The government by way of judicial fiat, is forcing a business to bake the cake. Thus controlling content.
wrt your claim to censorship, the government would be forcing the business to provide balance, thus controlling the content.
No wonder I couldn't see what you were getting at. That's a stretch which requires a bunch of things to be declared equal to each other, but which are not actually equal to each other.
The baking of cakes is unlimited. There is no corner on the cake market. Anyone can compete and no one can prevent competition.
The Airwaves are a limited resource that cannot be shared equally among all citizens. This resource is licensed by the Federal Government with the stipulation that it not be used for politically biased broadcasting. It is a violation of the terms of the licensing for them to do exactly what it is they are doing now.
In the instance of baking a cake, Government compulsion is a form of slavery, because it is forcing someone to do something against their will.
In the instance of forcing the people who hold the licenses to share the limited resource that is regulated by government intervention, it was a requirement of the licensee to observe restrictions placed upon them regarding political bias.
They agreed to it. We should simply make them live up to their agreement.
It's the same damn coin, just opposite sides. Either way, it positively asserts that the government has the right to control business at an incremental level.
It's not even the same denomination of currency, let alone the same coin. The Government is built in to the limited resource known as "the airwaves", because it cannot be otherwise. Without regulation, we would go back to the power wars and sabotage that was common before the communication act of 1934.
There is no need to regulate the baking of cakes because a virtual infinite source of baked cakes is already available to the public, including the prospect of baking their own.
