I find it interesting that Justice Kennedy -- who was presumed to be ready to retire at the end of the Court term -- has not yet made any announcement as such.
I sense that he was "of the mind" to do so -- UNTIL Neil Gorsuch took his seat and started making waves, and driving the Court rightward even though his tenure is yet a short one.
Perhaps Mr. Kennedy realizes that once he vacates the seat, there's little likelihood of it being replaced by another wishy-washy swing vote as himself. Instead, there's a good chance that the next justice to fill his place will be a rip-roarin' conservative.
And that scares him.
Perhaps Mr. Kennedy has reconsidered for just this reason.
I hope to be proven wrong in the next couple of months.
But that's my take on things.
