Barbershop Workers Quit After California Supreme Court Ruling
« on: September 09, 2018, 06:08:51 pm »
Coming to a State near year. This is already hurting the independent contractor business in California. This article is on barbers, but I am seeing the biggest complaints from software development/design forums where those type of independent contractors were doing very well in California and preferred that type of work.

Quote
A recent California Supreme Court decision is changing the way independent contractors are classified, and it’s already having a big impact on local shops. May fear it will hurt millions of workers and affect businesses’ bottom lines.
The work doesn’t stop at Downtown Sacramento’s Bottle and Barlow, even if it became a one-man shop......

....WHAT IS AN INDEPENDENT CONTRACTOR?
The April 2018 court ruling now says workers are assumed to be employees unless all three of these factors can be proven:
(A) that the worker is free from the control and direction of the hirer in connection with the performance of the work, both under the contract for the performance of such work and in fact;
(B) that the worker performs work that is outside the usual course of the hiring entity’s business; and
(C) that the worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed for the hiring entity.......

Our Commonwealth has recently passed a REPUBLICAN sponsored House Bill 487 that went into effect July 1 that requires all non-profits, churches and charities along with independent contractors and anyone in a service industry to pay a 6% excise tax on all services/sales/goods.  This includes haircuts, suntan booths, nail salons, church bake sales, church tithes, missionary donations and offerings.

Government is an insatiable ravenous beast that can never be satisfied.  It will eat all and everything until it kills the host.

Fart for freedom, fart for liberty and fart proudly.  - Benjamin Franklin

...Obsta principiis—Nip the shoots of arbitrary power in the bud, is the only maxim which can ever preserve the liberties of any people. When the people give way, their deceivers, betrayers and destroyers press upon them so fast that there is no resisting afterwards. The nature of the encroachment upon [the] American constitution is such, as to grow every day more and more encroaching. Like a cancer, it eats faster and faster every hour." - John Adams, February 6, 1775
