A federal lawsuit filed Thursday says the Texas prison system is “callously” denying thousands of inmates access to a costly hepatitis C medicine that is widely considered the standard of care, potentially exposing them to liver damage and other health complications.

At least 18,000 inmates in the state’s 104 facilities have been diagnosed with the chronic virus. And up to 30 percent of Texas’ roughly 148,000 inmates may be infected — a similar rate to prisons across the nation.

Inmates in at least a dozen states have file similar lawsuits, and litigants in Massachusetts, Minnesota, California, Colorado and Pennsylvania settled and now have access to the costly and highly effective medication sought by Texas prisoners. Louisiana officials made an agreement with the drug maker to get preferential pricing for the hepatitis C drug so that they can treat everyone, according to the class action lawyers.

Hep C can bring slow unpleasant death. A friend's Mom died of Hep C, years ago obviously, who had none of the behavioral stuff by which many get the virus. She got it via blood transfusion during a surgery. Hep C is seriously nasty.

The basic argument the inmates are making is that a 10 year sentence (or similar duration that would not take the inmate beyond the natural human lifespan) should not be a death sentence. Not giving a well known and effective treatment for their disease would have that effect and, they contend, would constitute cruel and unusual punishment.

Whether or not one favors that argument, it is not as frivolous as inmates suing for meds and surgery to effect a sex change.

It may be a 'standard', but I wonder what % of population has the shots?

These are prisoners, convicted of crimes.

They should not be placed ahead of the bulk of US citizens when it comes to health. 

That is not paying for crimes, it is rewarding them.
