gov. Tony Evers's (D) request, Lake County state's attorney Mike Nerheim said Friday, according to the AP.

Nerheim said that in his 20 years of work he had never seen anyone fight extradition after a governor signed a warrant.

I believe Rittenhouse acted in self-defense each time he fired his gun, but do not know on what grounds the extradition could be overturned.

Three times in this short excerpt it inaccurately says he killed protesters.

These were rioters and criminals with past arrest records who assaulted Kyle.  To call them just 'protesters' is ridiculous and like calling a guy intentionally running you over in a car just a 'driver'.

Kyle Rittenhouse makes first court appearance the day after his mother, lawyer got standing ovation at Waukesha County GOP event

Komie predicted that if Pritzker did sign off on the warrant, Rittenhouse's lawyers could challenge it with a writ of habeas corpus, as Pierce indicated Friday he would, and a judge would hold a hearing with witnesses from Kenosha, less than 20 miles away.

If after that hearing the judge denies the request and upholds the extradition, Rittenhouse could appeal that decision.

"Absent an appeal, it could take as long as six months," Komie estimated.

There is yet another option: The two governors could make a deal about the return, though that also seemed unlikely in Rittenhouse's case when both governors have already taken the standard steps.

Komie said any sort of political arguments about Rittenhouse's case that wouldn't get traction in an extradition hearing could become part of negotiations between governors.

As examples, he pointed to when a country without the death penalty refuses to extradite someone to a country where the person held could be executed, or agrees to extradite only after exacting assurance the death penalty would be off the table.

Komie once had a client who had escaped a chain gang 25 years earlier and the governor declined to send him back to Mississippi.

But in the end, Komie expects Rittenhouse will wind up in Wisconsin.

"After 43 years of experience," he said, "I'd say it's a classic self-defense (case) that will play out in front of jurors in Kenosha County."

Attorneys push self-defense theory

Other experienced defense lawyers agree that Rittenhouse — regardless of what people may think of the judgment in carrying a rifle to a tense, large-scale civil disturbance — has a solid, though not guaranteed, claim of self-defense.

But rather than waive extradition and demand a speedy trial in Kenosha, Friday's hearing suggests his controversial defense team will drag the case out. The longer the process takes, the more time the #FightBack Foundation can collect donations for Rittenhouse's defense and its other causes, like suing mainstream media outlets.

His lawyer needs to do what they did with the Rodney King case. Show the tapes a hundred, two hundred, heck three hundred times. Make the jury realize it was self defense pure and simple.

I suspect Rittenhouse, his family, and lawyer are ceding that as likely and going scorched earth against IL Goobernor Putzker, WI Goobernor Evers, and against the unjust DA's office in WI. When you put someone in the place of having nothing to lose it gives them a lot of freedom.

I hate saying this, but people like Rittenhouse and that couple in MO need to go berserker against the political grandstanding DAs (and other grandstanding gooberment officials) and bloody up a bunch of political careers (that's a metaphor, son, that's a metaphor)!

Same way with canceler-wannabes. Counter-attack them and raise the cost of cancel-attempts.

Kyle will have some serious dough once he is able to spend it on other than lawyers.

GoFundMe missed out on a $100k payday

Nearly $1 million has been raised for Kenosha shooting suspect Kyle Rittenhouse, according to a Christian fundraising site and the teen's lawyers

That can be his defense at his trial but I don't see how it's a reason to avoid extradition.  I can't imagine what the "issues of some complexity, frankly that have not arisen in the country for some time" can be.

LOL!  I'm pretty sure his lawyers are going to take the biggest chunk out of that.

At any rate there needs to be a price to pay for these political prosecutions, which is exactly what they are - political.
