Judge Napolitano Doubles Down: Says Paul Manafort was Exonerated 8 Years Ago — May Call Rosenstein as First Witness (VIDEO)
by Jim Hoft August 1, 2018

Judge Napolitano dropped a bomb Tuesday on FOX and Friends.

The FOX News legal analyst told the audience that Paul Manafort was already exonerated eight years ago on these same charges and… Rod Rosenstein was the lawyer who exonerated him!

Here’s the Transcript via Bizzy Blog:

ANDREW NAPOLITANO: Here’s Manafort’s defense: I was investigated for all this by the government eight years ago, and I was exonerated. And I’m going to put on the stand as my first witness the young lawyer who exonerated me.

You know who that young lawyer is? Rod Rosenstein.

    STEVE DDOCY: What?

NAPOLITANO: Yes! So this is going to be quite a show if they succeed in getting Rosenstein, who now runs the Justice Department —

DOOCY: So why was I innocent then and guilty now?

    NAPOLITANO: There you go.

That’s correct!
Manafort was “exonerated” by federal prosecutors led by Rod Rosenstein.

When the government brings charges against you and you're acquitted, that's exoneration.  They wanted to get Yanukovych at the time and didn't pursue charges after the Ukrainian president split for Moscow.  That killed Manafort's golden goose.  Instead of taking this gift, he used his properties to commit bank fraud multiple times, afterwards to keep the money coming in.  He's a special kind of stupid.
I disagree.  Circle gets the square.

Doesn't this also trigger the statue of limitations?  The government knew about this 8 years ago.  SOL for tax fraud is 5 years.

So, you're saying he was never charged previously, and has since committed other crimes.   His arrogance convinced him that he was eternally 'exonerated'.   Yeah, that's stupid.

I think it's 14 years.

... civil tax fraud and criminal tax fraud have different statute of limitations. For civil tax fraud, there is no statute of limitations, and the tax may be assessed at any time. By contrast, there is a criminal statute of limitations, but it applies only to the prosecution of the crime—the actual tax evasion—not the assessment of the tax owed. Typically, the statute is three (3) years after the taxpayer commits the offense. But there are certain, specified carved out offenses for which a six (6) year statute of limitations applies....

It is also important to note that no deadline applies where the IRS can establish that a taxpayer has: 1) filed a false or fraudulent return; 2) willfully attempted to evade tax; or 3) failed to file a return. Unlike the circumstances above where tax returns are filed (even with errors), these are cases in which a taxpayer is willfully or intentionally not filing taxes or is filing fraudulent return(s). Not only will there be no time limit on IRS action against such taxpayers, but heightened interest fees and penalties will apply.

The original inquiry was under Holder.  They were more interested in Ukrainian corruption, likely as a way to push the Obama agenda with the Maidan Revolution.  Once Yanukovych fled, Manafort wasn't important to them as a witness.  They looked at the benefit of prosecuting him in a stand alone case, compared to a much larger one and said forget it.
