Supreme Court rejects Trump plea to enforce asylum ban

WASHINGTON (AP) — The Supreme Court won’t let the Trump administration begin enforcing a ban on asylum for any immigrants who illegally cross the U.S.-Mexico border.

New Justice Brett Kavanaugh and three other conservative justices sided with the administration.

The court’s order Friday leaves in place lower court rulings that blocked President Donald Trump’s proclamation in November automatically denying asylum to people who enter the country from Mexico without going through official border crossings.

Trump said he was acting in response to caravans of migrants making their way to the border.

The administration had also complained that the nationwide order preventing the policy from taking effect was too broad.

But Chief Justice John Roberts and the court’s four more liberal justices rejected the administration’s suggestion for narrowing it.

All this means is the SC will allow the case to progress through the system naturally, not that they won’t hear it, at all.

Roberts is one of the liberal justices.

A great example of why voting for the Pubs so we avoid having leftists on the court is a 50/50 crap shoot at best.

I'll bet when the obamacare appeal gets to the SCOTUS Roberts will side with the liberal justices in defending it, even though his basis for saying it was constitutional was the "taxing" component (the individual mandate) which has been eliminated.

Correct decision.  It’s a shame that Kavanaugh was on the wrong end of it, although that may have to do more with the issue of national injunctions and not asylum.

That is my thought exactly.  Roberts appointment was a mistake.  He is a liberal and I find it quite disturbing that he was sell out this country.  In essence he has ruled that the Commander in Chief does not have the authority to protect this country.  He's ruling politically rather than constitutionally!

I hope Ginsberg decides to step down after the first of the year and Trump gets to appoint another conservative.

Nope. 

First, the lower court’s decision is correct on the asylum law, which is pretty clear and pretty clearly does not support what Trumpie Bear wants to do. 

Second, a nationwide temporary injunction makes sense because otherwise, the state that sits within the district covered by the district court’s order would be unfairly burdened by people going there to file asylum applications.

So, how is it that Ginbserg was able to vote on this??  It has been reported that she voted from her hospital bed.  Yet, McCain's vote was not acceptable unless he actually was in chamber.  ????
