Judge holds Godspeak chapel and Pastor Rob McCoy in contempt, orders fine

Pastor Rob McCoy and the Newbury Park church he leads were held in contempt of court Friday for failing to obey a restraining order that prohibits indoor worship services in an attempt to curb COVID-19.

Ventura County Superior Court Judge Vincent O'Neill Jr. issued the ruling against McCoy and the Godspeak Calvary Chapel after a two-hour hearing in Ventura. He fined the chapel $3,000, but did not impose any fines on McCoy.

That was half the $6,000 Ventura County officials had recommended against the church, based on a fine of $1,000 for each of the six services held indoors over the past two Sundays. County officials had not recommended a fine against McCoy either.

The judge said he thought there were "mitigating circumstances" for violating the order, but that he had not heard any suggestion that the indoor services would be stopped in the future.

O'Neill did not specify the circumstances in his ruling, but McCoy testified that there were numerous problems with holding services outdoors.

He said Executive Pastor Tony Logan must stay indoors because of a severe sun allergy; that the church had received threats of violence; that he could not find a park large enough to accommodate the worship services; and the temperature had risen close to 100 degrees on a recent Sunday.

O'Neill said it was an unpleasant duty before him, but concluded that the church and the pastor were in contempt of the order. He said the order was valid, the accused was aware of the order, there was the ability to comply and there was willful disobedience although well motivated.

"I fully understand that freedom of religion is protected by the very First Amendment, but I have a duty to uphold the court's order that was duly issued," O'Neill said. ..........

The Constitution is clear on this one.  This judge is in violation of the very oath he swore to uphold.  He should resign.

An emergency order cannot contain orders that conflict with the constitution!

I don’t give a d@mn if the SCOTUS themselves rule in favor of these tyrants!

As a matter of fact: In Marbury v. Madison the Supreme Court announced for the first time
the principle that a court may declare an act of Congress void if it is inconsistent with the Constitution.

“All laws that are repugnant to the Constitution are null and void."

So if Congress can’t enforce unconstitutional law(s) then what these legislators Should be doing is attacking and ignoring the unconstitutional, individual demands within the order itself!

And NO, a state’s constitution Does Not override the Federal Constitution!
