Why Does Senator Sasse Wants to Keep the Filibuster?

By Ed Willing  |  August 24, 2017, 04:10pm  |  @EddieWilling

How many of you have seen “Mr. Smith Goes to Washington?”

If you haven’t, you are without.

This Jimmy Stewart gem is a must-see for any political junkie like myself, and tells the story of a regular guy roped into running for office by a slick politician, then standing up against corruption once he got there. Because of Senate rules, he was able to hold up the government taking action on something that the corrupt politician’s party supported. The rule was the filibuster.

The filibuster rule is one that says you need 60 votes to accomplish anything in the 100 member Senate, or to at least debate it on the floor. With roots in the ancient Roman Senate, parliamentary rules were used by Cato the Younger to resist Julius Caesar’s autocratic methods by simply talking non-stop until it was dark and Senate business had to cease. It took hold in the United States in the early 1800’s and naturally evolved from the Founder’s intent to make the Senate move slowly.

I think there are good arguments to go either way. Removing it would strengthen Congress, which is a good thing IMO.

If it is removed, we will be wanting it back if the Dems take the Senate back.

The Dems are going to remove it the first second its to their advantage...which means its dead as a tool for forcing consensus OR civil extended debate. Clinging to it under that circumstance is absurd...and patently foolish...as it simply means the Repub congress continues in paralysis whilst the next Dem congress will force through all the legislation it wants.

As for Cato...how did that work out for him? Not well...he was killed and Caesar appointed dictator for life, so not the best example of effective filibustering. Caesar was not stopped by long winded Senators, but by rude force. The Dems are far less caring of civil etiquette and civil law than was Caesar...you do the math.

The filibuster violates the spirit of the Constitution (majority rule), if not the letter.

The Constitution specifically states where supermajorities are required in American governance. The filibuster is not one of them (in fact, it's not even mentioned).

It's time to get rid of it, and let the chips fall where they may.

Sasse is just another GOP-e who would happily spend his entire career in the minority if he could. He'd probably prefer things that way, so he never had to take a stand on matters where his vote might actually change something.

Of course they will despite any denials they may have today.

Maybe rule changes should be made at the beginning of a session but not come into effect till the beginning of the following session. They'll be a whole lot more careful making rule changes blindly with no idea who may be favored.

You have the spirit exactly backwards. The Constitution is a protection of the minority against mob rule of the majority.

I'm all for a representative Republic, but the filibuster is ridiculous. When you win the majority of a house of the legislature, you've won. Adding another layer to give the minority total power over legislation is idiocy.

Want power in a chamber? Win the stinking election.
The Republic is lost.

I don't think it matters much.  Biblical prophesy says President Trump will be allowed "authority to act for 42 months."
At best, that gives the rats a year and a half to live without a filibuster before President Trump pushes the beautiful, shiny red button...the jolly, candy like button.

And not just the spirit, but the letter as well....

By then it will be too late.

I agree, but the filibuster is irrelevant if the Senate can't even muster 50 votes for a bill, and except for this list of crap (Promoting Women in Entrepreneurship Act, INSPIRE Women Act, Vietnam War Veterans Recognition Act of 2017) https://en.wikipedia.org/wiki/List_of_acts_of_the_115th_United_States_Congress the GOP can't pass nuthin'.

No Wall.
No Obamacare repeal.
No swamp-draining.
No fair trade.
No execution for Hitlery.

Did I just imagine those issues?
