There has been a small development in the case against Volodymyr Zhukovskyy that suggests what prosecutors expect Zhukovskyy to be.
Zhukovskyy is the 23-year-old Ukrainian immigrant who drove his pickup truck and trailer into a pack of motorcycles in Randolph, New Hampshire on June 21. 2019. The bikers were were all members or associates of the JarHeads Motorcycle Club. The dead are Jo-Ann and Edward Corr; Michael Ferazzi; Albert Mazza; Daniel Pereira; Desma Oakes; and Aaron Perry.
Earlier this week, Coos County, New Hampshire prosecutors asked Judge Peter Bornstein permission to “conduct a Further examination†of the truck Zhukovskyy was driving when the tragedy occurred.They want a company named Crash Labs Inc.to “conduct testing or take additional measurements of the truck†and “return the vehicle to its previous post-crash state.â€
Zhukovskyy seems to have a very limited number of defenses at trial. One would be to argue that he was innocently incapacitated in some way – say by a mental illness that prevented him from knowing what he was doing. The other obvious defense is to blame the truck. That seems to be where this case is headed.
