President Donald Trump’s tax returns, which he has refused to make public, can’t be obtained by a non-profit organization using the Freedom of Information Act, the federal appeals court in Washington ruled.

The information is shielded by a taxpayer privacy law passed after President Richard Nixon tried to use the Internal Revenue Service to harass his political enemies, Circuit Judge Karen LeCraft Henderson said in an opinion Tuesday, upholding a lower-court ruling against a FOIA request by the Electronic Privacy Information Center.

With “certain limited exceptions” contained in the law, “no one can demand to inspect another’s tax records,” Henderson wrote, for a unanimous three-judge panel of the court.

Trump has insisted on keeping his tax returns confidential, going against a precedent first set when Nixon voluntarily disclosed his in 1974. Every president since then has allowed his tax filings to be made public.

No it won’t.  26 USC 6103 expressly permits the release of an individual’s tax return information to the Ways and Means Committee, or other Congressional committees without the consent of the person involved. 

What’s also clear is that she can’t unilaterally divulge that information to the public without his consent, but how far the fruit of the poisoned tree will go remains to be seen.

A three-judge panel on the federal court of appeals in D.C. denied a non-profit’s attempt to force the IRS to release President Trump’s tax returns.

In an unanimous riling, the D.C. Circuit Court of Appeals said not all records can be accessed by the public through a Freedom of Information Act request and affirmed a lower court’s decision to dismiss the Electronic Privacy Information Center (EPIC)’s lawsuit, which sought Trump’s income tax records.

“No one can demand to inspect another’s tax records,” Karen LeCraft Henderson, a George H.W. Bush appointee, said in the court’s majority ruling.

“And the IRC [Internal Revenue Code]’s confidentiality protections extend to the ordinary taxpayer and the President alike.”
